A Federal court judge has ruled that Oracle destroyed or failed to save, email written by CEO Larry Ellison pertaining to a class action shareholder lawsuit. The suit, filed in 2001, claims Ellison and other exec’s made false and misleading statements about the company’s financials and product reliability. The court also said that the company failed to produce transcripts of interviews with Ellison conducted by author Matthew Symonds, who allegedly destroyed his copies in early 2007. The court ruled that Ellison was aware of the lawsuit and, as a co-holder of the copyright on the material, should have produced transcripts when asked.
