The PJ Tatler has obtained documents from the Justice Department detailing efforts to recruit attorneys and staff who are dwarfs or who have “psychiatric disabilities” or “severe intellectual disabilities.” On May 31, 2012, Assistant Attorney General Tom Perez issued a directive to affirmatively recruit people with these “targeted disabilities.”
This DOJ policy does not merely involve prohibitions against discrimination, but rather the documents reveal deliberate recruitment efforts to hire as attorneys and staff for the Department of Justice people suffering from psychiatric disorders and intellectual disabilities. Moreover, applicants can “self-identify” their disability by means of the “Standard Form 256, Self Identification Disability.”
Those with “targeted disabilities” may be hired through a “non-competitive” appointment. That means they don’t have to endure the regular civil service competition among applicants, but can be plucked from the stack of resumes and hired immediately instead.
According to the documents, those with these “targeted disabilities” may be hired “before the position is advertised” and even “before the position’s closing date.” Moreover, lawyers with psychiatric disabilities and “severe intellectual” disabilities receive a waiver from the requirement that a new DOJ employee have practiced law for one year before being hired.

No offence intended for you, Christian, but only a group of government lawyers could fail to see that hiring this way defeats the entire intent of Congress in establishing civil service guidelines for hiring. Where did this power come from to add the criminally insane to the lists of the favored in AA provisions?
Where does it say the “criminally insane” are going to be hired? “Criminally insane” implies a person who has broken the law and has been convicted of a felony due to insanity; this would disqualify anyone from seeking a DOJ position. The majority of people with psychiatric disabilities are law-abiding people.

If you read the document that is linked to, it says
“A qualified individual with a targeted disability is a candidate who, based on his or her background, skills, and experience would have otherwise been appropriate for selection for interview, with our without a disability.”
In other words, the disabled people WILL be qualified.
Whether “recruiting” is a good idea, that is another question, but let’s not confuse the discussion by assuming the people would not meet the ordinary qualifications.
This is the theory, but what is the practice? Quotas aren’t supposed to be requied by law, either.
“qualified” by appointment is clearly not the same as qualified and chosen by competitive civil service testing.
What is disturbing is that this policy allows, and provides camouflage, so that candidates may be hired, and then promoted and assigned, on a purely political basis, with no paper trail as to background or qualifications (or disqualifications). Further, because of the disability claimed, it will be that much more difficult to scrutinize and discipline them, without raising accusation of prejudice. A claim of disability by a candidate, or a claim by an existing employee of an emerging disability, effectively shields them from fair and objective oversight. It smacks of yet another move by the Obama administration to circumvent the authority of the congress, and the will of the people.
Maybe hiring dumb crazy lawyers is a good thing. Maybe Americans will have a better chance against them in court.

You’ll never fire one of these hires, even if they’re in a “serve at the pleasure” position. Since they were hired as disabled, they’re entitled to all the VERY robust protections of that abortion of a law, the Americans with Disabilities Act. The employer will be “reasonably accommodating” whatever the employee wants and if you even hint at disciplining or dismissing one, even if probationary, you’ll be in court in a heartbeat for discrimination against a disabled person. Since it would be a Republican administration trying to dismiss them, it is well to remember that in DC you can get a jury to sentence someone to death by hanging, drawing, and quartering just for being a Republican. The book is set in the not too distant future and the key premise is that incompetence is NOT a deterrent to hire someone for a job in either the public or private sectors. Among the more memorable characters is Twinkle a very very old man who has a job as a lap dancer that serves heterosexal males. He couldn’t be denied the job despite his age, gender or poor health (he is so arthritic he can barely move let alone dance).
It’s one of the funniest things I’ve read in years but it struck me as an inevitable development if we actually keep expanding the role of the state in all aspects of employment. It sounds like someone at the DOJ read this book and decided they would make a good place to try the concept of deliberately hiring the least promising candidates for jobs.
It staggers the imagination how a reasonable idea – preventing unfair discrimination – can be perverted into the wholesale destruction of the organization by forcing hiring of those who can’t help but weaken the organization and frustrate the achievement of its goals.
What next? Replace all the fit young people who staff our military with quadriplegics and the blatantly insane?

The “managers” at DOJ may not be aware of their limitations (due to their faith in their own perfection), but by the same token they don’t want anyone on their staff(s) who might be able to outperform them, that not being “career-enhancing”. As such, they will look for potential recruits who have no chance whatever of showing them up.
These managers may have an inflated opinion of their own brilliance, but they also know what their “non-adjusted” scores on the Civil Service Exam were. Which means that they know just how little effort any reasonably-competent person would need to apply to be promoted past them in a heartbeat.
The logical solution, from their POV, is to only hire those incapable of that much mental effort.
This doesn’t explain the little people (dwarves, midgets, etc.), but it would tend to explain the rest.

Looks like Barry is borrowing yet another strategy from Mao’s Cultural Revolution where doctors and engineers and other professionals were replaced by peasants in the interest of advancing the cause of the proletariat.
You cannot practice law if you have severe psychiatric or intellectual disabilities. Bar admissions prevent anyone from practicing with any kind of mental defect that could impact their practice.
Sounds to me like such bar rules violate the ADA if a disabled attorney can be reasonably accommodated in such a way as to enable him/her to perform the essential duties of the job. The essential function most important is to be a Democrat and associated with a Democrat front group. The USDOJ also probably has many more employees that are non-attorneys than it has attorneys. Understand also, that if you self-identify as disabled, you’re disabled under the ADA, so if I’m the friendly communist attorney who probably wouldn’t be hired even in a crazy Democrat administration and would be fired while a Republican President’s hand is coming off The Bible, I just claim I’m disabled, force “reasonable accomodation” and sue for discrimination if a mean and nasty Republican supervisor looks at me crossways.

In the 1960′s SECDEF McNamera instituted Project 100,000, an effort to recruit 100,000 people a year into the military who could not otherwise meet the mental requirements. An additional feature was that the fact these people were not mentally capable of meeting the normal requirements was to be concealed from their commanders. But gee, you know what? The commanders all figured it out anyway, somehow.
Project 100,000 showed MacNamera’s utter contempt for the uniformed military, as if his approach on Vietnam was not enough by itself.
Holder’s opinion of his own department clearly is similar to MacNamera’s: just a bunch of cannon fodder.

Back when John Kerry made his “If you’re stupid you’ll end up in Iraq” comemnt I told the WSJ Opinionjournal people about Project 100,000. Their initial reaction was like yours “Ya gotta kiddin’ me!” and then they did some research and found out the truth: The Dems actually had a program to make sure that stupid people did end up in combat zones.
And it was worse than I thought, too. I assumed that Project 100,000 was a total of 100,000 such people inducted into the military. The reality is worse: the goal was 100,000 people inducted PER YEAR!
Actually, this is probably brilliant strategery on the part of Eric Holder and his minions. Holder and other high-level officials are political appointments, meaning their job ends when the President is booted out of office (God willing that happens in November).
However, the vast majority of positions at DOJ and other government offices are regular career positions, meaning there is no real way of getting rid of people effectively. It takes A LOT to get rid of incompetent people in government jobs, as we all know.
So Holder and Co. are creating an environment at DOJ such that all of the low level positions that deal with the day-to-day operations are staffed by physically and mentally-challenged individuals who will not really be able to handle those tasks and are almost guaranteed to cause infinitely more problems for the incoming President.
Sounds pretty typical for the liberal mindset. Sabotage the next President’s efforts because you *know*, even if you aren’t willing to admit it to yourself, that you are yourself incompetent (and criminal in the case of Eric Holder). If the future DOJ goes after you for your own criminal activities, you have a way of attacking the opposition based on their noted deficiencies.

the act in the days before the internet, they had an “ADA Hotline” one could call to discuss the finer legal & technical points (ramps to the bldg, etc) of the act. The very first–AND ONLY–time I tried to use it I found the person on the other end of the line had a SPEECH IMPEDIMENT so severe as to be unintelligible.I had to hang up in disgust and frustration. Think of it: Here was a position requiring utmost verbal clarity in transmitting complex legal and technical information, yet the govt hires a disabled with a speech impediment–not a blind parson, not a paraplegic, or someone with a disability that does not preclude them from answering the phone and fielding questions–no, they have to pick the EXACT single disability that prevents them from full-filling the job requirement. Our ever-helpful government at work..

My father ran a small business with an unusual business model that eventually attracted IRS attention, so they sent out an auditor to meet in my father’s offices for a week (during which he had to pay his accountant big bucks to sit in), it took a week because the agent had just had a stroke, and could barely get out two words a minute. To be fair, he found everything in order, but it still cost muchos thousands of dollars to get there because of his (perhaps temporary but in any case) disability.
Maybe Holder’s just hiring people like him and his relatives. Nothing to see here. Move along.

There’s a couple of levels to this, but I think that holder has to have someone working for him to whom he feels superior. However, if they can’t easily be fired in the case of a Republican win, that can still be handled. Assign jobs to them that are real work, but are incredibly boring. I would suggest titles such as ‘vice president in charge of sitting next to the other guy’. Keep remembering that Obama was elected by only 30% of registered voters. There was a 58% turnout and of the people who actually voted, 52% voted for Obama. Multiply 0.58 and 0.52 and you get 0.30. Just 30% of registered voters saddled us with Obama. Forget about the polls and just vote. He has not gained followers.

This hiring program makes total sense. If you’re going to have government projects like Fast and Furious or Obamacare, then you have to hire crazy people and stupid people to implement those projects, because no sane or smart person would have anything to do with them.
The stupidity of hiring attorneys at the DOJ who have “psychiatric” or “severe intellectual” disabilities is obvious, so I won’t go into that. It’s already been ably covered by previous commenters, and thinking about it gives me heartburn.
But if I were a dwarf, I’d be deeply offended. There’s no reason dwarfism should be a “targeted disability” on par with these others. The physical handicaps associated with dwarfism do not imply some kind of psychological or intellectual handicap. There’s no reason for a dwarf to be treated as a mental inferior to attorneys who don’t have dwarfism. You want to talk about affirmative action run amok? My goodness, I’d be furious!

I think it is just an example of hiring ala Elizabeth Warren. Check the box and the favored ones can avoid civil service requirements. Nobody checks to see if it is true. “Self-identify” = call myself whatever will get me an end-run around merit.
In Holder’s DOJ how do you tell the “sever intellectual disabled” ones from the others?
Those with targeted disabilities probably have a harder time finding and keeping a job. I wouldn’t be surprised if there are statistics showing that those with physical handicaps like dwarfism have higher unemployment rates in society. So, would you rather these folks stay at home and collect unemployment? Or, would you rather the government give them a chance to contribute to society and earn a paycheck?
I’d also like to point out that while DOJ lets folks self-identify disabilities, it also has to be followed up with the Schedule A process. Meaning that a doctor or a state official has to certify the disability.
Many people with mental illnesses are able to fully function in society with medication and treatment. They probably just require more medical leave and flexibility from their employer.
What difference does it make….most of the staff Lawyers that work at DOJ are already brain damaged Liberals.

I was looking forward to reading about how lawyers who were dwarfs got preferential treatment in hiring in the Obama Administration…but no.
