Kudos To The Legal Team of Angela Lloyd and Kort Gatterdam
Christmas arrived early this year for this brave, young ex-Muslim convert to Christianity. Judge Mary Goodrich in Columbus, Ohio, has just decided that Rifqa, who will turn eighteen in five days, does not have to return to her family (all of whom are here illegally from Sri Lanka). According to breaking local news,
“Goodrich also said it’s not in the girl’s best interest to return her to her native Sri Lanka. Bary is (also) an illegal immigrant. The ruling allows her attorneys to file for a special immigration status to allow her to stay in the U.S. while she continues medical treatment following recent surgery for uterine cancer.”
Allow me to congratulate her hard-working, dedicated, and skillful lawyers: Angela Lloyd and Kort Gatterdam. But most of all, allow me to congratulate Rifqa herself for her extraordinary strength and courage.
Without going into details, allow me to note that this decision is a triumph of committed pro bono lawyering. Rifqa is both young and poor; nevertheless, she found a legal team able and willing to represent her for no money — indeed, to go up against a legal team funded (and/or morally supported) by CAIR, the Council on American Islamic Relations.
For those who insist that there is no justice in America: What do you think Rifqa’s fate might have been in a Muslim country or even in Sri Lanka, where Muslims comprise a minority of the population? While justice is far, far from perfect in America, here is one, shining example, one brilliant moment, in which justice has triumphed. At the midnight hour, Magistrate Goodrich rendered a just decision.
For those who claim that Americans are racists, that they dislike both dark-skinned people and illegal aliens — please note that Rifqa Bary is beautifully dark-skinned and was brought here, illegally, as a child, by her family. She arrived here as an undocumented Muslim. Nevertheless, lawyers in both Florida and Ohio stepped forward to protect and defend her. The system-we-love-to-hate appointed these lawyers. No angry grassroots group, no Christian activist association did what the American state did: Actually pay for it all.
Rifqa, like our earliest founding ancestors, will now be able to freely practice her chosen religion. She converted from Islam to Christianity. This is a capital crime among Muslims and could lead to her death, either at the hands of her own family or at the hands of any “righteous” Muslim. Rifqa’s lawyers have defended her right to convert to Christianity without having to die for her choice.



















Finally a judge in htis case with a brain. Best wishes for Rifqa, may she also be blessed with health as well as her freeedom.

This is good news! I hope she finds some peace and happiness in her life. What an ordeal this young girl has and is going through. I wish her great success and hope she is surrounded by many loving people.
While I share the author’s happiness on Rifqa’s behalf, all of us must realize that this is only the beginning. Even if she is granted citizenship she will be in grave danger the rest of her life from Muslim thugs. Rifqa needs to get a CCW permit ASAP, then get a handgun and learn how to use it. (Given the free legal and medical support she has received, perhaps a patriotic gun shop can provide her a suitable firearm for free or at a large discount.)
I don’t know what Ohio’s gun and self-defense laws are, but if they’re too restrictive Rifqa should seriously consider returning to Florida, which has excellent “castle doctrine” and “stand your ground” laws.

Unfortunately, I found Ms. Chesler’s reporting to be offensive. Chesler kept going out of her way to mention the shade of Rifqa’s skin as if white people are to be presumed guilty of racism against such people unless found to be innocent. That is an outrageous slur by Chesler in a nation that mainstreams the likes of Barack, Michell, Farrakhan, Sharpton, Holder and on and on.
I’d also like to fact check Chesler’s claim that Rifqa received no support from the Christian community, the same community that has been trumpeting her cause since the beginning.
Lastly, what heck is her “undocumented”, as Chesler calls them, family doing in the United States? Let them follow the commands of the wicked Muhammad back in Sri Lanka where they belong.
Respectfully, I think you misread her intent in continually bringing up race. I think it was a tad heavy handed, but the point needs to be made- many people automatically assume that ours is a racist system just by institution, and that a non-caucasian can’t get a fair chance, period.
Ms. Chessler continually bringing up her race is to show that in fact, the system is not necessarily institutionally racist (nor xenophobic). She wasn’t implying that white people are racist, but rather showing that a supposedly racist system isn’t. Re-read the piece, look for the points where she says just that. Our evil racist judicial system protected a non-caucasian illegal immigrant. To most of us, it’s a ‘well, duh..’, to many progressives, if they took the time to wrap their heads around it, their brains could explode.
There is pervasive theory – and many “social justice” practices and programs based squarely on it- that to be white in the US is to be racist (please note, that is NOT my personal belief- I repeat, this is not my personal belief!), regardless of how many friends you have that aren’t white, or what you practice in your personal life, to be white is to be priviliged, be a part of and unconciously supporting the controlling institution (note how easy it is for progressives to shout ‘racist!’ at anyone who is in favor of controlling immigration, or even just enforcing current law).
Go online, you’ll find groups of people, who are otherwise upstanding members of the community, “educating themselves” and trying to convince others that they are also racists. It’s sadly ironic though, since these people could be doing good, like volunteering for literacy programs in poor areas, or working at youth centers, and outreach centers, but seem to think that navel gazing is better (actually, sadly, they think they’d be oppressing the minority kids they could be helping, simply with their whiteness).
So again, I think that Ms. Chessler was heavy handed, but the point needed to be made. A system that is routinely decried as racist simply by institution, protected someone who was not white, nor of legal entry into the country.
For the next part- she didn’t say that there was no support from the Christian Community, but rather that the government paid for the legal proceedings. There is a difference there. I’m sure Rifqa had the support of her church and the community around it (she has to have somewhere to live and food to eat, and the support of others), and probably a lot of political and grassroots support, but the government covered the legal tab, or at least that’s why I get out of it (I haven’t read the news articles, so that might be semi-erroneous).
I think the larger point is linked to the one above- our supposedly uncaring, racist system not only protected this young woman, but also supported and paid for the process. She owes no fees, and no court fees. Our system (we, the people) and some compassionate lawyers, footed the bill.
As for the family, there might be other issues going on- Did they flee sri lanka for asylum reasons? Immigrants, legal and not, come here for many reasons, and it could be that the background to her family coming here is just as sad as her needing to be free of her family and the community surrounding it. I’m not in favor of forgiving illegal immigration, but at the same time, I don’t want to immediately say ship the family out without knowing the rest of the situation.
The government needs to take her father by the balls,assuring that his heart and mind will follow, as well as the rest of the family to the deportation gate. Throw all m*** out of our country. This cult needs to be declared NOT a religion and ban it. Those that want to practice it should be deported summarily.
There were Christian lawyers and lawyers available to Rifqa, pro bono, who are very familiar with sharia law, which is what a lot of Muslims practice. That knowledge would have been greatly beneficial to her legal counsel.

Dear Phyllis – I know that when the case was going on in Florida, at the request of Florida’s attorney-general you submitted an affidavit on Rifqa Bary’s behalf, as also did Ibn Warraq, apostate from Islam; both of you, from your extensive knowledge, stating that the danger to Rifqa as a declared apostate from Islam was real and grave.
Thank *you* and bless *you*. And blessings on Mr Warraq too. You did everything you could, from a position of some authority as published authors and public figures, to make known – to the legal people, but also to ordinary Americans – the facts about Islam’s apostasy law.
I do hope that someday soon you, Ms Chesler, may be able to give little Rifqa a motherly Jewish hug and welcome her to America.
And I am sure that other apostates, Mr Warraq but also people such as Wafa Sultan, Nonie Darwish, and Ayaan Hirsi Ali (who is settling in America) will have excellent advice for her on practical matters of personal safety and security.
I will continue to pray for her. It will be wonderful if her cancer is fully cured. But if it is not, then at least she will depart into the presence of the Holy One as a free woman, surrounded and supported by loving friends.
Whatever happens, her case has surely brought to the attention of many, many people – not only in the USA but elsewhere – the fact that the Ummah of Islam kills – or tries to kill – those who try to leave it.
Everyone involved with this case should make sure to point out that if Rifqa Bary had not been a young and pretty girl convert to Christianity -if this had been, instead, a case involving a gangling and spotty 17 year old *boy* who fled his Muslim family and pronounced himself no longer a Muslim but an out-and-out atheist, or a Buddhist, the danger of such an apostate boy’s being killed by his family or by others in the Muslim ‘community’ would have been exactly the same and the campaign on his behalf, mounted by those who know about the Apostasy Law of Islam, would have been just as passionate, and the joy just as great when the apostate’s right to freedom of conscience, and to life, was affirmed.
Good news indeed! I believe that the same Jesus who freed my sister-in-Christ is also able to completely heal this cancer. I pray that she will find the right, Godly husband to both courageously stand with her, and model loving committed, Christian marriage. May they then demonstrate to the world true freedom for women, unlike that in Islam.

Islam is 8% of the Sri Lanka population. Critical mass to the point where they can and do push their weight around. I’ve read several articles that state once the muslim population gets to ~5% they feel justified in getting their way.
Take a look at European countries with the same or less % of muslims – you know what is going on there if you’ve read much in these pages.

I agree with you, I didn’t particularly like that barb as well. There have been many Christian groups and grassroots groups who have helped in this fight. I personally have friends here in Jacksonville, Florida, who have spent their own time and money attending each and every hearing that Rifqa has had, showing their support, writing letters to the judges, etc. This isn’t something that was done out of the goodness of the government’s heart. This case was originally brought to the forefront by Christians and grassroots groups. If it had not been for them, this case would have been dropped and this poor girl might possibly be dead by now.

WRJonas, that is a very good question, and what you missed is that Sri Lanka is currently in a state of chaos and anarchy. Its government is in no position to protect individuals; indeed, the Buddhists are rather hostile to the Christian community. It is the perfect set-up for the “minority force” of Muslims to commit an honour killing and not even be noticed. Rifqa has already received one death-threat from Sri Lanka, so we know she is a specific target there.
Janis, the whole point of the S.J.I.S. is that it eventually leads to citizenship. It gives Rifqa the immediate right to stay in the U.S.A. until she is 21, during which time her application is supposed to be processed. Marc’s suggestion would also solve her immigration problems, although we can’t count on that one.
Steve, Rifqa’s parents arrived in the U.S.A. on a working visa that expired in 2005. At least two immigration applications were rejected, but they probably have more in the pipeline. I expect their friends in C.A.I.R. will use their influence with the Immigration Department to hasten the Barys’ citizenship.
Strider, I think Rifqa already knows that she can’t stay in Ohio. If she knows where she’s going next, then she’d be a fool to tell anyone. Elliot, the average murderer does not respect a restraining order. The problem is not just the family – it is the entire Islamist community. How can a “restraining order” cover every single one of them?
Leatherneck, her healthcare has been state-funded so far, but she will need a private fund after she is 18. Steve is right – she has received numerous donations from well-wishers, some of whom are Christians, and these will contribute to her medical expenses until she has permission to find a job of her own. Meanwhile, I expect she will do voluntary work, as has been her custom in the past. While this doesn’t relieve the American taxpayer, it is a concrete expression of goodwill to the American community.

This is the wonderful news I’ve been waiting for!
I’ve been hoping beyond hope that I would get to see just this sort of news. But as the story played out things looked so bleak considering the sick way child services acted and the resources given the family by fellow fanatics. But the system has worked for her in the end and I hope it continues to do so further on. Please pass it on if Miss Bary doesn’t have access to this just yet that there are plenty of Christians out here who wish her nothing but the best and happiness!
Of course we need to keep in mind that there is more work ahead. We need to keep her in our mind and prayers and those who can need to help in whatever way we can so that she keeps her victories end the end.
From what I have read about this young lady, once she gets past her difficulties in the immigration system & deals w/ her cancer, she will be a credit to her adopted country. I suspect she will repay any kindness shown to her, ten fold.
Many still try to make issue of race when it comes to illegal aliens. The issue is NOT race. It is the law & especially once one realizes that just coming in is against the law (although many say its no big deal), but that initial crime “always’ leads to multiple additional & much more serious crimes.
Identity theft in the USA is our fastest growing crime & any who have suffered this know it ruins one’s life & causes all sorts of problems that could take ten years to fix, if then.
Illegal aliens use forged &/or stolen identity documents to get jobs, to drive a car, etc. Its drivers licenses, its birth certificates, its passports, its Social Security cards, its all sorts of documents & they all are much more serious crimes. No one can steal in illegally & not break multiple more & more serious laws. THAT is a large part of the problem w/ illegal aliens. Add national security & stability of our economic systems, plus more, and these are why we must “properly” secure our porous & virtually unprotected southern border w/ Mexico.
This girls case was one of the unusual. I agree all cases should be reviewed & where appropriate, illegal aliens should be deported. Those we decide can stay should go to the back of the line, pay fines, & be required to assimilate through renouncement of their previous nationality & learning our language, plus learning about America.

I want to add my blessings and hopes for healing and joy for dear Rifqa. I was similarly hated by members of my family when I turned to Christ. What a powerful article! For once news has reported the plight of Christians in Muslim countries and HERE in America! My classes have actively followed Rifqa’s plight from its inception and sent her cards and letters as permitted. In America we will soon be without the freedoms that we have been best known. Tyrants and anti-freedom entities have invaded us using our laws and ideologies against us. I’m afraid they will ultimately win as we have a government that is not favorable to the way of life we have known. I am concerned for Rifqa’s fate here in America as any who wear the turban will be against her and will consider her death as praise to their god. Maybe her plight will awaken Americans to our similar plight, but also let converts from Islam know that a relationship with Jesus is worth the cost – even death.
Here, we have a story of right vs wrong. A Magistrate recognized the danger to this young woman if she were to rule against her. Solomon in his wisdom recognized the evil intent of a “false mother” when ordered the child rendered in half so each claiment could possess the child. CAIR knew full well the results awaiting this “Child” yet they persisted in their course of action. They would rather the “Child” be rendered in half than be allowed to choose Christianity over Islam. That is the glaring comparison for those with honest eyes to behold. The real mother in Solomons era would gladly preserve the Child at her own loss, the false mother only wanted possession even if it meant the death of the child. Islam only wants possession of this young lady even if their real intent is to end her life for converting to Christian faith.
Thank the Lord, and may He bless Rifqa. Free at last!!!

This comes down to ONE JUDGE who was not weak, intimidated, leftish or vain. One judge who saw it as it was and said so.
I consider this, while a nice moment for Rifqa and all who’ve prayed for her, evidence of the risk to our society of having so much in the hands of so few deciders, people who are so close to unaccountable.. this should NEVER have come down to a single judge’s decision. THe power and influence of the Muslim agents here are shocking, even though they failed here. They had lawyers, other judges, journalists all pulling for them and making conscience-searing decisions to throw that young lady to the wolves, over and over again.
It is beyond belief that it got THIS far. Thank God a line was finally drawn.
