Eric Holder Probing State Voter ID Laws

DNC Chair Debbie Wasserman-Schultz makes a revealing comment in an interview:

The assistant attorney general for civil rights, Tom Perez, has assured Americans and members of Congress that the Voting Section [at DOJ] is looking very closely at the laws that have recently passed. They’ve acknowledged the concern that both I and others have expressed about the potential for these laws to have an undue and disproportionate impact on racial minorities and the poor. I trust that Tom Perez and Attorney General Eric Holder are reviewing these laws very seriously.

This almost certainly means that the DOJ Voting Section is looking at whether or not photo identification laws violate Section 2 of the Voting Rights Act.  The overwhelming majority of Americans support voter ID, including Democrats.  But if there is a racially discriminatory effect, look for the DOJ to go after some state somewhere (I pick South Carolina) to activate their political base.  People often dismiss the merits of such a case.  But if the DOJ can show that minorities are disproportionately affected by the requirement to show ID at the polls, the case is stronger than many realize.  Is it a fight Holder wants heading into 2012?  Perhaps, especially when you need to rebuild a collapsing political base.

    Is there no end to their dishonesty? There is one and only one reason to oppose voter ID: to facilitate vote fraud.

    No. It won’t be South Carolina, it will be Florida. Jesse Jackson is already hear trying to cause trouble.

    • Florida’s voter ID law was precleared under Section 5 years ago. It is extremely unlikely that any examination of the law will start under Section 2 of the Voting Rights Act after so much time has passed. Florida has other laws currently before the Voting Section (early voting, voter reigstration by 3rd parties) that may well be objected to. The Civil Rights groups are in a full court press to have Holder block them, and for reasons that are wholly mystifying, Florida submitted them to DOJ. If they want them to be approved, they should go to the federal court in DC after they withdrawal the submission.

      South Carolina, it seems, also submitted voter ID to DOJ for mystifying reasons. Texas and other states are likely to go straight to a neutral federal judge for approval.

    I doubt Holder has the time or focus to do anything right now other than shredding some documents and trying to find cover from his involvement in Fast and Furious.

      I works somewhat like this. This is a rough approximation of the theory. Under Section 2 (or Section5 if you really want a tough law) laws discriminatory in effect are illegal. (I am making this simpler than it really is).

      If there are 1000 whites in a state, and 100 blacks, and 990 whites have ID and 80 blacks have ID, there would be a disparate impact/ discriminatory effect on blacks. Under federal law, in voting, you cannot have laws which discriminate racially. It really isn’t that complicated, but it is the law. All of this depends on the facts, all of which I oversimplify here.

    Every individual who files bankruptcy in federal court is required to show a current drivers license and proof of Social Security number; might that also be interpreted as discouraging racial minorities from availing themselves of federal law in order to relieve themselves of burdensome debts? DOJ under Holder plays its B.S. games,

      If you wish to enter, *enter* an IRS office to request a tax return transcript you have to show a valid, government issued photo id. You’ll have to show it to the security guards, and you’ll have to show it again to the IRS employee whose job it is to provide said transcript. How is this racist? Enabling jackass party vote fraud is what it’s all about, plain and simple.

        I realize that it will be impossible to impeach this corrupt, racist bastage while the Big O and Dingy Harry cover for him but I dearly hope he’s on somebody’s list to bring up on criminal charges in 2013. And if the pachyderms win the big office next year every US attorney, *EVERY* US attorney needs to be given his walking papers effective inauguration day +1.

      Holder has proven himself to be a racist as has Jesse Jackson. All my “Minority” friends have ID’s and know that their leaders are trying to keep them chained to “Uncle Sam’s Plantation”. The DOJ needs to be investigated. You are right Holder is just playing another BS game.

    Well, it sure is nice Holder and company extended those second amendment individual gun rights to Mexican cartel members in the effort to bust them for illegal weapons trafficking. Even non citizens have fundamental constitutional rights. Holder and company even knew who they were because they had photo ID and were government snitches! Of course, the whole point of doing a sting is to arrest the snitches before they do an actual violent crime with the weapons. I guess Holder and company thought the weapon was like the pen in libel law; you have to let them do the libel or shoot people rather than preempt the libelous free speech or unlawful killings. Apparently it’s OK to require a photo ID to buy a gun and drive a car, but not to vote. Strange.

    Mr. Holder should have an investigation into why these southern and Midwestern states want to implement new voting laws? Gee, I wonder why? If I had my way all of them would be in jail
