Now Biden Is Getting Sued, but Not for What He Should Be Sued For

Dragging presidents into court, or trying to, is all the rage these days, but up to now the targeted president has in every case been one Donald J. Trump, who is, for the left, the focus of evil in the modern world. Yet now some far-left and Muslim activists in Oakland, Calif., have filed a lawsuit against a man who is supposed to be on their side: Old Joe Biden. The suit is just the latest indication of the strains in the longstanding leftist/Islamic alliance.

Middle East Eye reported Friday that Old Joe is “being sued by a group of American Palestinians and aid groups accusing him of failing to prevent genocide in the Gaza Strip.” Now, I’m no lawyer, and the senescent corruptocrat in the Oval Office is certainly no angel, but it seems to me that a moment’s glance reveals a fatal flaw in this lawsuit: there is no genocide in the Gaza Strip.

Those who might greet this statement with skepticism should consider the fact that South Africa just took Israel to the International Court of Justice (ICJ) on charges of genocide and failed to get what it wanted: an order from the court (which wouldn’t have been binding, anyway, but would have turned international public opinion even more against Israel than it is now) for Israel to cease all military operations in Gaza. The ICJ did not oblige; according to the Jerusalem Post, it “bad-mouthed Israel” for 35 minutes, but did not find it guilty of genocide or impose a ceasefire that would have allowed Hamas to regroup.

Nevertheless, these activists who have brought suit in Oakland apparently think they can succeed where the International Court of Justice has failed and not only find Israel guilty of genocide but Old Joe also guilty of abetting the Jewish state’s nefarious schemes. The lawsuit “claims that Biden failed to fulfil [sic] his obligations to international and federal law” and was “originally filed by several plaintiffs as a last-ditch attempt to stop the deaths of their family members in Gaza.” 

Biden regime legal wonks tried repeatedly to get the case dismissed — after all, they’re supposed to be the beneficiaries of the two-tier justice system — but instead, U.S. District Judge Jeffrey S. White permitted a live hearing, which was just as much of a circus as you’d expect.

Middle East Eye noted that “some of those who testified spoke directly from Gaza, including Dr. Omar al-Najjar, who spoke from a hospital in Rafah. ‘I have nothing left but my grief…They weakened us for years and continued to unleash bullets and missiles on our lifeless bodies,’ said Najjar, who was the first among several Palestinians who testified.” 

That’s terrible indeed, but Najjar said nothing about the Hamas jihad massacre of 1,200 Israelis on Oct. 7 or about Hamas’ practice of using hospitals and other civilian facilities as bases of operations, secure in the knowledge that if Israel strikes them there, the jihadis will enjoy a propaganda bonanza. 

And as for Najjar’s claim that “they weakened us for years,” consider the fact that Gaza’s population has risen from 265,800 in 1960 to 2.1 million in 2023. If the Israelis were carrying out a genocide, it was a remarkably inefficient one.

Nevertheless, Judge White, perhaps engaging in some fashionable Islamopandering, lamented, “In 27 years this is the most difficult case to have come before this court in terms of facts and law. Testimonies we heard were horrifying and gut-wrenching.” 

He continued, "To the [Palestinian] witnesses we heard today… I say you have been seen and heard…I will study your testimonies and the law and fulfill my constitutional obligation…This is the most difficult judicial decision in my life and I will take it with the utmost seriousness.”

As he apparently thinks this ridiculous case has merit, White could conceivably end up ruling against Biden. It would be heartening if he were to make any effort to inquire as to whether or not there is actually any “genocide” going on in Gaza, but he likely won’t. He might also benefit from looking into Israel’s policies regarding avoiding civilian casualties and Hamas’ efforts to put civilians in harm’s way for propaganda purposes, but he is unlikely to do that, either.

This is another crack in the great Leftist/Islamic alliance. The Biden regime’s far-Left base is enraged at Biden for not abandoning Israel, so the regime is doing its best to appease it by supporting Hamas on the sly, with $10 billion to Iran and $100 million to Gaza, which means to Hamas. 

Will it work? Unlikely. The Biden regime is going to have to withdraw even its stated support for Israel. Will it do so? Don’t be surprised.
