Pima County SWAT believes that Tucson resident Jose Guerena is an Iraqi war veteran turned bad, participating in a home invasion robbery ring.
Guerena was at home sleeping “after working a night shift at the Asarco copper mine.” Apparently, though he held a semi-automatic rifle as SWAT burst in, he never fired.
Police attorney Michael Storie claims they’re right, because they found “found rifles, handguns, body armor and a portion of a law-enforcement uniform inside the house where Jose Guerena was shot…”
Charles Heller of Tucson’s Liberty Watch radio says “Body armor is perfectly legal here, except if it is used in a crime.” So are handguns and rifles. Civilians can legally buy police gear like duty belts, holsters, etc. (What’s a “portion”?)
Heller also notes:
“Much more going on than meets the eye. SWAT let him “cool off” for 60 minutes before they let medical in. Many lies by SWAT about his position in house.
Oath Keepers went in to investigate and found that some SWAT members shot through walls from outside; neighbors have 13 new holes in walls. Were told to evacuate AFTER the shooting. 4 of 17 rounds that exited house not accounted for…. Lots of gooey details.”
Guerena family attorney Christopher Scileppi claims police have published four versions of their story so far.
Pima County SWAT is run by Sheriff Clarence Dupnik, who was unable to enforce existing laws to bring Jared Loughner to justice before he shot Gabrielle Giffords. But that didn’t stop Dupnik from blaming “conservative commentators and rhetoric” for a tragedy committed by a fan of Karl Marx and Hitler.






We already know from the shootings in January of this year that Clarence Dupnik is a liar and a political hack. I’m betting he is remaining true to form.

Morally, if someone cannot get justice from the government, they are entitled to seek it on their own terms. I wish SSGT Guerena’s family “good luck”.
If Clarence Dupnik were honest, he’d offer to pay the widow, and he’d discipline the 5 SWAT team members. But it took the Board of Supervisors to settle a jail lawsuit, where Dupnik’s jail guards beat up an inmate in the head, causing trauma. Dupnik prefers to lie and kill veterans. He’s a Democrat who like Napolitano and the Department of Homeland Security, believes that returning veterans are terrorists who need to be eliminated. If you’re in Tucson, hide the fact that you’re a veteran. You’re safer that way. Tucson is a largely Democrat city, with a liberal University of Arizona, all who equate the veteran with the evil they see in wars. War protestors choke if asked to support the troops. Just picture Tucson and Dupnik as the equivalent of Bill Ayers in the 1960′s and people who spit on returning Vietnam war veterans. Dupnik is so angry at conservatives and veterans it’s hunting season on veterans and the military in Tucson Arizona. It’s a hotbed of liberal goons, led by the Chief Goon himself, Clarence Dupnik. Tucson wants to secede from Arizona and become a separate state. It may even prefer to join with Mexico or any foreign interests that hate America. Clarence Dupnik essentially has declared open hunting season, on military veterans. Year round. No hunting license needed. Dupnik is the liberal hero of Tucson, who blamed conservatives and the military for Giffords’ death. Even the slanted Tucson newspaper, the Daily Star, asked Dupnik to explain the marine killing. Dupnik refused to explain, but has ridiculed anyone who questions his conduct. he’s been sheriff for over 30 years. He’s been a local dictator in police operations, largely immune from criticism. he hands out some liberal platitudes so the local Democrats support him, even when he murders a marine.
So many things were planted in that home I’ll bet the sprouts are coming through the windows and from under the doors already.

Reuters reports that Sheriff Dupnik acknowledged that “there had been earlier contact between Loughner and law enforcement after he had made death threats, although they had not been against [Rep. Gabrielle] Giffords.”

You may be partially correct, in that Loughner should have been evaluated, and an ‘unstable’ outcome would have put him on the NICS No list. However, it also appears that Loughner got away with death threats, which, if prosecuted, would have landed him on the NICS No list. Some of these threats were within Dupnik’s sphere of influence.
Since my police contacts say that one arrest usually represents multiple violations, there are likely many times Loughner wasn’t arrested. Dupnik is high on the food chain in the large tolerant, permissive community, in Tucson. Enabling in my mind equals accessory before the fact. Perhaps a guilty conscience is why Dupnik had to lash out at others? That’s pretty common when people go off like he did against existing evidence.
Does anyone know why the no knock warrant was issued? How many were issued and why? Were they all served at the correct address? Can a reasonable SWAT team serve 1,2 or 10 in a day? Was there planning involved or did they just go kick in doors? How well trained was this SWAT team? Was there any illegal material or stolen goods found?
I think the Sheriff is a dumb political hack with no talent and no class. If the dead civilian had committed no crime the SWAT team should man up and admit the mistake of be charged with murder. There are no winners here, the civilian lost and the SWAT team lost. The Sheriff is just a looser whoring himself to illegals and slackers for votes.
The problem I have with this is that it looks like the cops involved screwed up, have covered this up, and are now asking for permission to essentially supervise themselves. The Sheriff, of course, is not interested in an independant investigation, certainly not in a situation like this where if the investigation winds up finding the department at fault it’s going to make him look bad. On the other hand, it’s hard to see how the department can justify shooting automatic weapons like that, into a neighboring house, without evacuating the other house. Supposedly this was a bust, but they didn’t have time to alert the neighbors? Generally when it’s a bust like this, you take as long as you need to prepare the area, clear out civilians who might be in the line of fire, etc. Typically, these days you never want to be shooting (especially automatic weapons, which put out *lots* of bullets very fast) without knowing where the bullets can go, if you can control the situation. Since you’re choosing the battlefield, so to speak, you can control the area around it and minimize the chance that stray bullets can hit someone. This seems to have been neglected, which leads me to believe that either they’re very incompetent, or they aren’t telling the truth. My guess is that they were stumbling around the neighborhood in their bust gear, half-trained, the guy heard them and got his gun, someone saw him through a window and decided he was a threat (all without identifying themselves as cops) and they escalated from there, because since he had a gun *of course* he’s a criminal. After shooting him, they probably didn’t want anyone near the dead body until they thoroughly examined it, looking for something that would justify shooting him, so of course they let him bleed out. Now they’re just trying to cover their asses, hoping that something else happens somewhere else to distract everyone, so they can stall and in a month release a report exonerating everyone, except the guy who got shot. He of course is a criminal, and should not be missed.
Time for Dupnik to go. Pima County, whatcha gonna do? Roll over and capitulate? Remember, the feds are breathing down your neck – do you really need local help for them?
The governor should charge the state AG to run an investigation and file charges (if called for) against the SWAT Team and the sheriff and if she has the authority under AZ law remove him or suspend him immediately until the investigation is complete. Cops are supposed uphold the law not break them.
This reminds me of the Vet. who was shot to death leaving a sporting good store after it was called in that he had a gun. He had a permit and didn’t know cops were waiting outside for him.That was murder plain and simple sounds like this is also.
Really? They don’t like their integrity questioned. It’s called the constitution but apparently that doesn’t seem to get in their way, can you imagine the uproar there would be if Bin Laden was shot 60 times, there would be all kinds of investigations and questions of legality and justification!!

What a bunch of nonsense. Know what they found?? A baseball cap that said Border Patrol, like the kind a cop buddy would give you, or you might pick up on eBay as a joke or a souvenir.
That line is so disingenuous, and frankly it’s the only line they’ve got that makes you wonder if he guilty of something. It really shows they are not interested in the truth and the law; just covering their own ass by making the dead veteran look bad.

I believe that in AZ there is a law that if someone is pointing a gun at you or someone else, you have the right to shoot them. Theres more details but you get the point.

I worked with Jose or Joe as we called him on many many occasion, and his character was that of a good and very hard working man. If he was a drug dealer or involed in other allegations, why was he working these crappy hrs in one of the hardest jobs there (yes it sucks).
This is the kinda work were you do it for the pay not the pleasure.
You shovel all day/night, very dusty, sometime in extremely uncomfortable positions, hot, cold, rain, wind, and could be dangerous if one is not carefull (Like I said not a place one works for fun).
Now I’m open minded, and understand that one can be deceived about someones personal life, but on this subject it’s gonna take alot more than a lawyers statement to make me think otherwise about Joe. As for now I wish nothing but blessed wishes for Joe’s family in this tragic time.
