One Possible Explanation:

After murdering his daughter and attempting to murder her protector, Faleh Al-Maleki fled to the UK. A reader pointed out that perhaps the UK would not have him were he to face the death penalty. Perhaps this is the reason the prosecutors took the death penalty off the sentencing table. I have no way of knowing whether this was the case. However, the UK is bound by the European Court of Human Rights which, in the past, has ruled in just this way. For example, in the 1989 case of Soering vs UK, a German citizen committed a murder in Virginia, after which he fled to England. The United States asked for his extradition. The House of Lords approved it but Soering filed a claim with the European Commission of Human Rights. After Virginia assured the Europeans that Soering would not face the death penalty, the UK sent him back to America.

If so: Why have the prosecutors remained silent about this? And why did public defender, Billy Little, and the media present these facts as if Little’s argument had actually won the day for his client?

Arizona Prosecutors Won’t Seek Death Penalty in Honor Killing

Remember the case in which Faleh al-Maleki, an Iraqi-American father brutally ran over his daughter, Noor, in Arizona, then attempted to escape but was apprehended in Britain and returned to face justice?

Guess what’s just happened? The Arizona prosecutors have been scared off seeking the death penalty. Public defender Billy Little raised the specter of “How will it look for Christians to execute a Muslim?”

I kid you not.

Billy Little asked the judge to “take special precautions to ensure the County Attorney’s Office wouldn’t wrongly seek the death penalty because Almaleki is a Muslim.” Little called for an “open process (to) provide some level of assurance that there is no appearance that a Christian is seeking to execute a Muslim for racial, political, religious or cultural beliefs,” referring to County Attorney Andrew Thomas’ Christian faith.

Whoa!

Words fail me here. Are Christian lawyers, by definition, hopelessly biased against Muslims? This is a fact not in evidence. Is the public defender Christian? Why should this matter in America? What if the judge is Christian? Does Billy Little understand that Muslim judges do not usually prosecute men who honor murder their wives, sisters, or daughters?

    Phyllis: that your column should be read by everyone becomes obvious when one reads how the MSM played this story. When I first read a brief story about this horrific decision in the NY Post, there was NO MENTION of any of the important details you point out: http://www.nypost.com/p/news/national/dad_accused_of_honor_killing_of_bzENCDXbRjzDW5AInbQMmK. I commented to my wife, how idiotic the decision was, which I first learned by opening your Chronicles. Now, I am even more outraged that the question of a “Christian bias” was used to convict the system rather than the killer. In the story by the Arizona Republic, they at least gave the background details of Little’s belittling so-called “argument.” However, once again, at the end of the story, it was not the evil teachings of this killer dad’s religion that was the cause of his beautiful daughter’s death, but “cultural.” Interesting that the reporter did not seem to make mention that islam is a culture: a culture of death. islamic abortion is what I call it.

    A British official in India had an appropriate response to this sort of nonsense. He told the Indian men that they could go ahead and burn the widow—but he would then hang them for violating the objectively moral standards of Great Britain. Unsurprisingly, the practice of suttee came to an abrupt halt.

    It’s so bizarre how everybody seems to tiptoe around Islam these days. The more crap that goes on, the more Americans seem to defend it. This a truly unique moment in American psychology. I would find it fascinating except that I take it too personally, and can’t even wrap my head around what is going on. Are the Arizona officials too afraid of what will happen if a muslim who murders his daughter because of the teachings of Islam, gets the death penalty? Are the folks in charge just trying to avoid some sort of “God Knows What Sh&%t Hitting The Fan” scenario by you know who? Oh yes, what Irresponsible Ugly Inflamatory Language I am using. How terribly offensive the liberals must be by my neanderthal world view. Oh I am So Part Of The Problem.     In this state it really doesn’t matter anyways, the State of Arizona doesn’t have the guts to execute people. Maliki would only die of old age while sitting on death row, like inmate Viva Nash who died last week in a prison medical wing at the age of 94 and was then the oldest inmate in the US on death row.

    Billy Little apparently has no faith in the law at all. Other scenarios that Little could be worrying about: How would it look for a male to convict a female, a Baptist to convict a Jew, a Jew to convict a black, a black to convict a white, a white to convict a Muslim, a Muslim to convict a Jew?

    A fair justice system would ensure that no one is unfairly convicted.

    Is Little really worried about the anticipated Muslim protests to a conviction, which could turn violent — as past experience shows?

    This is how political Islam works. They have two sets of rules: one for muslim men and one for the rest of us. The golden rule does not apply to the rest of us. They use fear and intimidation to get what they want wherever they are. They are expected to work for jihad by killing non muslims, giving money, or causing trouble to anyone who dares to differ.     The issue isn’t really about his lawyer trying to defend him from the death penalty; that’s what defense lawyers get paid to do and that is what our system of law advocates.

    The issue is will this silly and stupid defense work in Arizona? To paint Christians as those who only murder fellow Christians, Jews, Buddhists and seculars but not Muslims is ridiculous! All religions have blood on their hands from murdering other humans.

    I agree with you about the death penalty because not all the people we murder are guilty. Until that glaring problem is resolved, except in the worst of the worst cases–911, McVeigh, Mohammed and so on, we should keep them behind bars till death.

    Agree with ‘Ed’ on this one. That last statement was stupid. There is no evidence to back up that claim. A cold-blooded murderer is a cold-blooded murderer – whether it be Timothy McVeigh or a gun-toting black assasin.

    Our country use to be a country of laws for all of it’s people within our borders and over the last thirty years these laws have disintergrated like
    garbage. Try changing laws in any foreign country to suit ours and we are asked to leave, put in jail or whatever is the law of that country. Either we protect what made this country what it was and the reason so many people escaping from the persecution accept our laws whatever their religious beliefs or find a country to accept them and allow them to kill their daughters for learning to live in our society and freedom from persecution.

    The more I read about prosecutorial abuse and rogue police & the more I read about people being exculpated after decades in prison, the more skeptical I am about the death penalty.

    Nevertheless, if the death penalty is ever warranted, it is warranted here.

    I can imagine a radical imam preaching, “You see? The infidels are weak. They are cowards in act, in speech, and in thought. Allah has beclouded their minds. In their hearts they have already lost.”

    I regret that you feel the way you do about the death penalty. If used properly, quickly and judiciously we would not have as many murderers running around. It just doesn’t seem right to me that a murdering pig like Faleh al-Maleki gets to spend only part of the rest of his life in jail while his daughter gets to spend absolutely zero time enjoying the rest of her life. I say that in consideration of the idea that some liberal judge at some point in time will feel that this murdering pig Faleh has done enough time or is showing repentance or some such nonsense and will set him free. So here’s an idea. If the public defender Billie Little is so concerned about the appearance of a “Christian” jury convicting this murdering pig Faleh to death why not have a jury composed of all Jews? Heck the Jews get blamed for everything anyway, right. So what’s one more little item to blame them for. I wonder what Noor’s last thoughts were as she was being crushed to death by the family vehicle driven by her own Dad.

    You got my all-time favorite reference to multiculturalism, David. It was from Sir Charles Napaier, the conqueror of Sind, who while engaged in stamping out suttee was told by an indignant Brahmin that suttee was one of their customs.

    One of the many, many reason I long ceased calling myself a leftist was this sort of thing: People will excuse the foulest, most vile practice if it’s done by someone who can be deemed by virtue of residence, religion, or skin color an oppressed victim. Many of the women who would be outraged and being addressed as, “Honey,” will explain away honor killings or female mutilation (which is what female circumcision is) or the subordination of women.

    I am, I freely grant, not a multiculturalist. I think some cultures are better than others and a culture that subordinates women and at best looks away when women are killed over “honor” is not as good as a society that doesn’t allow that sort of thing.

    I stand aghast–this sorry excuse for a human murdered his own daughter. I disagree somewhat with Dr. Chesler on capital punishment but in this case if they fried the guy I would sleep perfectly soundly knowing that someone else may think twice before deciding to off his own child and in any case this is one outrage he’ll never commit again.

    The relevant issue is, the intentional murder of a human being is punishable by death. Render unto Caesar…. and in this case, the death penalty is Caesar’s judgment if a jury of 12 decides he is guilty.
    Whether one agrees w/ the death penalty or not, it is the law of the land in Arizona. Therefore, if found guilty, he can be executed.
    That he took the life of a child makes his crime even more reprehensible. If my father had killed my sister because he objected to her lifestyle &/or her boyfriend, he would have faced the death penalty. Its as simple as that.
    That someone has brought this up shows a decided bias in the court system & is cause for the case to be reassigned to a more impartial court where the law will be applied, not political correctness.
    When we adjust or apply our laws to relieve another of their responsibility because of their faith, race, creed, color of skin, national origin, etc., then we have lost the objectivity of justice in our legal system. It also means the law will be applied to the rest of us, improperly or disproportionately.
    This prosecutor, local judges, etc., must recuse themselves & require this case to be tried in a more objective venue to assure true justice is done. Who knows, perhaps it was an accident? The point is, their words already show a bias that is unacceptable in our system!

    Yopu raise very deep moral and philosophical questions. Not whether or not the honour killing is wrong–there is no question that it is outside the bounds of civilized standards as we understand them in the Judeo-Christian West; but rather–the really difficultions–how we deal with the persons who perpetrate this crime, the ones who ask our society to be tolerant of their intolerant ways, and the proprieties in managing a legal system that is secular and supposedly fair, liberal and sensitive.

    Well that is going about it the wrong way. One could ask also, how does it look if a black man is executed, how does it look if a woman is executed…and so on, and so forth.

    If the laws of the country are ignored, why have the law? If he is guilty, he is not different from others who are guilty. If he is different from others who are guilty, we need to re-try everyone to find out just how they also are different.
    This is indeed a very dumb approach and to tell the truth, speaks more about the ability of his legal defense to think rational.

    You’re wrong. Blacks convicted of murder get the death penalty at a higher proportion than Whites convicted of murder.

    You can close your eyes, but that doesn’t mean racism isn’t rampant in our judicial system. Feel free to google any of these studies:

    “University of Iowa law professor David Baldus found that during the 1980s prosecutors in Georgia sought the death penalty for 70 % of black defendants with white victims, but for only 15% of white defendants with black victims.”

    “The DOJ study also revealed the influence that the race of the victim has in determining potential capital cases. U.S. Attorneys recommended the death penalty in 36 % of the cases with black defendants and non-black victims, but only recommended the death penalty in 20 % of the cases with black defendants and black victims.”

    “While white victims account for approximately one-half of all murder victims, 80% of all Capital cases involve white victims. Furthermore, as of October 2002, 12 people have been executed where the defendant was white and the murder victim black, compared with 178 black defendants executed for murders with white victims.”

    (Btw, the whole “the death penalty doesn’t deter crime” argument is B.S. It absolutely does. But even if it doesn’t, there are some cases in which Justice demands no less, and premeditated murder of your own child is one of them.)

It’s just that Billy Little is a *lawyer*, and this is the typical, cynical behavior we have come to expect of them. These days there is no argument so absurd, no tactic so low, that it cannot be attempted in the courtroom. And given how often these tactics work these days, can you blame him? Would you blame a pig for eating food left unattended?

    How will it look if, after a fair trial, jury members who are all Christian vote for and a judge who happens to be Christian imposes the death sentence on a person who is Muslim and has been found guilty of premeditated murder in the first degree?

    It will look like JUSTICE has been done. In fact, JUSTICE will have been done.

    In the traditional American system of justice, there is no special exemption for Muslim males who intentionally kill their wives, sisters and daughters.

    The Arizona prosecutors involved here should be fired.

    The only way Billy Little would *not* realize how sick and twisted this act was is if a) he’s deliberately suppressing the urge to vomit and doing what he’s paid to do the only way he knows how, or b) he’s so far out to left field that Babe Ruth couldn’t hit a ball to him. Personally, it’s a coin toss.

    On the one hand, if I were in that position and had to defend this scum, I’d have to think up some pretty silly excuses to get the jury to at least reduce the sentence. Silly as it seems, these guys have to make a living, and if they have to bend or break their principles to do it, then so be it.

    On the other hand, there are a lot of left-wing lunatics out there, such as Nancy Pelosi, who thinks that we ought to just open up our borders and let everyone come in regardless of whether they’d be counted or productive members of our society, and Ted Kennedy (God rest his soul) who stopped a large, carbon-neutral wind project because it *blocked his otherwise pristine view of the ocean*. In light of these idiots who have that kind of power, it doesn’t seem too far-fetched to think Little is yet another in a long line of liberal loonies who think that just because we happen to be successful as a nation, we need to be demolished.

    . How did other Family Members react to the Murder? Which was their Opinion about Noor’s Lifestyle?

    Ironically, only last week a Jewish prisoner was executed in the State of Florida. But while many Jewish organizations argued for clemency based on the circumstances of the case, none asked “How would it look if Christians in Florida executed a Jew?” Muslims expect not equality before the law but special consideration.     Your column proves once again why there used to be a reason for allowing certain groups from certain cultures to settle here. Because the cultures were compatible. Nowadays, the more bizarre and antagonistic to the host culture, the more they are welcomed. The immigration laws need to be changed. This is one step removed from Sharia Law. In America it is hoped that one’s religious identity can co-exist with one’s duties as a citizen. Obviously for many of the “religion of peace” that is not an option.     Why did we stand on the islamic side when they used their islamic rules on the serbian people in Bosnia, while cutting their heads for being Christians? And someone here said “it’s time to wake up”. How many Christians in other parts of this world woke up and died from this religion while you stood on their side without knowing the real truth. Yes indeed, it’s time to wake up and see what the States does supporting islam and mujahedins in Bosnia and now in the States too.     The decision not to seek the death penalty comes after Almaleki’s attorney, Billy Little, a public defender, asked a judge to take special precautions to ensure the County Attorney’s Office wouldn’t wrongly seek the death penalty because Almaleki is a Muslim.

    Islam and Sharia Law have no place in civilized societies or countries.     2. Deterrence is a secondary function of capital punishment. Justice is the first, which is why capital punishment is reserved for heinous crimes (murder, sedition, treason, etc.) where the act causes irreparable damage to society and/or intentional loss of innocent life. The victims of such crimes deserve justice, as do their families.

    As a society we’ve diluted justice to the point that we’re more concerned about rehabilitating callous wanton murderous demons than we are about protecting the innocent. Very scary.

The inferiority of Christians and Jews is a part of their religious dogma. It is in the Koran itself. Why do we care what these bigots think? Do we not know that there really is a war of civilizations going on and we’re cowering into defeat? Islam is a brutal, abusive and despotic religio-political system. It should be called out for what it really is. That monster that killed his own daughter should be executed. We should also call him out for the low life creep that he is. He should be publicly reproved for his so called cultural bias right before we pull the switch.

    I’m sorry, Ms. Chesler, but on the first point you’re wrong in the way I believe you intend, and on the second, you’re simply wrong. Despite massive efforts, activists have not yet unearthed any case of an innocent person executed. Not one. And studies on racial bias in the death penalty show that white male murderers are actually slightly more likely to receive death for comparable crimes than minority defendants. Those results, so unanticipated by the activists who set out to prove the opposite, have been retooled with the message that minority victims are less likely to be honored with death for their killers — yet that message utterly ignores the real reason for the disparity: community attitudes towards assigning death.

    I agree with you that pleading a special case for certain murderers based on identity or religion is appalling. It privileges that identity over the victim’s identity and her right to life. In Florida last week, we witnessed a similar instance when dozens of Jewish organizations in the U.S. and Israel protested the execution of Martin Grossman, who slaughtered a young female cop two decades ago.

    I happen to oppose the death penalty in all cases, but false propaganda accusing the government of taking innocent lives undermines our willingness to enforce any law. And it is terrible to watch any interest group claim that a person’s identity excuses his actions, or is more important than the identity of the person whose life he took. This is the wretched logical outcome of Eric Holder’s hate crimes regime, in which some people are simply more important, or less important, than others.

    However, do you remember the part of the Pledge of Allegiance that states “Justice for All”? We are a nation of laws. This is the USA with laws that are supposed to be applied evenly to everyone.

    If this guy qualifies to be tried in court under death penalty rules for the pre-meditated murder of his own daughter, then so be it! If we were in his native country, they would not care whether you are Christian or Muslim. They will apply the Sharia Law to you withoout regard to how you worship. You come here buster, you play by our rules.

    Now, apply the law as it is warranted! If you can’t do the time or pay the penalty, DONT TO THE CRIME!

    If the Arizona prosecutors aren’t going to seek the death penalty for a brutal crime that could certainly deserve it, then sentence him to a lifetime of hard labor, the equivalent of lifetime slavery, as his due punishment for his evil crime.

    Considering the number of people whose convictions were overturned after DNA testing, you can just imagine the number unjustly convicted and executed in pre-DNA days. And just a few months ago, The New Yorker ran a compelling piece about a man convicted and executed for killing his family in a fire – unjustly, according to experts who convincingly refuted the forensic evidence used to convict.

    Lady Justice wears a blindfold for a reason. It is a travesty that anyone would take such blatant idiocy put forth by Billy Little as anything more than the ravings of a madman. If Mr. Little truly believes such things, frankly, he should be disbarred. And if taking the death penalty off the table was only to get Faleh al-Maleki extradited, then Britain must be told, “Too bad, so sad, we lied.”

    For Faleh al-Maleki is accused of murdering his daughter in cold blood. As an American, he must stand trial for this crime and if found guilty must face the penalty. Neither culture nor religion are relevant to the facts of the case for he is an American and therefore only the standards of American society, which does not condone honor killings, may apply.
