Questions emerged today about whether a key element of the Baltimore City state’s attorney’s case — the knife that was the basis for the arrest of Freddie Gray — was legal or not. The police say that the spring-loaded blade is illegal to carry around in Baltimore. The prosecutor maintains that it was a legal knife and thus the arrest of its carrier, Freddie Gray, was illegal.
On Greta Van Susteren’s On the Record Tuesday night, Fox News reporter Peter Doocy reported that one of the six officers charged in Gray’s death says Baltimore City State’s Attorney Marilyn Mosby is wrong.
Attorneys for Officer Edward Nero filed a motion Monday explaining that Gray’s knife had a spring-loaded blade that released with the flick of a wrist.
“In other words, the kind of weapon that would earn anyone a trip to jail in this city, including Freddie Gray,” Doocy said.
Doocy explained that Nero, who is charged with second-degree assault, misconduct in office and false imprisonment, now wants Mosby to produce the knife to show the world that it is not legal.
Mosby’s office released the following statement to WBAL:
While the evidence we have obtained through our independent investigation does substantiate the elements of the charges filed, I refuse to litigate this case through the media. The evidence we have collected cannot ethically be disclosed, relayed or released to the public before trial. As I’ve previously indicated, I strongly condemn anyone in law enforcement with access to trial evidence, who has or continues to leak information prior to the resolution of this case. These unethical disclosures are only damaging our ability to conduct a fair and impartial process for all parties involved.
