Conservatives have spent years pointing out a two-tier justice system where Democrats weaponize government power against Donald Trump while dodging accountability for their own corruption. But another layer exists that is just as absurd. You would think natural-born Americans have more rights than illegal immigrants, but the case of Kilmar Abrego Garcia proves otherwise.
Abrego Garcia, a Salvadoran national living illegally in the United States, walked out of ICE custody in early December 2025 and promptly created a new TikTok account, ready to become the left’s latest viral sensation. His feed now features at least two Spanish-language videos showing him lip-syncing to songs in what appears to be a suburban neighborhood. One recent post has him mouthing along to a song by Danny Berrios, an American singer known for Spanish Christian music, and that video has racked up nearly half a million views.
Meanwhile, federal officials trying to enforce immigration law are silenced by court order.
DHS Assistant Secretary Tricia McLaughlin summed up the situation on X Saturday, writing, "So we, at [the Department of Homeland Security] are under gag order by an activist judge and Kilmar Abrego Garcia is making TikToks.” She added, "American justice ceases to function when its arbiters silence law enforcement and give megaphones to those who oppose our legal system.”

We’ve covered the accusations against Garcia here at PJ Media countless times already. Between being an illegal immigrant, an accused MS-13 gang member, a wife beater, and a human trafficker, it’s hard to imagine why he gets to walk free in suburbia and become a social media star.
How does this happen? Garcia's lawyers demanded in August that the Trump administration stop publicly calling him an MS-13 gangbanger, serial wife beater, human trafficker, or similar labels tied to the allegations. U.S. District Judge Waverly Crenshaw, an Obama appointee to the federal bench in Tennessee, ordered federal prosecutors in October 2025 to warn Department of Justice and DHS employees against making any "prejudicial" statements about Garcia. Crenshaw's order barred federal officials from publicly using terms like "gangbanger," "serial wife beater," or "human trafficker" to describe Garcia while the case is ongoing.
Then U.S. District Court Judge Paula Xinis, another Obama-era appointee, ordered the "immediate release" of Garcia from ICE custody on December 11, 2025, allowing him to return home to Maryland. Xinis extended her temporary restraining order, which keeps Garcia out of federal custody, through the Christmas holiday period. She claimed his "removal cannot be regarded as reasonably foreseeable, imminent, or in accordance with due process.” The judge also accused the government of misleading the court during a hearing last month.
Abrego Garcia has been engaged in a legal battle with the Trump administration since his March deportation to El Salvador and subsequent return to the U.S. This saga has turned him into a left-wing hero and now social media star. Now, Abrego Garcia posts carefree social media videos, playing the role of a harmless Maryland father lip-syncing to Christian music while Democrat-appointed judges block the administration at every turn. Federal authorities are effectively gagged, unable to even describe his alleged crimes without risking contempt. The result is a two-tier justice system where an illegal immigrant gang member, human trafficker, and wife beater enjoys more freedom of speech than the Department of Homeland Security.
