Pigford v. Glickman: 86,000 claims from 39,697 total farmers?
I’m confused.
If there are only 39,697 African-American farmers grand total in the entire country, then how can over 86,000 of them claim discrimination at the hands of the USDA? Where did the other 46,303 come from?
Now, if you’re confused over what the heck I’m even talking about, let’s go back to the beginning of the story:
Pigford v. Glickman
In 1997, 400 African-American farmers sued the United States Department of Agriculture, alleging that they had been unfairly denied USDA loans due to racial discrimination during the period 1983 to 1997. The farmers won the case, known as Pigford v. Glickman, and in 1999 the government agreed to pay $50,000 each to any farmer who had been wrongly denied an agricultural loan. By then it had grown into a class action case, and any black farmer who had filed a complaint between 1983 and 1997 would be given at least $50,000 — not limited to the original 400 plaintiffs. It was estimated at that time that there might be as many as 2,000 beneficiaries granted $50,000 each.
According to the summary of the case linked above,
Originally, claimants were to have filed within 180 days of the consent decree. Late claims were accepted for an additional year afterwards, if they could show extraordinary circumstances that prevented them from filing on time.
Far beyond the anticipated 2,000 affected farmers, 22,505 “Track A” applications were heard and decided upon, of which 13,348 (59%) were approved. US$995 million had been disbursed or credited to the “Track A” applicants as of January 2009, including US$760 million disbursed as US$50,000 cash awards…. Beyond those applications that were heard and decided upon, about 70,000 petitions were filed late and were not allowed to proceed. Some have argued that the notice program was defective, and others blamed the farmers’ attorneys for “the inadequate notice and overall mismanagement of the settlement agreement”. A provision in the 2008 farm bill essentially allowed a re-hearing in civil court for any claimant whose claim had been denied without a decision that had been based on its merits.
Then on February 23 of this year, the USDA finally consented to pay $1.25 billion to those farmers whose claims had earlier been denied:
In the 1999 case Pigford v. Glickman, the USDA agreed to pay 16,000 black farmers $1 billion after a judge held the federal government responsible for the decline in black farmers. Critics argued that more than 70,000 farmers were shut out of the lawsuit. In 2008, then-Sen. Barack Obama and Republican Sen. Chuck Grassley got a law passed to reopen the case, and the settlement talks moved forward.
The $1.25 billion settlement, announced Thursday, comes on top of the money paid out a decade ago. The new agreement would provide cash payments and debt relief to farmers who applied too late to participate in the earlier settlement, The Washington Post reported. Authorities say they are not certain how many farmers might apply this time, but analysts say the number could be higher than 70,000.
Seventy-thousand+ applicants in addition to the 16,000 already compensated now means that over 86,000 people are slated to be paid.
The U.S. Senate and Shirley Sherrod
Which brings us up to today, when two current events suddenly thrust this otherwise little-known case into the spotlight. First, the Senate stripped funding for the settlement out of an unrelated war appropriations bill, as they had done several times in the past. Second, it was revealed today that “A farm collective founded by Shirley Sherrod and her husband that was forced out of business by the discriminatory practices received a $13 million settlement as part of Pigford last year, just before she was hired by the USDA.”
Suddenly, everyone in America is talking about a class-action suit that until a few hours ago very few had ever heard of.
But I want to go back to the beginning.
Forget about Shirley Sherrod’s connection. Forget about the Senate not funding the settlement. There will be plenty of pundits commenting on those aspects over the upcoming days.
What I want to know is: How can there be 86,000 legitimate claimants?
The Census pinpoints the precise number of African-American farmers
I ask this question because it didn’t take me very long to find the latest census statistics released by the Department of Agriculture, which can be found linked to from this official USDA page. There, you will find this direct link to a text version of the Census report, and this recommended pdf version.
In the pdf version of the government’s official 2007 Agricultural Census, Table 53 on page 646 shows that there are exactly 39,697 African-American farmers grand total in the entire nation:

(A scan through earlier census reports shows that this number has remained fairly constant over time, which is to be expected, as farming tends to be a long-term lifestyle rather than a “job” that one gets and then quickly abandons.)
Granted: the original case was valid. But has it spun out of control?
Let’s accept as a point of fact that some African-American farmers were unfairly denied loans by racists in the USDA during the Clinton and Reagan administrations. I’m not casting any aspersions on the validity of the original lawsuit, nor on the courts’ rulings in the case.
But ponder the numbers.
• There are approximately 40,000 African-American farmers in the country.
• Of that 40,000, not all of them have gotten into financial trouble. Some have successful farms.
• Of those who had financial trouble, not all of them sought out loans. Some tried to stay afloat on their own.
• Of those who sought out loans, not all of them sought out loans from the USDA. Some got loans from banks or friends.
• Of those who sought out loans from the USDA, not all of them were denied loans. Some got the loans as requested.
• Of those who were denied loans, not all of them were denied due to discriminatory racial practices.
In the end, a total much much smaller than 40,000 could legitimately claim to be victims of discrimination.
As shown above, it was originally estimated to be no more than 2,000 possible total plaintiffs.
Somehow, that number quickly swelled to 16,000 wronged claimants.
And now, as of February, the government has announced its plans to hand out at least $50,000 each to over 70,000 more claimants, over and above the original 16,000.
This means that the U.S. may be recompensing at least 86,000 African-American farmers for past racial discrimination. But how could that possibly be true if there are only 39,697 African-American farmers in existence nationwide? And if only some subset of them ever applied for loans in the first place and were then unfairly denied loans?
If someone can explain this to me, I’ll add it in an update to this post. Could it be that there is a constant turnover of African-Americans trying out farming for a few years, and then quickly giving it up, so that although there may be only 40,000 farmers at any one time, over the years, the total number of different people involved in farming is much larger? If so, is there any evidence for this? Or could there be another explanation?
I have a feeling that the Senate repeatedly fails to fund this settlement because there is a strong suspicion among the senators that something is amiss with the case — that a substantial percentage of the 70,000 claims that were originally rejected must necessarily have been fraudulent claims. And so there is reluctance to fork over the money. But there also seems to be a reluctance on the part of the Senate to admit why they won’t fund the settlement, because the issue is just too racially charged.
It is a tragedy that victims of institutional discrimination like the legitimately wronged African-American farmers could be denied their payout due to scammers trying to undeservedly grab a piece of the pie. Instead of getting angry at the Senate for hesitating with the funds, we should be angry at the swindlers (and their lawyers) who contaminated an otherwise valid case.
Unless, of course, there is a clear explanation of where those 86,000 farmers came from. Any ideas?
UPDATE I:
Another Department of Agriculture census report details the total number of African-American farmers in 1992, during the exact time covered by the Pigford v. Glickman lawsuit — and it reveals that there were far fewer back then than there were in 2007. According to the chart on page 20 of the USDA’s pdf 1998 “Status Report, Minority & Women Farmers In the U.S.”, there were only 18,816 black farmers in 1992:

If this is true (and it seems to be), then the disparity between the available total number of black farmers in the U.S. and the number of claimants in Pigford v. Glickman is even far greater than I originally calculated.
UPDATE II:
This official USDA census report, in Appendix 3 on page 24 of the pdf, gives even more statistics for 1987, 1992, and 1997 — every single agricultural census year during the period covered by the lawsuit. Turns out that the number of black farmers in every year was consistently very small:
Total number of African-American farmers in the United States, by year:
1987: 22,954
1992: 18,816
1997: 18,451
Even if there was a 100% turnover, and every single farmer went out of business every five years and was replaced by a new farmer (extremely unlikely), there still wouldn’t be enough black farmers throughout the entire period combined to account for the number of claimants.
It seems, no matter how you look at it, that a substantial number of the 86,000 claims must necessarily be fraudulent.






Reparations.
That’s all it is. Reparations under a different name.
I think you are being much too kind when you grant the case any legitimacy. President Clinton (if you remember) at the time was billed as both “The first Black President” or “The best friend the Black Man ever had.” Furthermore it was a federal crime by then to discriminate by race. Considering all that, just how believable is it that there was massive anti-Black discrimination in the Clinton USDA? And that nobody called it out until this lawsuit 5 years after Clinton had been in office?
I call shakedown.
And when the shakedown worked so well for the original 400, then out of the blue 85,600 phony “black farmers” suddenly remembered how the USDA was racist to them and so applied for their $50,000 handouts, encouraged by innumerable Shirley Sherrods and sleazy lawyers. I’d bet that fewer than 10% of the plaintiffs are actual farmers.
Then-Senator Obama was aware of all this, but his goal was to get reparations one way or the other (and that’s still his goal), so he pushed it anyway. Now that he’s President, it’s time for the Big Jackpot!
And speaking of Sherrod, that’s the real scandal here. She personally scams $13 million out of the USDA and successfully advocates for billions more for her fellow scammers, and as a consequence she gets handed the keys to the piggy bank and appointed a key USDA position by Obama? Talk about the fox guarding the hen house!

You must fall into one of these categories: 1) You did not comprehend the facts of the case, 2) You purposefully choose not to address the facts of the case 3) You are intellectually dishonest, 4) Your emotions over the issue blinds you to the truth, or 5) You are so influenced by your ideology that the truth eludes you. It matters not which of these applies to you as it would appear unlikely that you would reconsider your opinion. Apparently rather than wait – a good short cut would be a “civil rights reparations embezelment fund” to sweeten the pot till they have the support for HR 40 to make it to the floor. Such as we see here with Sherrod. You know the old “you owe me …”.

Kat, I am in my mid 50′s and though I have paid into social security, I would gladly see it terminated. I have been saving since age 28 into a 401K, and I am in a single income household, less than $70K annually. Frugality and thrift are virtues not punishment. Thats how it was done before social security.
Wow…I am 52 and I never got that impression that young people think things should be handed to them…honestly, I see more entitlement among those on social programs, like SSI and SS Disability. I personally know MANY on SS Disability who are given more than they made when they worked, and honestly, some of them are perfectly able to work. But you believe that because people lack discipline to save for themselves, the government should do it forcibly for them? I just received my SS statement. When I retire, I will collect about $1700/month. That means I will use up the $52,000 withheld from my pay in my lifetime in 30 months. Count what my employers put in, and it will last 60 months. Where does the rest of the money come from, since I will probably live for maybe 18 years after I retire? Out of thin air? However, you can find a cutoff age that I bet a good leader could explain that we have to cancel at that date so the program can end. Say at 45 years of age. Then people would still have about 20 years to build their retirement themselves. Pay the remainder out by scrapping the IRS and eliminating the income tax code. After doing that, put us on solid footing with a federal sales tax that has to balance the spending. Before that is done, return all department budgets to 2005 levels. All new agencies since that date will be closed and all personnel associated with it would be let go.

Sherrod’s “government job” was dispersing the monies for the USDA and the White House was afraid the scam would leak out so she was quickly fired. It got out anyway. That’s what happens when you turn over a rock in this evil regime.
I first thought something at USDA was amiss back in the 1980s when I released an economic report that said, in effect, that “gasahol” couldn’t succeed on its merits as an additive in gasoline. Now we have ethanol as a permanent addtional subsidy to corn farmers. And now USDA wants to rehire Sherrod, into a different job. Why not her old one? Was she screwing things up there? Was she cooking up another lawsuit against USDA? The plot thickens.

It’s the difference between “tax farmer”, and “farmer”. We currently have a lot more of the former.

The way it worked was imported wool was taxed and the proceeds given out to American wool producers on a sliding scale, the better your wool, the more you would get. The reasoning was Australian and New Zealand ranchers are heavily subsidized and so American ranchers could not compete in the wool market. To level the playing field American wool was also subsidized by taxing Australian and New Zealand wool. Wool was considered a strategic commodity, one that was vital to waging war and therefore we didn’t want to be in the position of relying on foreign producers. Al Gore sold the country into thinking this was welfare and when he reinvented America he cut the wool incentive program and put most sheep ranchers out of business. He didn’t cut the tax on imported wool however.
Heck if they’re handing out “free” money, I’m getting in line! It’s like the residential school scandal in Canada. As it turns out, EVERY single aboriginal Canadian was abused in these schools including many who never attended one.

I know the government and most of you on this site treat women as second class citizens, but they are NOW allowed to use the court system. Could that be from where the other claimants came? Do you think the author of this piece missed that piece of information or left it out on purpose? Either way their investigative journalism can not be trusted.

If the recipients are not black farmers who were denied loans by the USDA in the time period covered in the suit then the thing is fraudulent. Call it what it is, no matter what color it is. Fraud is fraud.

It was determined that claimants would have difficulty meeting legal burden of proof in demonstrating that they had been discriminated against by the USDA.
Therefore they set up two “tracks” for claimants: one would require only minimal evidence (“Track A”) and would result in a fixed $50,000 payout; the other (“Track B”) would have to meet the standards for a civil case but had no cap on how much could be awarded in damages.
The Sherrods were part of a group that filed under “Track B”. The group recieved a $13 million payout, I’m not sure how much of that actually went to her and her husband.
Sherrod and her collective got 13 million plus she and her husband got $150,000 each for pain and suffering. The total damages in the payout to everyone came to over a billion.

Oh, shut up. The total given by the census for African-American farmers includes farmer of all genders. Women A-A farmers are not excluded. The separate statistic you cite, listing the number of women farmers, is just a different way of slicing the same pie — not an extra pile of separate farmers excluded from all other categories.
This sounds a lot like bus accidents back in Boston (and probably in other big cities). If a municipal bus was involved in an accident in certain parts of the city, there would be more passengers on the bus after the accident than before, and they were all grievously injured and planning to sue the city for big bucks.
Years ago – small article in the Boston papers said that two trolley cars had collided on South Street. Next day, dozens of injury claims filed by “passengers.” Following day, small clarification article told that both trolleys were empty and “out of service” at time of crash.
More recently, security video showed nearby pedestrians climbing aboard after bus collision and then limping and lying down “injured.”

The Pigford petitions were filed in 1997, not 2007. And in 1997, there weren’t even 39,697 black farmers in the country.
There were only 18,816, according to the USDA’s figures.
And there were actually 96,305 total Pigford claims, as near as I can add up the figures from reading transcripts of the Farm Bill debate. 22,505 of those were filed on time, and ruled on under the original settlement – of those 13,348 were approved. There were also an additional 73,800 that were filed too late, but thanks to the Farm Bill of 2008 those poor souls were given another chance. Incidentally, Obama as a candidate strongly supported extension of Pigford for those who didn’t meet the original deadline.

You are using 2007 census data, when what you probably should be using is the data from the 2000 census…the judgment in the original case being handed down in 1999 and all, that would provide the most accurate contemporary count of how many African-American farmers there were.
Additionally, you’d have to tally how many African-American farmers there had been, in total, from 1983-1997, who had applied for USDA loans and been denied.
Now I have no idea if 86,000 would be a reasonable figure for that, but if there are 40,000 black farmers in 2007, and remembering what the 1980′s were like economically for all American farmers, I would assert that that number might not be out of the realm of possibility.
As you point out, the tally of total Afr-Am farmers would give us only a gross set, and the subsets of applicants for USDA loans would have to be dug out further, but at least that would give a realistic starting point.

Farming is a long-term profession, not a temp job.

Actually, yes. But it was in Brazil of the 1950′s to the 1980′s, as the government urged all the underclass to head west and settle the Amazon basin by farming.
As happened in the tobacco belt in the USA, the swidden agriculture gave them about 4 years or so of decent crops and decent yields, and then the soil was exhausted and they went bust…and filtered back to the coast to live in the favelas until the next turn on the Rondonia or Amazonas “agricultural merry-go-round”.
But to directly answer your question, outside of a maritime occupation…no.
It’s possible that a lot of these ‘farmers’ are people trying to qualify for the (many) tax benefits. My boss kept a rabbit hutch (which only had rabbits during an inspection) in his backyard in order to claim that his house was a farm and get out of some property taxes. These cases don’t deserve compensation, of course.
It’s also possible that many of the claimants are wholly illegitimate, just people encouraged to make a claim in order to bump up the numbers and pressure a settlement. Class actions in general are famously prone to this problem, as some people will apply to every class action under the sun, since there’s no penalty and you occasionally get a check.
There’s also MASSIVE fraud problems – the Fen-Phen class action, for example, court auditors ended up bouncing more than half the claims that included heart scans (!) and further review estimated that 70% of the remaining claims should have been rejected as well. Further investigation turned up ‘echocardiograms’ being performed in hotel rooms and doctored results. Nobody went to jail for all this, of course. Or the asbestosis class actions which are an infamous racket where 95+% of claims substantiated with actual evidence end up being fake and entire companies end up getting liquidated by the fraud. Look up Dickie Scruggs, he was one of the worst players in that ongoing mess.
Anyway: normally the fraud is mitigated somewhat by setting up tiers of claimants…but that’s specifically not the case here. If this class action is like any of the other bigguns, it’s probably safe to say that most of the claimants, well, aren’t.
Maybe all of the ‘white’ farmers who had to deal with Shirley Sherrod should be able to file a class-action discrimination law-suit.

That’s a possibility. Were there a number of white farmers screwed by Shirley Sherrod before her alleged conversion to class warfare? She has already admittedly that the one mentioned in the speech received initially her second best efforts.
Proving a charge of racial discrimination can’t be easy, but, I’d think the video as ‘proof’ per a specific ‘time-line’ regarding Sherrod surely adds some legitimacy to the charge if it ever made it to a lawsuit. How much harder it is to prove racism against whites is the new ‘discussion about race’ us cowards in the USA have yet to have though (without being called racists for even mentioning it).

There seem to be several “unusual” aspects to the settlement of this massive lawsuit. For one thing, Charles Sherrod said that New Communities successfully sued the USDA on the basis of “late payments” by the USDA. Now the government is delaying funding for settlements again.
Personally, I would like to know exactly what kind of new position Shirley Sherrod was offered after the “full video” was released. Remember that she was offered the new position at about the time she was being compared to Nelson Mandela and Rosa Parks, and about the time Peggy Noonan was calling for the tape to be shown in schools, presenting Ms. Sherrod as a positive role model.
Is it typical for the Federal Government to create new positions for people they have wrongfully fired? Was a promotion to an existing job classification contemplated? Do Civil Service rules apply? Whatever the new position is, my guess is that she won’t take it.
She originally got her job at the USDA days after winning a lot of money from them. Did this happen with any of the other plaintiffs in this massive case? Is this a good way to select federal employees?

This is like the bus accident in New York a few years back. A city transit bus collided with another vehicle and sustained heavy damage. A huge number of passengers came forward claiming all sorts of grievous and expensive injuries, mostly whiplash and head trauma. When a drunk driver almost killed my daughter and I (and by the Grace of the Lord we came out with nary a scratch except for my back and whiplash pain), the Lawyer representing our case kept trying to convince me to ‘milk it for all it’s worth’ and rack up doctor/chiropractor bills but, I refused and instead did my own physical therapy and we got a small amount rewarded because I didn’t “work-the-system”. And, believe me, we could have used the money at that time but I felt it was disgusting and dishonest.
As someone who took Vioxx for several years (and wish I still could), I was approached to join the class action suit. I refused. Vioxx was and would still be a great drug if not for the John Edwards of this world. I spit in their general direction.

Thomas, lots of conservatives are against the “war” on drugs. Our street is littered with green mulberries (hallucinogenic) and the police do nothing. Marijuana grows like a weed in the lawn of our police department. Teenagers in Hawaii lick the skin of endangered frogs to get “high” from the poison. The police do nothing. It is the “war on (some) drugs”. Healthy and non-addictive coca leaf tea is not only banned from this country (except the decocaineated leaves imported by Coca Cola), but we destroy the crops of honest farmers in other countries because some evil people refine dangerous and addictive pure cocaine from the leaves. It is most of all an excuse to use the word “war” so that constitutional rights can be thrown aside (see forfeiture – police can take your stuff any time they want without trial, just need some “reasonable suspicion”, like a cocaine sniffing dog detected one of the 1 in 4 bills in your wallet that was once used by a drug dealer).
I would legalize all “drugs” that don’t require a chemical laboratory to synthesize or refine. Granted, this would legalize opium and pot, but I don’t see how these are any more dangerous than alcohol (or green mulberries or poison frogs). Refined cocaine, heroine, and synthetic drugs are another matter, and maybe need to be “controlled” like any dangerous prescription drug.

As in probably all Class Action lawsuits, this lawsuit involves extreme greed, profound dishonesty, and shameless corruption at all levels, across the board. Not a single involved group is telling the truth, being fair, or behaving ethically.
The single largest problem (besides the original lawsuit being declared a Class Action) was the 2008 Farm Bill, which quite intentionally opened up a Pandora’s box for black farmers (and almost certainly others) to loot and steal with wild abandon. After all, who would argue against themselves receiving vast quantities of other people’s money, with no strings attached, for nothing?

A $40 million suit published in a recent Sunday Parade Magazine was offering $16 to each of the claimants, the remainder to be distributed among various other “accounts” (read: law firms). Law is a great profession, but don’t try to convince me it’s top heavy with altruists.

I wonder how much of that money went to sustain actual farms, let alone farms that were ever negatively impacted by unequal access to loans. But again, this type of dependence on free money wasn’t limited to this lawsuit.

I think you got it. The “community organizers” got their hands on a settlement that only applies to one race, they have to fudge the little detail about being farmers. But a very large pot of money designated to members of a specific race was too delicious not to “spread around”.
I hope Zombie does a follow up piece on this uncovering who made the key decisions regarding this lawsuit and who is responsible for overseeing the claims payment process. Some one should be held responsible for not properly vetting the claims.

You have to look at the definition of “farmer” for these purposes. Anyone with a gross (not net) income in excess of $1000 is a farmer according to the USDA. The census may have a different definition (I don’t know).
Although USDA and Justice have said they want to pay an extra $1.25 Billion (1) to more Pigford claimants, the judge has not approved the addition.
As I understand it, native american “farmers” and Hawaiian “farmers” are waiting to file their own lawsuit.
This is business as usual. In fact some “conservative” farm state senators are supporting the revised settlement. Why? Could it have anything to do with securing Black Caucus support for the farm bill.
The funding bill will pass–after the November election.

This official USDA census report, in Appendix 3 on page 24 of the pdf, gives even more statistics for 1987, 1992, and 1997 — every single agricultural census year during the period covered by the lawsuit. Turns out that the number of black farmers in every year was consistently very small:
Total number of African-American farmers in the United States, by year:
1987: 22,954
1992: 18,816
1997: 18,451
Even if there was a 100% turnover, and every single farmer went out of business every five years and was replaced by a new farmer (extremely unlikely), there still wouldn’t be enough black farmers throughout the entire period combined to account for the number of claimants.
It seems, no matter how you look at it, that a substantial number of the 86,000 claims must necessarily be fraudulent.

If you take 1987 as a constant figure, (and I’m being generous), and assume that there were just under 23,000 Afr-Am farmers per year for every one of the 14 years covered by Pigford, you would arrive at a total of 322,000 black farmers.
Now many, if not most, of these would be the same individual, counted 14 times, but for the sake of argument, let’s assume that this isn’t the case.
There would still have been 322,000 individual black farmers.
For there to be almost 90,000 litigants who had applied for, and been denied on the basis of discrimination, USDA loans and therefore be legitimately entitled to redress, this would have meant that the farm failure rate among Afr-Am farmere would have had to approach 30% a year for every one of the 14 years of Pigford; and almost every one of them, almost 7000 farmers a year, would have had to apply for a USDA loan.

Following Senate passage Thursday of a war supplemental appropriations bill that dropped money to settle two long-standing discrimination lawsuits, National Black Farmers Association President John Boyd said Friday President Obama should call for a stand-alone measure to pay for them.
The House version contained funds to settle a suit by black farmers against USDA as well as a Native American suit against the Interior Department.
“Without pressure from the White House, this funding will not make it through Congress,” Boyd said in a news release.
Boyd added he is afraid Congress will not act before an agreement between USDA and the black farmers to settle the suit expires.
Lawyers for the black farmers and the government reached a deal this year to settle the suits for total payments of $1.25 billion, but $1.15 billion of that was supposed to be appropriated by June 30. On June 29, both sides extended the agreement for 50 days.
The Obama administration has declined to tell lawmakers that the settlement merits emergency funding, which would not require an offset. Neither the White House nor USDA responded on whether there had been any change in the administration’s position on emergency designation.

Efforts should be made to FOIA FBI records on the settlement. The FBI was charged for a time in the late 1990′s with attempting to locate class memebrs and potential claimants, and “investigate” fraudulent claims. In many urban areas, people had learned about the settlement and unscrupulous individuals were charging money for seminars, structured to teach others how to fill out the forms and apply for class certification. There were many forms completed which had the same name and addresses of a “black farmer who had been denied loans”, indicating the denied individual was a relative and therefore the applicant was entitled to some relief. That’s how the class grew so large.

You know, watching Sherrod’s full video, you get the feeling that one of the programs she is hawking there for minorities to get loans 100% backed by the USDA to buy land and build a house on it, just might play some part in all of this. I am pretty shocked that anyone would try to re-furbish a farm loan system into a home loan system, but then I’m pretty shocked at most of the spending going on at the USDA… of course in the video she also admits to getting no takers on this program, which is why she needed extra-special help from the regional office.

Sherrod Discloses Her Job Offer
Shirley Sherrod tells CBS News that the job she’s been offered at the Agriculture Department is that of deputy director of the Office of Advocacy and Outreach.
The office, established just last year, is responsible for helping such groups as socially disadvantaged farmers, small farms, beginning farmers and ranchers and farm workers.
Sherrod told CBS that USDA has put into writing the offer she received directly from Secretary of Agriculture Tom Vilsack last week, but she has a number of questions and plans to make a decision by next week. “I need to have a conversation with someone,” Sherrod said.
For those who were off the grid last week, Sherrod is an African-American who was forced to leave her job as a USDA official in Georgia after a conservative website circulated an edited video that made her appear to be racist. After the full video surfaced, it became clear Sherrod was speaking out against racism, saying that poverty, not race, hurts farmers. Vilsack apologized, saying he had made the call to pressure her to resign, and both he and President Barack Obama spoke with her last week to express their regret.

The answer to as why there are 86,0000 farmers is i have family and friends in ms that own hundreds of acres of land most farmers lease their land these days because profits in farming is very low especially for black farmers for example i know a farmer that has 300 acres in ms he farm on 60 acres his self and the other 240 acres he rents out 240 acres to six other farmers so that is a total of 7 farmers including himself on 300 acres of land its simple math census dont count all these farmers because the are not the actual owners of the farm they are lessors of land and they actually grow crops cotton, soy bean, Corn, etc.

1. It was a set-up that really backfired…and ended up looking

2. NAACP attacked Tea Partiers as being racists.

before. I watched the clips, and I watched the entire video.
4. When a person has changed his/her viewpoint, there’s a turn-

5. When Shirley spoke of the white farmer, she spoke as a
racist. It matters that she was not going to give the full
force of her “power”. It does not matter if she finally did
something for him, because we do not know what happened in

6. The purpose of her speech was to introduce “Redistribution
of Wealth.” She did this by saying, “It’s not about blacks
and whites; it’s about the Have’s and Have-not’s. This
belies her recovery from racism, because most Have’s
are white. I do not have wealth, but I would like the
American Dream to be a part of everyone’s future. I do
not want to pay for reparations for slavery, when I never
never owned a plantation. I resent anyone using the color
of their skin as a means for getting something free. It is
an excuse for failure.
7. Shirley Sherrod, if you are reading this, remember you and
husband have too much baggage in your past to call anyone
racists. Bill Ayers, a friend of Obama’s, was with a group
that was organized by your husband, Charles Sherrod. That

No, they did not win the original case. (A fact that is reported incorrectly in this article.) It was settled on the eve of trial. At the time, the class was estimated at 2,000 members. It was only after the USDA agreed to the settlement terms, with a lower burden of proof, that thousands of additional claimants suddenly came out of the woodwork. I’d be very curious to know how it is that Sherrod’s group managed to get $13 million.

That’s why there are more claims than there are currently black farmers – because the discrimination worked.

Your article is based on a faulty premise. Call me if you want details, but the case involves the years after 1980 and before 1987, when there were a lot more farmers, especially Southeastern farmers, who were and are far more likely to be black. The post 2008 re-filings were individual cases (thanks to Charles Grassley, R-IA) and would have been settled some time ago if not for stonewalling at 1600 Pennsylvania Avenue.
2007 census figures have nothing to do with the case, which is extremely procedurally complicated. Seriously, call me. If you want, I can provide my extensive conservative bona fides.

Could it be possible that dependants of the discriminated farmers account for the much larger number of plaintiffs. I could see a case being made based on the quality of life that the entire farmers’ family was denied. On the face of it clearly only the person whose name was on the USDA docs was wronged. But honestly, by extension, his entire immediate family were also the victims of the discrimination. I don’t necessarily agree with this hypothesis but sometimes in life a person is so obviously egregiously wronged that all aspects of victimization deserve to be addressed.

We all can agree that citizens should only pay taxes to the federal government that are levied legally, that is, constitutionally.

Obviously, we private citizens who currently pay taxes would save a bundle and be far more self-reliant like we are supposed to be…because we’d all be richer. Did I read that correctly? Shirley Sherrod and her husband, prior to her being hired by the USDA, got at least a PART of a $13 million settlement for a farm co-op or collective? Wouldn’t that make her part in this business a little suspect, and present – if not an actual – then at least the appearance of a conflict-of-interest and/or impropriety? In a very non-racist way, this whole thing stinks to high heaven. This is just like those LIHEAP payments that went to people who’ve been dead for years, and to people who made multiple times more than the maximum limit (even government employees) because there’s little to no oversight. Take a look at per capita income. The per capita income for red states, using 2008 figures, is $55.847. For blue states, the per capita income is $47,211. To the degree that income tax is redistributionist, it would stand to reason that relatively poorer red states would get a larger portion.
I would be glad to refuse federal monies not generated in my state if the tax system would also become less redistributionist. Nearly half the population at present pays no income tax. I would also support an end to federal price supports for agriculture, as this is not going to family farms but to corporate farms.
What is interesting is the stimulus.
When one ranks the states in per capita income and in per capita stimulus money, we find the following average ranking for blue and red states.

In the pdf version of the government’s official 2007 Agricultural Census, Table 53 on page 646 shows that there are exactly 39,697 African-American farmers grand total in the entire nation:
In this graph, (I tried to copy and paste it into my commnt – but no luck there) there are a TOTAL OF 31,912 actual farms (owned by Black/African American Farmers) in the USA, and there is listed 39,697 actual Black/African American FARMRERS that are active, that is WITH LAND THAT IS BING OPERATED.
HOW CAN ANYONE BE AN ACTIVE FARMER IF HE IS NOT ON/OPERATING A FARM? There are 7,795 people claiming to be active Black/African American FARMERS who do NOT HAVE FARM LAND THAT THEY ARE FARMING, …. so what gives there, also????
When has Obama ever talked against redistributive policies? Never. Obama has ALWAYS been about “sharing the wealth” [his words]. Therefore the Stimulus was also about redistributing the wealth. Instead of redistributing on the basis of those who were needy, it was about redistributing to states who voted for him, who may or may not have been needy. The criteria was to send it to states that supported him, just like the Chicago machine does.
Government pork has got to stop, agricultural subsidies included, the Stimulus included. While I am not in agreement with a flat tax, we need some adjustment of the income tax. When nearly half the population doesn’t pay income tax, we are at a dangerous tipping point. But the main emphasis needs to be cutting spending.
Look, the funds go where the people are. There are plenty of examples of anti-terrorism homeland security funds going to places like Wyoming, and I don’t recall any Teabag rallies in Jackson Hole seeking to refuse that kind of wealth-spreading, even though the likelihood that Osama bin Laden flies a plane into a herd of Angus cattle is probably pretty slim.
That is just one reason I just don’t buy the Republican line…another is that the military budget is off limits as far as they are concerned, and it is huge and bloated and antiquated. We spend hundreds of billions on weapons systems and hardware to fight a land war in Europe against the USSR, which no longer even exists. What Dick Cheney referred to a a “peace dividend” hasn’t materialized because of the addiction of so many Republican congressmen to the defense spending in their districts. That type of wealth-spreading, also OK apparently.
I am all for more people paying taxes, because that would mean they are making money. Half the country not making enough of a living to pay taxes on it is indeed a bad thing, but not for the reason you mean, I think.
30 years of voodoo economics has had the effect of a gigantic redistribution of wealth, concentrated upward. The gap between the middle class and the super-rich has never been wider, and good hardworking people are falling out of the middle class every day. While people are arguing about gay marriage and other stupid shit like that.
What I want to know is, is there a Republican with any intention of doing anything about that other than getting elected to a government job by saying government can’t solve our problems, and then doing everything they can to prove it through incompetence and malfeasance?

Part of your article says that Sherrod received $13 million BEFORE she hired on to USDA. In an article By Howard Kurtz Washington Post Staff Writer Thursday, July 22, 2010 he says she worked for USDA for 24 years.
How does that compute with your article? It would appear to me that she started with USDA in 1986. If she filed a claim when she was an official at USDA, did she recluse herself from the settlement process? In your article it sounds like she made her claim “before” she hired onto USDA. Am I confused?
This blog post uses some funny math. It’s basing it’s 39,697 on the 2007 agricultural census. But that tells you nothing about how many black farmers there were from 1983 to 1997 which is the period covering the lawsuit! Just going from 1997 there were 47,658 black farmers in America. But that still doesn’t tell us the total number. We’d have to look at each year from 1993 to 1997 and account for black farms that went under those years and were not part of the final 1997 total. Since I’m not getting paid to do that I’m not going through those numbers. I’m merely pointing out that the number in the article was crap.

This official USDA census report, in Appendix 3 on page 24 of the pdf, gives even more statistics for 1987, 1992, and 1997 — every single agricultural census year during the period covered by the lawsuit. Turns out that the number of black farmers in every year was consistently very small:
Total number of African-American farmers in the United States, by year:
1987: 22,954
1992: 18,816
1997: 18,451
Even if there was a 100% turnover, and every single farmer went out of business every five years and was replaced by a new farmer (extremely unlikely), there still wouldn’t be enough black farmers throughout the entire period combined to account for the number of claimants.
People, I believe with my whole heart, everyone should be treated equal. BUT, I for one am so friggin tired of the blacks a that always have their hand out, but there’s never anything in it. I’ve heard of ‘white guilt’, which I have never felt, but I am currently experiencing ‘white embarrassment’. C’mon man. It’s not about race, it’s about economic class. I read all this. If I understand it the government initially awarded 400 claims, then an additional 13,378. The number of Black farmers was (is?) 39,697.
So, 34.6% of the claims were allowed. IF 86,000 claims were really filed by people alleging to be Black farmers that just means a lot of Americans are trying to sacm all they can out of the government. I haven’t read every single comment, so someone may have already said this, but the real issue isn’t discrimination. The real issue isn’t that more people applied for the $50,000 than were eligible. I don’t care how many black farmers there are or aren’t. I don’t care how many applied for loans and got accepted or rejected. The real issue is that the government shouldn’t be loaning money to anyone of any skin color for any reason, and the USDA (and a zillion other gov’t agencies) shouldn’t exist.

There was nothing taken out of context on Sherrod’s statement. It was just as she spoke the words,

My take on the incident was the farmer new more about what was due to him than Sherrod did. What happened is she did not give him what was due to him, which is racist. I’m sure the farmer pointed out what he was due and she then responded to his needs, but not before. Because she was ticked off that he thought he was superior. Not really, superior ( smarter).
I’m ticked that no one has come forward to point out this women’s short comings.

I’m pretty sure that filing a fradulant claim is illegal and punishable by law. So why arn’t these claims investigated and the ones that are false (and it shouldn’t be to hard to figure who is legitamate and whose not)be prosecuted. I think that if found guilty they should be fined. This should not only fund the legitimate claims but put more money into the coffers to fund other things. Here’s a thought folks…while huge numbers of African Americans, farmers or not, are alleging racial discrimination in this huge melting pot of ours perhaps there are quite a few other racial groups that are feeling discriminated against because they are not 1. African American 2. Mexican American or 3. any other official “minority-American” group yet face the same exact issues as the officially accepted minority groups. Sooo, what is to stop a European American, White American or any other American from claiming some African blood line somewhere in their past to be included in this hand out? Chances are if a non-minority claimed any type of racial discrimination they would be laughed out of court, the media or any other tribunal available because – didn’t you know – one CANNOT be discriminated against in America unless you’re a member of an officially recognized minority group? Perhaps this whole guilt card/discrimination card has been picked up by some who are really tired of excluded and penalized for NOT being a minority. Prove they don’t have African heritage somewhere in their bloodline. Perhaps that’s where the numbers multiplied. Many non-minorities are now claiming some officially recognized minority heritage so as not to be discriminated against and penalized in school admissions, government programs and yes, handouts.
I am fed up with all of this. There is racism, classism, weightism, lookism, ageism. People are and have been and will always be judgemental on all levels. I was recently audited by an IRS black woman. I have no doubt she was pulling a Shirley Sherrod on me. She had an very superior attitude with me. My husband has a black boss who is so incompetent but no one will say anything. We are victims of reverse discrimination. Who’s going to pay us? What about the children of Israel? Who compensated them? There is injustice. If these black people weren’t sent here by disgraceful, disgusting people, they would possibly still be in Africa. Take a look at the country. Thereis so much misinformation put out here I hardley know where to start, but the most glaring, preposturous claim is the fact that Shirley Sherrod rec’d 13 million $’s from the lawsuit which I think you all know is not true but why let something like that get in the way of titillating all the robots who love to think alike in the most negative terms that can be construed in the worst possible light to further your sick agendas? Their claim was in the form of a class action suit divided among thousands of farmers & their take was for $300,000 to be divided between her & her husband, NOT 13 million! During the period covered under the lawsuit , back in the 80′s, there could have been 80,000 black farmers & common sense tells you that since they all mostly lost their land due to the gov’t not living up to their committment to them as psomised, the numbers dwindled to the present count. The reason the ranks swelled is because it was deemed by lawmakers that the cases were not treated fairly, some missed the filing deadline & attorneys were handling most cases in a sloppy way. Hence, the 2008 law passed to reopen the case to allow more black farmers to sue. And yes, Obama was a co-sponsor, along with Sen. Grassley (R) and other Republicans were on board with it as well. All of you need to broaden your network & get your news from some non-partisan sites who play fair & square by the rules instead of playing loose with your facts.

Did you not read the part about the DOA farm census? Whatever the number, 40,000 or 80,000 black farmers, would they all have qualified for loans? Do just white farmers have to qualify for loans? Another note, there were more farmers (minorities and white) in the 80′s than in 2008. The attritiom has many causes: retirement, death, bankruptcy, etc.. The Department of Agriculture was no more responsible for the failures of minority farmers than it was for those that were white. What happened here is fraud. I want my money back.

The lawsuit was dismissed when the BFAA failed to show it had standing to bring the suit.
The bottom line is to vote Obama & his cronies out of office. I just did a search on this because of an email forwarded around – and came up with http://www.pigfordmonitor.com, and seems the case is now known as Pigford v. Vilsack and Brewington v. Glickman now known as Brewington v. Vilsack???? what’s with the name change?
I think the name of the case changed to reflect the name of whoever is the new Secretary of Agriculture.
However, it rapidly gets too confusing that way, so I decided to just stick with the original name that everybody was already familiar with. Most of the action I discuss happened when the case was still called Pigford v. Glickman, and thus it wouldn’t make much sense calling it by a name that wouldn’t apply until the future. It would be like a modern author writing dialogue between two fictional soldiers in 1917, and having them say to each other, “Gee, World War I is a brutal conflict!”
(For those that don’t get it, World War I obviously didn’t get that moniker until after WWII came along; prior to that, it was simply called The Great War.)
The way I see it we have 3 choices, 1.) Vote (becasue that is how the system works) 2.) Revolution (because the ends will justify the means) 3.) Move (If you hate it so much move out of the country) Finally, lets not forget how Adolf Hitler took power; Germany was in financial turmoil and bought into Hitlers ideals hoping for financial gain. Whomever denied the loans should have paid for this, not WE THE PEOPLE. Funny how my mother a white woman worked in the fields from the time she was 9 years old and she never got any restitution. Whomever is doing this should pay the bill, not our treasury. Whomever made the decisions to not make the loans should be charged with this, not the people of the UNITED STATES OF AMERICA. It is not their money to spend like this period. This criminal embezzlment and fraud has got to stop. Same with welfare, unless you are totaly disabled. you should have been allowed 3-5 years and then after that go out and get a job….Everybody wants to bilk our system…..and enough is enough. False claims should be denied and these people prosecuted for criminal embezzlement and conspiracy to defraud our treasury. When is enough, enough with people who want handouts. Get off your butts and go get a job like the rest of us.
Reminds me of the big city bus wreck where people from all over the street was crawling on the bus and pretended to be hurt to collect money from suits.

Accessing the public treasury for the benefit of their constituents is what politicians do, so don’t be so shocked. The only question is whether there has been fraud. Until a real investigation takes place, our views are only speculative and not worth much. However, if an investigation is being obtructed by the current administration, we need to know. I wonder why Snopes hasn’t looked into this?

I scribble things down a 100 times a day…to later loose the notes, then months later shred and recycle. I love this idea….no notes to loose, shred or recycle!
