I think it serves our interests to keep up appearances, though.

Why would we care if Saddam goes into exile instead of getting killed or being tried for war crimes? Gone is gone.
If we decide we need him dead sometime later because he continues to be a threat after exile, well, he can be killed in exile if necessary.
