With the latest horrible tragedy in Texas, opportunistic Democratic candidates for president suddenly smell an opportunity to… confiscate guns. Beto O’Rourke leads the way. Standing in front of TV cameras yesterday, the failed senatorial candidate-turned presidential candidate promises (or threatens, depending on your perspective) to confiscate all semi-automatic firearms.
“How do you address fears that the government is going to confiscate people’s semi-auto firearms?” one of the reporters asks when he wants to give O’Rourke a way out; a way to convince Americans who love the second amendment that he will not use any tragedies to take away their constitutional rights. O’Rourke’s frank response must have surprised the reporter.
“I want to be really clear, that’s exactly what we are going to do,” he answers.

There’s little reason to doubt that O’Rourke is telling the truth. It is very likely that he — and other progressive Democrats — will indeed try to confiscate Americans’ weapons. The good news is that the Supreme Court has confirmed the right to bear arms to be a constitutional right, making it virtually impossible for O’Rourke to win in court. He may try to confiscate guns, he may even get his hands on some, but when push comes to shove, the Supreme Court (and lower courts) will intervene and force him to abandon this anti-constitutional plan. The same goes, of course, for any other Democrat who may want to try this.
As such, O’Rourke’s promise (or threat, depending on your perspective) is hardly a reason to panic, even if other colleagues — who do actually have a shot at winning — embrace it. The second amendment guarantees Americans’ the right to bear arms (whether O’Rourke and Joe Biden like it or not). If O’Rourke and his fellow Democrats want to change that, they’ll have to amend the constitution.
