While I’d love to applaud this, let’s get real. If Texas passes this law, which is similar to the one currently under consideration in Wyoming, how long will it take for the Obama government to take us to court to get the law overturned? I’d give it five minutes, tops.
A Texas lawmaker says he plans to file the Firearms Protection Act, which would make any federal laws that may be passed by Congress or imposed by Presidential order which would ban or restrict ownership of semi-automatic firearms or limit the size of gun magazines illegal in the state, 1200 WOAI news reports.
Republican Rep. Steve Toth says his measure also calls for felony criminal charges to be filed against any federal official who tries to enforce the rule in the state.
“If a federal official comes into the state of Texas to enforce the federal executive order, that person is subject to criminal prosecution,” Toth told 1200 WOAI’s Joe Pags Tuesday. He says his bill would make attempting to enforce a federal gun ban in Texas punishable by a $50,000 fine and up to five years in prison.
Toth says he will file his measure after speaking with the state’s Republican Attorney General, Greg Abbott, who has already vowed to fight any federal measures which call for restrictions on weapons possession.
Toth acknowledges that Eric Holder would take this to court pretty much immediately. He says he hopes that we have this fight out at the state and federal level, so we may as well get on with it. The problem, then, becomes the courts. Arizona’s perfectly sensible immigration reform got squeezed by the courts even though it does a better job serving the purpose of the relevant federal law than current federal policy does.
Still, it may be worth the fight. And if any state is to be a part of that fight, it ought to be Texas.






But all those states legalizaing pot are okay…
The 10th Amendment to the Constitution gives to the States the right to decide for themselves when the Constitution does not give the power to the Feds. In the case of laws for or against Cannabis use (I am btw opposed), it is a States rights issue not a Federal issue. Texas goes its way and Colorado and California go theirs. Not our business.
Of course Texas and all other states that love freedom and the constitution should pass this law. If they get beat in the supreme court then these states should then say adios. Let’s see, about 30 states in New America and 20 in the rotting old.

Proper use of state law is an important aspect to resisting the assault on our freedom. It gives _every_ state official the _legal standing_ to refuse to obey executive orders, and it gives every federal official an excuse to disobey executive orders.
It isn’t just about whether or not the AG will sue. It is about putting whatever law we can, wherever we can, in the favor of constitutional law abiding citizens.

Well there are implications of that section of the Constitution. Its obvious it means From the Federal to the State. But read that passage again. By implication it also implies From the State to the Federal. It would be inconceivable to have a dictatorial central government surrounded by Republic States. The contract is bidirectional.
If we had a schedule of criminal penalties for violations of the Constitution by public officials and a mechanism for applying them, Texas’s action wouldn’t seem quite so necessary.
What a nation we have: a Marine carrying his weapons safely locked up as prescribed by the D.C. police can be locked up for “gun law violations,” yet federal officials can blandly dismiss the plain language of the Second Amendment and get away scot free!
The Democrats, particularly the Obama administration, are employing a Cloward-Piven strategy to the judicial system. They purposely do illegal and unconstitutional things that overwhelm the courts. It takes more than a year, at least, for a complaint to wend its way to resolution.
The States can retaliate in the same manner. Pass laws such as those in WY and TX and let the Justice Department attempt to cope.
So Eric Holder sues Texas, again. What’s new? Everytime we Texans turn around, Holder is suing our state. Let’s see; voter I.D.? Nope, not according to Holder. It’s racist. So he sues and the law is prosponed until after the election last November. Defunding Planned Parenthood? Well, that didn’t float Holder’s boat so he sued, and lost. EPA regulations that violated the actual law? Yeah, Holder sued on that, as well, and again he lost.
How many times does Eric Holder have to get thumped in court by Greg Abbott to realize that he can’t play with the big kids?
I wouldn’t suggest that Obama think he can just sign an E.O. and Texans will roll over like trained dogs and hand in their firearms. Ain’t gonna happen. This ain’t New York. The Alamo isn’t just a land mark; it’s our creed.
Let’s not forget the gerrymandering of 2010′s Census by then Rahm Emmanuel crony-capitalist-in-chief in Obama’s Executive branch of government. Obama simply moved the 2010 Census from Commerce Department to his trusted crony-capitalist bundler-in-chief Rahm Emmanuel.
Results of this were the serious undercounting of Texas’ white populations and overcounting of its Hispanic and Asian populations (especially Huston’s exploding Asian population increases????).
Anybody following not only Texas’ re-districting committee’s gerrymandering of district (voting) precincts but serious gymnastics involving eligible candidates? Especially around Austin, Texas??? HUH???
HAH! The fix is in, Progressive New Left Activists WILL destroy everything America…ACLU is leading the way. Amen.Pray.
Hold on messup. This whole issue is about overbearing government powers, and that is the whole reason for the ACLU’s existence! As far as I am concerned, both parties are equally bad. It was Bush who passed the Patriot Act remember – I can’t even go to my local library now without reading the warning sign about how the FBI can investigate the books you check out! And, both sides just agreed to extend warranties wire tapping until 2017. Bit by bit our constitutional freedoms and liberties are beng eaten away, it’s like the old expression about the boiling frog. And by the way, I am an independent with strng Libertarian bent, and voted for the Libertarian candidate in November, Gary Johnson.
Let me conclude by saying that while I have no great desire to own a gun (i’d probably end up blowing my own head off !) I take great solace from the idea that there may be those braver then myself out there who stand ready to resist encroaching power. And by the way, Red State has a great article pointing out that the purpose of the 2nd Amendment was not to protect hunters, but precisely to protect the people against government power and abuse!
BTW, anyone know what might happen under the following scenario: Let’s say that the FEDs decide to ignore a state law like this prosed one, and then they actually try to arrest someone involved in a transaction legal under TX law. The cops in turn try to arrest the FEDs and there is a stand-off. How might that play out? And how about a situation where the Governor himself ordered state troopers to enforce state law? Would the Feds then try to arrest the Governor for Treason? Am I the only one out there who has ever thought about this type of scenario?!

But assuming I didn’t know, I would have typed that phrase into Google. The very first result is Wikipedia, and the very first line in the Wikipedia article is:
