Where’s the “thou shalt not offend Obama” clause in the Michigan state constitution? I’m unable to find it.

Ruling that the governor and Detroit’s emergency manager violated the state constitution, an Ingham County Circuit judge ordered Friday that Detroit’s federal bankruptcy filing be withdrawn.

“It’s absolutely needed,” said Judge Rosemary Aquilina, observing she hopes Gov. Rick Snyder “reads certain sections of the (Michigan) constitution and reconsiders his actions.”

Prior to her ruling on Friday, she criticized the Snyder administration and Attorney General’s Office for what appeared to be hasty action to outflank pension board attorneys.

“It’s cheating, sir, and it’s cheating good people who work,” the judge told assistant Attorney General Brian Devlin. “It’s also not honoring the (United States) president, who took (Detroit’s auto companies) out of bankruptcy.”

Aquilina said she would make sure President Obama got a copy of her order.

“I know he’s watching this,” she said, predicting the president ultimately will have to take action to make sure existing pension commitments are honored.

Aquilina never referred to how government unions electing Democrats to continue increasing their lavish and unaffordable benefits cheats taxpayers.

There yuh go again, judgie!

"Detroit" and "The Auto Industry" are not, repeat, NOT the same thing. There have been no cars built within the city limits in decades. There are plenty of manufacturing and assembly ops in the suburbs and exurbs but they do not count in this reckoning. GM, despite its impressive headquarters downtown, builds more cars outside the US than in. Chrysler is completely foreign owned. Ford has zero corporate presence within the city limits. The Auto Industry has all but abandoned "The Motor City". Detroit's economic problems are completely separate from any particular group of corporate entities.

Do you remember in 1975 when President Ford declined to bail out a bankrupt New York City? Do you remember the headline in the New York Daily News headline the next day?

Perhaps we'll still get to see a headline in the Detroit Free Press, "Obama to City: Drop Dead". I would savor the irony.

She can't stop the bankruptcy. She has no jurisdiction. Federal preempts and she knows it. She is an idiot. Not to mention Obama has no power to tell the judiciary what to do.

I won't argue with you that she's an idiot, but it is a little more complicated than what you describe. If the bankruptcy court gets jurisdiction you are correct. The real issue is whether the emergency manager had the authority to file for bankruptcy to begin with.

Correct. The Federal bankruptcy law for municipalities (CH 9) does require lawful State approval for a filing. The judge is saying that the State Constitution does not permit the filing. Ultimately this will depend on the partisan composition of the State's highest court.

No, she claims that because the effect of the bankruptcy would contradict Michigan constitution that there is no authority to file. That's nonsense on stilts. And its the bankruptcy court and the Federal appellate system that will decide their jurisdiction.
