Today, the president is announcing that he and the administration will:
- Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.
- Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.
- Improve incentives for states to share information with the background check system.
- Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.
- Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.
- Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.
- Launch a national safe and responsible gun ownership campaign.
- Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).
- Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.
- Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.
- Nominate an ATF director.
- Provide law enforcement, first responders, and school officials with proper training for active shooter situations.
- Maximize enforcement efforts to prevent gun violence and prosecute gun crime.
- Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.
- Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to developinnovative technologies.
- Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.
- Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.
- Provide incentives for schools to hire school resource officers.

I believe in what you all are doing! Exposing thieves and lairs, One thing that is in need, is for this generation to learn to monitor what is going on in there prospective States. Something just struck me– The Liberals scream bloody murder when laws are suggested to require a photo ID to vote. Of course they claim this is “Racist”. So how do these same liberal screamers reconcile with Obama’s measures that demand full background checks for gun purchases. Under the Liberal definition, how is that not “Racist”? Won’t these measures have more a negative effect on blacks?

My point being that if securing a simple photo ID to vote is deemed too diffucult for minorities and thereby “disenfranchises” them. How about a thorough background check? How can people who have never saw the need for a photo ID pass a background check?

It’s all about enabling/compelling the doctors to ask your children whether you have guns, drink alcohol, smoke dope, or partake in other drugs. Then the doc will ask if Dad or Mom ever have loud arguments. The ask how often you take out your guns in front of them, etc., etc., etc. And if your child answers, confused or not, it goes in your record.
If you answer “yes” or “f*ck off”, the response of the government will be to deny you health care, because you indulge in a “risky” behavior.

I recently went to my doctor and was given a questionnaire that asked some nosy questions (smoke alarms, car seats, mental health, sexual practices, guns in the home, etc.)

Does this include the guns he illegally exported to Mexico, and which were subsequently used to murder hundreds if not thousands of Mexican citizens, PLUS the US citizens who were murdered in our country with these guns, under his failed Fast and Furious debacle?
In all honesty, there are a few egregious items as well as some things the states need to think about long and hard before climbing in bed with the federal government to implement, but the majority of it looks like fluff.
Only 3 of the recommendations touch on making data available between agencies, federal, state, etc.
Seven…SEVEN(1) of the recommendations involve health care issues! Still, at least the issue of mental health is now on the radar, but the concern I would have is how wide they would cast that net to snare as many people as possible in the designation as mentally incompetent to possess or own a firearm.
Think about all of our returning vets who may need some help with various degrees of post-traumatic stress symptoms that, while possibly temporary in nature, could permanently ban them from gun ownership even after they have recovered.
The biggest issue for me is #14, as the CDC cannot be counted on to be impartial – they WILL have an ax to grind and have already previously tried to lay claim that gun violence is an “epidemic”.
I have no faith in their results.
Then you have various programs to “help” states with things like resource officers. The states need to bear in mind that anything from the federal government comes with strings attached, and they could find themselves dancing the federal tune – especially when money is involved.
#7….would it have killed the SOB to at least reach out to the NRA and ask if there were any way they could help to expand the Eddie Eagle program using federal resources? I mean $hit, the NRA has been promoting gun safety for decades now! What are the feds gonna do that the NRA (and gun industry in general) has not already done?
Police paper work will now take a significantly longer amount of time limiting the actual time on the street. I bet the police unions will love this rule which will require even more overtime making the union chiefs that much richer…
More to my concern is the ‘mental health’ issue preventing people with actual reasons for needing a gun from getting one. A battered woman fleeing an abusive husband will have most of the same disorders that these nut jobs they’re trying to stop have…. Depression, paranoia, PTSD, Mania…. difference is, someone is actually out to get her, it’s not her imagination….
So what are they doing to assume responsibility for the people with a legitimate need for self defense that are being denied on the grounds that their abuser broke their mind bad enough to insure they’d be forbidden a means of self defense?

I wouldn’t give him any credit. It was only STRONG opposition from NRA and gun rights advocates that produced this result.
In my opinion this is part of a longer term strategy. Make vague remarks, send the opposition into a frenzy of worry, get the opposition generally discredited and mocked in the process, and then do it all again the next time. Meanwhile steady progress is made bureaucratically while he asks his base for MORE power to do more next time.

All those government agencies are theoretically OK but it’s the government employees who give Joe Public hell. EPA, IRS, & DMV are 3 great examples. I’d note the Chief Executive’s thing about physicians is consistent with a certain Progressive world view that says those with “doctor” in front of their name should oversee us, for our own good.
What I’m getting from my doctors is that they are getting fed up with all the new hoops that the government keeps making them jump through. More time filling out paperwork, more forms to fill out, more ridiculous, but mandatory, “consultations”, and the need to hire more staff just to make sure all the t’s are crossed and the i’s dotted.

I also had the pleasent experience of being behind two Obamaites at the pharmacy the other day, while they were arguing with the pharmacist over the sudden increase in the cost of their medication. That kind of made my day.

So, is this background check going to be modeled on law enforcement hiring and testing protocols? You know, require the gun owner seeking to get his gun back after an “incident” to take a polygraph test, the ink blot test, a blood chemical and urine test, a standard battery of psychological tests, such as the California Personality Inventory, with a psychological interview all at the owners expense? It’s the only way to be sure, although I would venture a guess that more cops go to prison each year for violating the law than lawyers are disbarred for violating the law and their professional ethics under their various state bars. Harvard lawyers generally are better trained and lawyers do get to run their own licensing boards, and they don’t have to pee in bottles as a condition of employment. So, when are we going to be bringing back those literacy tests for voting?

10. If the government takes my guns based on a shrink’s assessment, what actual crime will I be charged with? How can I answer those charges. Define the offense.
11. If the government takes my guns based on a shrink’s assessment, will I ever be able to pass any kind of background check ever again? If I have a security clearance, will I lose it?
12. If I’m too unstable to own a gun, I might be unstable enough to kill my shrink for ratting me out to the cops. God, I hate a snitch…

“Screening” to determine “mental stability” to own guns is fine so long as there is some sort of due process where the state has to prove its case against a would-be gun owner and the gun owner has the right of counsel, expert witnesses and appeal if needed.
Denying someone their civil rights is a big deal.
After consideration, I realized I was contradicting some things I said following the Virginia Tech incident. I think there SHOULD be a way for psychiatrists, therapists, school counselors, law enforcement, and others to deal with someone who appears to be an IMMINENT THREAT due to mental health problems.
By that, I mean people like Cho, Holmes, Laughner, Spengler, and Lanza. From what I’ve read, all these men were disturbing to other people including their families, had been seen or noticed by school or mental health counselors, and were generally giving off crazy/dangerous signals. Spengler was a violent ex-con.
I’ll echo Zeke’s vague “mentally unstable” term here: these proposed measures should only be taken against actual psychos – people who are obviously in danger of “going off” in the near future, people who frighten other people by the way they look, behave, and speak, people who exude crazy from their pores. Again, that’s not a diagnosis; it’s not in the DSM. Could mean schizophrenic. Could mean clinically depressed. Who knows? From what acquaintances say about these shooters after the fact, most of us seem to know this kind of crazy when we see it.
The problem is, how do you turn that gut feeling into an actionable diagnosis? And how do you avoid creating a dragnet that catches people who are harmless but extremely weird?
I’m waiting for the lawsuits to start. Maybe the Supreme Court can figure it out…

Can someone explain how executive orders are permissible under our form of government? Don’t we have a system of checks and balances on each branch of government?
Executive Orders have been around since Washington. He issued 8 of them, among them one setting 26 Nov 1789 as Thanksgiving Day and another requiring former Confederation (remember that before Washington was President under the Constitution there was another government under the Articles of Confederation) officials to issue a report to him on their activities.
Most executive orders have been used to instruct various Federal Executive agencies (State dep and other agencies for example) on how to implement laws passed by Congress. For instance, some of the more famous EOs have to do with the President “seizing” food or other resources in an emergency. Those EOs exist because Congress passed some rather nebulous law under Title 50, Chapter 34 about national emergencies. The law gave the President power to declare a national emergency but was rather vague on what actions the government was to take during one. Thus the President issued an EO that – in excruciating detail – told executive agencies of the government what to do. Had Congress exercised a bit more due diligence an EO would not have been needed.
In the aggregate, this round of EOs does little or nothing that wasn’t already on the books elsewhere. They do, however, look to be more pointed at health care agencies than previous ones.
In general, as one of the three branches of the federal government, the President has the ability to issue orders so long as they do not contradict the Constitution or infringe on the Constitutional duties of the other two branches. He cannot declare a law Constitutional or not—that’s the prerogative of the US Supreme Court. He cannot declare war or wage war beyond the limits given him by law—declaring war is the prerogative of the Legislature.
Every President tends to issue Executive Orders. The problem is if the Executive Orders are not merely some mundane procedural matter or civic goodwill or such but an effort by the President to bypass or overrule another branch of government’s exercising its duties and obligations.
Current polling among gun owner homes — of the big three issues its 60/40, 70/30 and 80/20 FOR reform.
Now watch the democrats begin to screen ‘their’ candiates for the 2014 election cycle who belongs to the NRA and or share the NRA position on these issues, will instead, choose to stand with the majority of the people, including gun owners. The likelyhood of the House going to democrat control in 2014 for a number of reasons seems to get better now. Majority still rules in America!

If he were to call for martial law all the red state national guard unit would fallow the governor. The blue state guards would sit it out because they would split at best. I would order the federal government to get out of school security issues, a state responsibility.
I would be honest: the first responder to confronting a criminal shooting is normally an armed civilian, not an armed policeman.
I would order all departments to cut down the violence in the prostitution, drug, and illegal immigration industries, and paraphrase Joe Stalin: either win, or be fired.
I would order the CDC to stop researching killings as a disease. Their work to date is cloaked as science, but is in fact, funded by left wing anti gun forces who seek the brand as CDC science. I would rather order them to define means to identify the criminally insane with some certainty, and order the DoJ to propose laws to Congress, by June 1, 2013 to implement these means, via electronic means, consistent with America’s Constitutional Rights. A huge debate topic is the resolution of what electronic records may be permanently kept by the government on weapons, and weapon owners.
I would enlist the NRA in a national safe and responsible gun ownership campaign and fund it by taking money from executive agencies who are not as capable.
I would ask churches for help with providing guidance to young males who lack a stable home life.

Here, I disagree with Perry. A certain law could have saved lives of Sandy Hook victims – the law that would allowed teachers in that school to have conceal-carry guns. Unfortunately, there is the law in place that prevented them from that option.

A lot of those actually sound kind of reasonable BUT does address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system mean my health records become public if I buy a gun? What if you tell your doctor it’s none of his business if you have a gun? Does he get to not treat you?
And why didn’t he nominate an ATF director in his first term?
It’s simpler than that. With your gun ownership in the Health Database, they can assess additional insurance premiums due to your increased risk. These premiums would be an alternative to actually coming to your home and seizing your guns. If you claim a “canoe accident” they can get you for fraud, and can inspect your premises on that basis.
This pretty much confirms that Obama has been talking up the gun control issue so that he doesn’t have to talk about other things — like the economy.

Where does this say your doctor will ask if you have a gun? It does hint at looser privacy in health care, depriving a right based on a disability and leaving these questions up to bureaucrats. The fact that this is tied to the Health Care Act and HIPPA is a cause for concern.

Courts have long had the authority to decree mental capacity and conditions.
Law enforcement uses psychological testing.
Some government agencies use psychological testing.
Numerous places in the private sector use both psychological and lie testing.
YTou mentioned an appeal question. Have the same appeals rights you do in the above listed cases where testing is mandatory.
So, what does a psychologically well and responsible citizen have to ‘fear’ with the idea of test screening potential gun owners for their mental health condition? Everybody on PJM was quick to proclaim it was mental nuts doing the killing and that its they who should not own guns. Now, ya’ll seem to be reversing in the face of an idea having to be test screened. Makes one wonder!
I’ll grant you the point about the courts. However, Obama’s proposals and Cuomo’s laws say nothing about “test screening” for people who want to own guns like we already do for people who are applying for certain jobs. That would be voluntary and above-board. Don’t want the screening? Don’t apply for the job – or try to buy a gun.
(Thought experiment: How about if we “test screen” you before you’re allowed to exercise your First Amendment rights? After all, you might have some dangerous ideas that could cause great public harm. Better find out your mental condition and your beliefs before we turn you loose on the defenseless citizenry.)
What they’re proposing, however, is involuntary screening of anybody who walks through any doctor’s door, whether that person owns a gun, intends to own a gun, or has owned guns all his life. That’s different. Unlike screening for a job or a security clearance, there appears to be no requirement to inform the patient that he’s being screened, no requirement to inform him that he’s been reported as a risk, and no legal recourse until AFTER the cops have come and taken away his guns.
Seriously, I have no problem with figuring out a way to keep dangerously unstable people from getting their hands on firearms. But it has to be done in a way that a) doesn’t trample on stable people’s rights and b) doesn’t sweep up a lot of innocent but weird people in the process. In my opinion, Obama and Cuomo’s sweeping pronouncements leave too much leeway for abuse, mistakes, and unintended consequences. Still, it’s early in the process. It’s going to take a long time to work out the details. That will happen in the legislatures, doctors’ offices, the courts, and the public forum.
I thought liberals were all about “questioning authority” and “speaking truth to power.” It’s strange (assuming you are a liberal) that you’re so complacent about your Constitutional rights. Good citizens don’t just roll over when the government does something they’re concerned about. They speak their minds. Or does that only apply when a Republican is President?

I feel like a lot of people are missing the real danger here. It is understandable because of the upset about the guns. But one does not have to be a doctor to write a damaging mental health note. Why are people assuming that a full-fledged psychiatrist/doctor would be doing these “mental health screenings?” Do people even realize how broad the Diagnostic and Statistical Manual is? That a short term “alcohol abuse” is a permanent mental health diagnosis? That things are included like “religiosity.” Have they ever seen all their medical records? It is very dangerous to tie medical notes and records to the right to bear arms. And to tie the interpretation to law enforcement? Be very careful about a willingness to scapegoat the “mentally ill.” That can mean almost anything. PTSD in a violent crime victim could deny them the ability to protect themselves, for instance. This is very bad business.

After perusing the information, it seems to me like a huge chunk of the problem was not so much the gun as it was the rise of gang related activity and the crime that follows it.
BTW, imposing draconian gun laws on law abiding citizens will have zero impact on gang related violence.
Handgun related crimes went up until around 1993 – then began a looooong drop that seems to have flattened out around the year 2000.
Interestingly enough, there has been a long slow drop in crime since the early 1990′s for every weapon catagory – which corresponds very nicely with a drastic increase in the number of guns that the private sector has been purchasing as well as an increase in the number of states issuing concealed carry permits.
Even more interestingly, the drop in crime began in 1993 before the 1994 AWB took effect, and it’s expiration in 2004 appears to have had no impact on crime levels.

So, while gun ownership has skyrocketed and concealed carry is now commonplace, crime – and especially gun crime – has apparently been going down.
So, this leaves me with the question….why do leftists so desperately want to control what guns are available and even fantasize about outright confiscation when it’s clear that crime is going down?
It can’t be because gun control has been shown to reduce crime, as the locations with the strictest gun control laws seem to have the highest crime rates.
Hmmmm…..could there possibly be another reason, having nothing to do with crime or public safety, that leftists would would want the average citizen to be defenseless?

Back in the 1950′s, I along with about 30 other young teens attended the Informative and well organized NRA Hunter Safety Course every Monday night for ten weeks along with weekend range safety shooting and safety obstacle course at our County Fish and Game club.
Between the NRA and our fathers who fought in WWII we all had a great background in gun safety.
Now his Majesty, King Obama declares we all need what the NRA has given us free all along.
Like he is the enlightened one with this revelation of gun safety in the form of an EO.
