Having looked at gun laws, due to recent coversations occuring across this continental union, and in particular the exclusionary categories–it seems to me that if we are going to deny freedoms to those who have not actually done anything violent, but are stereotyped in with the type of person who does, then it is both a violation of the equal protection clause (for we are making decisions not based on the individual, but stereotypes), and, if we are to treat entitlements as property rights, as sometimes happens, then should not the denial of a birthright and Bill of Rights right be seen as an eminent domain of a right that society needs to compensate that individual for, for the individual has not done anything deliberate, as the other exclusionary categories are?
Re: S&P–my guess is that there is something legitimate for the government to go after, and the reason they went looking at that company in particular is that some liberal at Justice got ticked off when the rating downgrade happened, and got motivated to find a weak spot.
