Whoopsie:

In a potentially crippling blow to Obamacare, a top federal appeals court Tuesday said that billions of dollars worth of government subsidies that helped nearly 5 million people buy insurance on HealthCare.gov are illegal.

A judicial panel in a 2-1 ruling said such subsidies can be granted only to those people who bought insurance in an Obamacare exchange run by an individual state or the District of Columbia — not on the federally run exchange HealthCare.gov.

The decision threatens to unleash a cascade of effects that could seriously compromise Obamacare’s goals of compelling people to get health insurance, and helping them afford it.

I bet Nancy is wishing she’d read it first.

More seriously, the Supremes are likely to uphold the lower court’s decision, and probably by a better than 5-4 margin.

Seriously? Why? Obamacare passed the Supreme test because Roberts chickened out or was threatened by the dirt gathered by Dear Leader's NSA. The lib Justices' decision was dictated by their ideology, not the Constitution. What diff now?

The difference is, that recently, the SC has been generally ruling on the actual law. We've seen a lot of Conservative rulings, even some 9-0 spankings of Obama. It would not surprise me to see Kagan recuse herself (as she must) and we get a result of 6-2 upholding the decision that the language is plain.

The mood in the country is moving against the Progressives, because we have seen it in action, and it is a clusterf---. It seems the SC is feeling the same way. Even if they are not, they do not want to endorse this clusterf---. They do not want this as part of their legacies, so suddenly, they are ruling directly on the law.

Obama is not just toxic to Dems in this election. He is toxic even to the SC. Everything he touches turns to sh--. The Mierdas touch.

If this ruling survives an en banc hearing, or if it's not heard by the full court, then we'll know that the Administration has lost an awful lot of support in the Establishment.

After all, this was the entire point of Reid's "nuclear option"--to stack the D.C. circuit so that things like this wouldn't happen. If the courts all of a sudden take an interest in correctly interpreting the law, then something big has gone wrong...

The amusing part about this is how much the Left (mostly) is going to scream about it [and is already] ... as if they don't realize that Congress could "fix" that in five minutes (so to speak) by just passing a new law to let it happen.

It's like they don't understand basic civics.

(It'll be doubly amusing if the Senate, with a Democrat majority, can't even put together a bill.)

I see that the 4th Circuit just upheld this provision of Obamacare. The ruling looks like it should have been in a dissent, but is essentially "Yes, the law is fairly clear, but I'm going with what I want to rule anyway."

I'll take that bet. Not that SCOTUS won't uphold it (unless Roberts can find a way to call it a tax), but that 4/4 of the leftists Justices already know that they're going to rule in favor of the administration. I'll buy you a beer when I'm in Denver if I'm wrong. Maybe two.

And what about the state exchanges that never worked?

If your state managed to blow $100 million or so, is that enough to qualify for subsidies even though no state citizens were ever able to sign up for insurance through that state's exchange?

The decision was the correct one. When you live by the political sword you eventually going to die by the political sword once in awhile.
