This is one way to skew the Obamacare stats and turn the IRS into the Democrats’ personal political army in a stroke.

Consider what administration officials announcing the new exemption for medium-sized employers had to say about firms that might fire workers to get under the threshold and avoid hugely expensive new requirements of the law. Obama officials made clear in a press briefing that firms would not be allowed to lay off workers to get into the preferred class of those businesses with 50 to 99 employees. How will the feds know what employers were thinking when hiring and firing? Simple. Firms will be required to certify to the IRS – under penalty of perjury – that ObamaCare was not a motivating factor in their staffing decisions. To avoid ObamaCare costs you must swear that you are not trying to avoid ObamaCare costs. You can duck the law, but only if you promise not to say so.

Company officials will be trapped in a catch-22. They can lay off as many people as they want because of Obamacare. But because they’ll have to swear to the IRS that their decisions had nothing to do with Obamacare, they can’t speak publicly about what’s happening. What a great way to silence the people who are on the front lines of dealing with Obamacare’s horrific effects.

I self-certify that the IRS has no authority to make me tell them my REASONS for running my business the way I do, and if they'd like to take that up with my lawyer for a 1st Amendment case about compelling speech, he will be happy to show you his list of court cases (see http://itlaw.wikia.com/wiki/Compelled_speech)

This is actually good news. The tovarisch era is over. From this moment on it will be more and more clear that force has to be used to make the crazy liberal plans work. Price controls, internal passports, exile, executions, brutal punishment for the smallest fault against the regime. That is what replaces civic duty and good judgment formed in a Christian conscience. Like Islam, and many other sects, Liberal Progressivism eventually needs the threat of violence to work. Why? Because it does not work otherwise. You see, once the stolen money runs out the masters have to find a way to make the drones follow the program. Absent money stolen through the violence of the state from "the rich" the only thing left is intimidation and brute force. Who are "the rich"? Anyone with money who is not in the nomenklaturaThe good news my dear tovarisches is that this stage of the program is short and painful. Here is where the people realizes that the czar was not that bad after all, later at the height of oppression is when the people start remembering there is a God that perhaps can help. This is very good news because Americans are not Russians or Germans, there is something in the American soul that yearns for liberty. The great expanses of our landscape call our hearts to noble, holy freedom. It has come to this again. Long ago an oppressing bureaucracy in London ignited the fuse. Now is one of those who "are among us but are not of our own" (to borrow the words of the apostle Paul.) Remember: if they disobey our Constitution we are not obliged to obey them. Remember the cry of the Solidarity movement in Poland: Christus regnat.

But don't publically traded companies and SEC, companies that must comply with Sarbanes-Oxley and any that have contracts or sub- and violate laws.contracts with state and federal have to account for all financial decisions? Doesn't this force them to lie and break laws?

Apparently, Obamatrons are concerned fired employees will have cause to sue the federal gov under ACA, grounds for SC hearings.

Makes a nice bookend with the FCC checking in to make sure you're reporting the news correctly.

And half the country is perfectly fine with both of these things...

This can't be legal, right? Isn't this the "one bridge too far"? SCOTUS can't uphold this complete violation of the 1st amendment. We're living in a freakin' Ayn Rand novel.

Can you say legal extortion? Also, how to succeed at ruining the job creation engine (small businesses) of our economy without really trying! And our Prez is smart because he graduated from Columbia and Harvard? Reminder: A number of the people who were instrumental in the 2007-2008 debacle had degrees from...wait for it...Harvard! It's a cliche but you can't fix stupid.

Fascism: a political philosophy, movement, or regime (as that of the Fascisti) that exalts nation and often race above the individual and that stands for a centralized autocratic government headed by a dictatorial leader, severe economic and social regimentation, and forcible suppression of opposition

Oh, and forgot to mention Samizdat: place stickers everywhere saying "I did fire workers to avoid Obamacare costs". Placing them on the walls of government offices, bus shelters and US mailboxes will send the message quite nicely.

Interesting and with a twist of Irony: Fairey started his marketing with Andre the Giant and Obey spray painted stencils. Fairey went on to create the Hope poster.
As you say, it is now time.

First easy solution: fire them now, before this becomes law.
Second solution: don't hire anyone new and attrit your way down to 99 (or whatever the number is)
Best Solution, pack your bags and come to Canada. We are not perfect either, but are not into the in your face lawlessness. And the culture is very similar, so the transition won't be too jarring.

Come on over, you CAN built that (business, life, future) here.
