On Monday, House Judiciary Committee Chairman Jerry Nadler (D-N.Y.) announced four legal scholars who will be called as witnesses during his committee’s impeachment inquiry. Three of the scholars were chosen by Democrats, one by Republicans.
One of the legal scholars chosen by Democrats is Harvard Law School professor Noah Feldman. As Breitbart notes, Feldman “was taken in by the ‘Russia collusion’ conspiracy theory, claiming in September 2017 that ‘more and more evidence of collusion between Donald Trump’s presidential campaign and Russia has come to light,'” even though none was found by the Mueller investigation.
In fact, Feldman has been foaming at the mouth over impeachment for virtually the entirety of Trump’s presidency. Believe it or not, Feldman actually believed that Trump should be impeached over the following tweet:
How low has President Obama gone to tapp my phones during the very sacred election process. This is Nixon/Watergate. Bad (or sick) guy!
— Donald J. Trump (@realDonaldTrump) March 4, 2017
On March 6, 2017, two days after Trump made this tweet, an opinion piece by Feldman was published at Bloomberg in which he argued, “If the president has made false claims of a crime without proof, there’s only one constitutional remedy,” and that remedy is impeachment.
The sitting president has accused his predecessor of an act that could have gotten the past president impeached. That’s not your ordinary exercise of free speech. If the accusation were true, and President Barack Obama ordered a warrantless wiretap of Donald Trump during the campaign, the scandal would be of Watergate-level proportions.
But if the allegation is not true and is unsupported by evidence, that too should be a scandal on a major scale. This is the kind of accusation that, taken as part of a broader course of conduct, could get the current president impeached. We shouldn’t care that the allegation was made early on a Saturday morning on Twitter.
