Democrats Mourn ObamaCare Verdict
Last month’s stunning ObamaCare verdict, a 5-4 decision in favor of the law on the basis of a new and unprecedented taxing ability, has Democrats across the country loudly mourning the verdict and calling for Chief Justice Robert’s head. News media across the nation somberly announced the partisan verdict on to a shocked Democrat audience who just thought they were getting free health care, not a religious dictatorship. The new verdict allows the federal government to ban behavior they don’t want, or force behavior they do want, just by taxing it, since you will be jailed if you don’t pay the tax. All the federal government now has to do is make a tax on something high enough to essentially make it a crime. Democrats are crying foul because they never intended the law to be considered a tax in the first place.
There is now little doubt the Republicans will take over the presidency and Congress after the elections in November, partly due to the passage of the unpopular ObamaCare legislation, which spawned the Tea Party movement and angry town hall meetings across the country. Many congressmen have already lost their seats, and Rasmussen reports that even after SCOTUS found the law constitutional, 52% of Americans who plan to vote favor repeal versus 39% who don’t — which will surely be reflected at the polls. While Democrats are happy to have another impractical behemoth of an entitlement with which to punish the rich and permanently shackle the middle class, they didn’t count on the consequences — that of giving unlimited power to the government, which isn’t so great if your side is out of office.
Is It a Republican Conspiracy?
Some are crying conspiracy, since the swing voter Chief Justice Roberts is a conservative and appears to have changed his vote. Some think he was “gotten to” by the Republican National Committee or a cabal of Beck and Limbaugh fans, pushing a sinister plan to allow the Religious Right to take over the country. As Roberts is an appointee of the much-maligned President Bush, it may very well be true. It may simply be a case of a conservative judge being an activist from the bench, and trying to grant a totalitarian government to the incoming Religious Right, knowing they are only months away from taking over.
The sweeping new tax powers now available to a future Republican-led federal government are frightening in their scope. Since the federal government can now make anything illegal, including NOT doing something they want you to do, Democrats are outraged by the potential trampling of their liberties. Retail stores are reportedly seeing a nationwide spike in sales of Don’t Tread on Me flags, and this time the purchasers are lifelong Democrats and SEIU members.
A totalitarian government seemed all fine and dandy as long as it only required people to buy health care, recycle, not build on swamps, not drink too much soda, not get married, not cut down any trees, not put a grocery store there, not be Fox News, buy a Chevy Volt, buy a house, not use paper bags, not use plastic bags, go to college, have some kids, contribute to certain unions, have some more kids, wear your seatbelt, not save money, spend money — especially on electric cars or student loans, carpool, take public transportation, not drink raw milk, not eat fresh eggs, and give lots of money to other people, etc.. But it is another matter if you want to ban gay marriage and abortion. Oops.

“We now regret sitting by while our own Democratic president, through executive orders and ObamaCare, increased federal authority to such a degree that, come January, we will no longer live in a country where we are free to be ourselves, love whom we choose, and live our lives the way we want as long as we are not hurting anyone else, which is the essence of our great nation. We only wanted to knock a few rich heads together and get some free stuff. Our bad!” said Mike Weederson, spokesman for Media Matters.
Frank Brinkman, from the Human Rights Campaign, the largest national gay, lesbian, bisexual and transgender advocacy organization, said he was “fine with spy drones secretly flying over the homes of Americans” until he realized it will be “gay-hating religious nut cases” at the controls.
The fear and suspicion keep mounting. MoveOn.org claims to have heard from a source in the upper echelons of the Republican Party that there is already a plan underway to charge a $1,000,000 tax on all gay marriages and to apply it retroactively since the Constitution no longer applies to lawmaking, thereby putting many gay and lesbians in jail within the year for getting married in the first place unpaid taxes. Other possible items up for taxation by a Republican majority are things like abortions, not going to church, not helping your kids with their homework, simply being gay, fornicating, being a Democrat, divorcing, living together in sin, being Muslim, a so called “mainstream media” tax, short skirts, and worse.
A Republican Party spokesman, Barry Goodfellow, said on Saturday “nonsense,” but no one believes it.
Many Democrat civil rights organizations are banding together to call for a constitutional amendment limiting the taxation powers of government such that they could no longer manipulate people and markets with the tax code, and could certainly never tax a person for NOT doing something the government wants them to do, but the fate of such legislation seems uncertain.

Not to mention that a Republican Congress can now tax Barbara Streisand and Michael Moore and Yoko Ono and Russell Simons and George Soros and Warren Buffet and Barack Obama and Oprah Winfrey at 95% of their net worth (not income), thereby ensuring that the rich really do pay their fair share.
That suggests that elected Republicans will not be able to resist the temptation of being lured into using the vary-ability of this new seven-headed-Hydra-ability to tax as a way to give democrat party operatives, elected or otherwise, some of their own treatment, tax-wise. Taxation isn’t the solution to anything. Except making more government. And making it more powerful and unchecked. Repeal of 0bumacare is not only the imperative, but just the beginning. From now on, repeal of anything and everything at fed/national level, that, for lack of any better word, “sucks”… the uh… life out of this (former) federal republic must take place. No compromise on repeal. Otherwise, if repealing fed/national programs cannot succeed, the fifty states will have to go their separate ways and become republics of laws themselves, or make themselves slush fund “democracies” such as Tax-a-fornia, Michigan, etc. to bribe the electorates there with looted tax revenue. Post fed/national governments (comprised of the former fifty states) will either sink or rise according to how they chart this course.
Curious, congress wrote the mandate as a tax before they wrote it as a penalty. The Supreme Court ruled it wasn’t a tax for purposes of the Injunction Act (under which a person has to refuse to pay the inactivity tax and be punished for that refusal before the person can appeal to the judiciary on the constitutionality of a do nothing tax) but the mandate penalty (illegal under the commerce clause) is a tax for constitutional purposes. So, that means in 2014, when the first WASP non-Indian (Indians, and Elizabeth Two Tongue Tepee Squaw Warren are exempt from the do nothing tax) refuses to pay the inactivity tax, there will be case that can go to the Supreme Court to determine if it’s constitutional to charge an excise tax for essentially not purchasing tea. We’ve come along ways since the Boston Tea Party over taxation without representation for doing something optional, purchasing tea, to now being taxed for doing nothing, not purchasing the tea. Even the slaves in their day didn’t pay a do nothing tax for failure to purchase the cotton they picked or the Tobacco they didn’t smoke.

Walter Williams sitting in for Rush said today that if more governors like Scott of Fl. refused to implement Obamacare then the whole thing would collapse. Unfortunately there are not too many like Scott and especially in Congress. We have a bunch of big talkers but when their necks are on the block they all go soft and wobbly. If ever the TEA party is needed it is now. We must NOT let this monster get implemented or we will never get it thrown out. There were 26 states involved in the anti-ObamaCare lawsuit. That is 2/3 of the states necessary to pass a constitutional amendment severely limiting the ability of congress to tax or muck around with health care. I think this is in reach. Cheers -

But think about the revenue opportunities…
Smokers pay massive tobacco excise taxes that allegedly fund health programs “for the children”. Shouldn’t Congress enact a “non-smokers tax” for the children?
Citizens could be penalized for not owning a gun and being part of the well regulated militia and gun owners could be taxed for not maintaining a gun-free environment.
The obese could be taxed for, well, taxing the health care system and the fit could be taxed for damaging the mental health of the obese.
The poor could be taxed for not contributing enough to society and the rich for contributing too much (oh, wait, we already do that).
Why the list is endless. Congress can tax you if do and tax you if you don’t.
There’s another revenue opportunity: a tax on walking.
By not driving a car or taking a bus, you contribute nothing to the upkeep of the roads. By burning all those calories, you reduce the chance you’ll need expensive drugs to control hypertension or diabetes. Staying healthy means you’re not doing your ‘fair share’ and contributing to the economy. The least you can do is buy a gym membership. If you don’t belong to a gym and you don’t drive then we will tax you!

The court just gave the government unlimited power as long the mandated decree is punishable for noncompliance by a tax, and that tax can be as high as the government wants. The possibilitys of mandates are endless so liberals how about mandated gun ownership, mandated bow and arrow ownership, mandated Nascar attendance, mandated church attendance, mandation of eating beef products, mandation of drinking beer, mandation of schools teaching about the founding fathers of this country, the Constitution, The Bill of Rights, the Declaration of Independence, oh possibilities are truely endless.

I lost my dad in 2010 because of Medicare death panels. Will Obamacare be an issue this election cycle? You betcha! Can someone give at least a reasonable argument for why the Government needs to be in the business of end of life decision-making. Medicare’s response to my family was, get lost.

Sure, I’ll give you two:
- Social Security is broke. If you die then no more payments to you, thus saving SS money.
- Nationalized health care is a fixed pot of money. Suppose I can treat you and your pre-existing condition, or I can treat 15 other people. Sorry, I’m treating the other 15. It’s simply a bigger bang for the buck. Now suppose that you’re 65 and I can either treat you or a 10 year-old. Sorry, the 10 year-old gets the money because your prime tax paying years are in the past. And, just so you know, Medicare is nationalized health care.
Health care resources are finite and you can either let the market ration them or you can let the government. The argument for the market making the decisions is that you are part of the market so you can influence, or even control, the decisions. The argument for nationalized health care is that a set of fixed arbitrary rules will be established and followed, except where exemptions are granted to those with political connections. It’s really pretty simple… if you’re spending your money then you get to make the decisions; if you’re spending my money then I get to make the decisions.
What if the 15 are on welfare? What about 15 illegal immigrants? This is truly dangerous times we are living in when the Federal Government can play spin the bottle on who dies today.
I don’t even have to open BureauPedia to answer that – you trade the one potential voter for the 15 potential voters with full knowledge that the illegals are, in fact, on the voter rolls. The more difficult question is what happens if I have to decide between 10 Blacks and 15 Hispanics? Do I keep the 10 known and faithful useful idiots or do I trade for the 15 potential useful idiots? I make the trade because the useful idiots will still idiots when they stop being useful. In fact, if you really want to see nationalized health care in action then just look at “nationalized Black America”. Inner City, USA is what happens when you give control of your life over to somebody else.

Joey, I don’t understand your post. Medicare doesn’t have “death panels”. Medicare doesn’t issue “prior authorizations” or “pre-approvals” like most private health insurers do. They do,indeed, retro-actively deny payments, but that’s nothing like death panels.l

You do realize, don’t you, that Medicare is a welfare program? The reality you won’t often hear is this: There isn’t enough money to pay for top tier medical care for all who want it. Not under Medicare, obamacare, or any other kind of care. Rationing is inevitable. The question is the method. Economic ability vs. government dictate. I choose economic ability because I’m a capitalist but there is NO system that will provide equal healthcare for all. Not possible.
What’s funny about the alarm on the left is this: they’re projecting their intentions on the right and assume we’re likely to do all the opposite things that they were intending to do. Since a well-regulated militia is necessary to the security of a free state, then we can now levy taxes on those Americans who choose not to exercise their RTKBA and thereby unfairly burden those of us who DO with the responsibility of service in the Unorganized Militia.
