The ongoing controversy over the use of public restrooms by transgendered individuals continues to devolve into an evermore bizarre sideshow. Most recently acting through the Department of Justice, President Obama has threatened to defund North Carolina schools if that state does not back away from its law limiting access to bathrooms based on biological gender. In a letter to Gov. Pat McCrory, DOJ contends that they and North Carolina would be in violation of federal civil rights law if the bill passes.
According to the Justice Department, the state law violates federal law under Title VII of the U.S. Civil Rights Act, which prohibits discrimination on the basis of sex. The Obama administration says that with the passage of House Bill 2, “the state is engaged in a pattern or practice of resistance to the full enjoyment of Title VII right by employees of public agencies.”

If the DOJ’s determination is upheld, North Carolina could lose federal education funding. During the current school year, state public schools received $861 million in federal funding. The University of North Carolina got $1.4 billion in 2014-15.

The whole drama defies reason. We don’t need laws dictating bathroom use one way or the other. This should not be a contest over which tyrants get to impose their worldview on their cultural adversaries. It should be an effort to protect the individual rights of all parties concerned, whether transgendered or not.
