When I saw the headline to this story, I briefly considered filing it under the silly “News You Can Use” category.

But no.

Just no.

Not after reading the details:

The nightmare began on January 2, 2013. New Mexico resident Eckert was driving out of a WalMart parking lot when he didn’t make a complete stop at a stop sign, and was pulled over. Law enforcement thought he was “clenching his buttocks,” and obtained a search warrant from a judge to search his anus for narcotics.

But Eckert’s lawyer is raising concerns about the validity of the search warrant, saying that it was broad and lacked probable cause. In addition, the medical room where Eckert was taken was outside the jurisdiction of the search warrant, making the searches performed on him illegally.

Police from Deming, New Mexico took Eckert to an emergency room to undergo the anal cavity search, but a doctor refused to perform it because it was “unethical,” according to the lawsuit.  But a few hours later, doctors agreed to perform the search.

It wasn’t only one search. An x-ray of Eckert found no narcotics. Doctors performed a search of his anus with their fingers. Again, nothing was found. On three separate occasions, doctors inserted an “enema”–a device used to induce bowel movements–into Eckert, and he was forced to defecate. They x-rayed him again. Nothing was ever found.

There really is no end to the depravities of the drug war. I hope this guy takes that department, the individual cops, and the doctors for everything they’re worth.

So someone with a history of arrests (and regularly dropped charges, I might add) has fewer civil rights than the rest of us? And did the officer know any of this at the time? At what point does "clenching ones buttocks" constitute probably cause.

So, no, there's nothing more to the case because it has nothing to do with the current fiasco. Even if he had one or more convictions on his record, that does not mean a police force has any right to treat a citizen this way.

So, by your logic, you would be okay with a 40 year old male with a history of pedophilia spending time on the playground with your 12 year old daughter? Profiling is NOT a violation of civil rights. An habitual offender is just that.

Reading through his lawyers request for summary judgement is pretty interesting, too. It will be interesting to see what falls out of this. Probably the two D-bag officers will be given a week off, and the taxpayers will foot the civil bill for their antics. Worst case, I'll see this as another one of those "well, the officers don't *really* have to obey the law" rulings.

Nice follow-up. Shows he's the usual mess of a person, but even such people should never be subjected to this kind of treatment. An enema is a medical procedure which requires penetration. Same with a colonoscopy. Once the x-ray found nothing, there was no longer even a hint of probable cause.

I hope he makes the cops and doctors lose everything, as a lesson to the rest.

The answer to this is not to sue the good people of New Mexico. It's to punish the offenders for abuse of power, false imprisonment, unlawful detainment, etc. They should be suspended, tried in criminal court, and then tried in civil court.

Well, he also got billed $6,000 from the hospital for that Area-51 grade anal probing.

I'm waiting for the excuse/rationalization that he's just gotten his free Obozo-care exam. Most Obozo voters would willingly pay that sum of money for the delightful experience, and from what I can tell, are lining up eagerly in NYC to be included.

I'm pretty sure this will be a porn parody in the next few weeks, if it isn't already. Toss in a Sarah Palin look alike in nazi regalia, and you've got a winner.

Cops in question need to go to jail. Like now.
