Today the Drudge Report covers the Justice Department’s racialist attack on school discipline policies. The DOJ policy is based on the idea that school discipline policies are racially discriminatory because black students comprise a greater percentage of students disciplined than their percentage in the general population. Call it exceeding the bad-behavior quota.

That this four-year-old federal policy exists wasn’t news. I covered it in my 2011 book InjusticeWhat is newsworthy is how these radical racialist education policies will outlast the Obama administration, and Republicans are ill-equipped to reverse it even if they win the White House.

As I wrote in Injustice:

The DOJ’s reasoning goes like this: if minorities face school discipline at rates greater than their overall percentage in the population, then the school is engaging in racial discrimination. As Civil Rights chief Tom Perez explained, “Black boys account for 9 percent of the nation’s student population, but comprise 24 percent of students suspended out of school and 30 percent of students expelled.” This preposterous racial bean-counting is an affront to the very concept of individual responsibility.

In January 2011, Perez announced that the DOJ would use a “disparate impact” analysis on school discipline cases to determine whether discipline policies were racially discriminatory. Thus, if blacks were disciplined in higher percentages than their share of the population, the DOJ would bring a lawsuit to stop the discipline policy. The new policy was on display at a DOJ conference on September 27 and 28, 2010, entitled “Civil Rights and School Discipline: Addressing Disparities to Ensure Educational Opportunity.” Attorney General Holder addressed the gathering and sought to “better understand the causes, and most effectively remedy the consequences, of disparities in student discipline.” Perez then complained that minority “students are being handed Draconian punishments for things like school uniform violations, schoolyard fights and subjective violations, such as disrespect and insubordination.”

Some might argue American schools have already allowed far too much disrespect and insubordination among students. That Tom Perez gives quarter for these acts illustrates the cultural demographic he and his fellow Obama political appointees seek to protect—the disrespectful and insubordinate.

We’ve come to expect this sort of policy from Eric Holder of protecting the lawless and misbehaving. The New Black Panther voter intimidation case dismissal was mere prologue.

Republicans in Congress have shown minimal skill in stopping these radical racialist programs.  Instead of defunding the components of the DOJ that perpetrate these lawless policies, they continue to vote for spending resolutions and budgets that fuel them.

And even if the GOP takes control of the Justice Department in 2017, it will take an attorney general willing to roll up his or her sleeves and clean out the mess inside the Civil Rights Division that is fueling these nutty and lawless policies.  Only a few GOP figures understand the scope of the problem and have the courage to correct it.  Among them are people like Representatives Louie Gohmert and Trey Gowdy and Senators Jeff Sessions and John Cornyn.

Here are three reasons why even these four would struggle in 2017 to reverse this lawless nuttiness:

It just isn't as hard as the conventional wisdom makes it out to be. Merit system rules or union contracts notwithstanding, I'll guaran-damn-tee you that I can fire ANY public employee in a year, even a good one. A dedicated activist with an agenda won't last six months. All you need is a chief executive who will back you, and, yes, I know how hard that is.

When we took over in '03 we'd had two years of the Democrat sleepers setting things up in the waning year of a Republican administration that chose not to seek re-election and eight years of a Democrat Administration. They had their radicals, activists, and sleepers planted throughout the government. It took about six months of very visible "eliminations" of loudmouths and a**holes and peace broke out all over. We knew what we were dealing with and it was a structured, planned program, though of course little of it was written down and none of it admitted to. We styled it the "Empty Chairs Program" and I'll admit it drew its inspiration from Operation Phoeniix and other programs to eliminate guerrilla leadership in various conflicts with leftists. If the lefties can talk openly about mau-mauing supervisors, managers, and appointees, I felt I could be pretty open about taking them out. It does marvelous things for morale and loyalty in your workforce when a couple of strange suits from headquarters show up and march somebody who thought they were above such things out never to return. You have to fight it out with the boards and the labor arbitrators, the courts with some of them, but you're the 'effin' government and you WILL win, if for no other reason than you can just grind them down.

The whole "you can't fire them" thing is just chickensh*t managers. They know that if they take out a bunch of lefties in the government, when the Democrats get back in, that manager will be on the "take out" list. It's true; you just have to be brave enough to deal with it. They got me once, but I came back and settled the score.

And yet there are Americans who believe that this situation can be changed, that the ship of state can be turned, that we can save this country, if we just get rid of Obama. He is nothing but the current occupier of the WH; all the damage he is doing is PERMANENT. We can't unmarry gays, we can't unbrainwash our kids, we can never pay back $16 Trillion dollars (nor our grandchildren!), we can't undo the racial damage by this administration. These things are permanent! The fat lady is warming up. Someone prove to me I'm wrong about this.

How can we outlast a racist, cop hating, murderer loving head of the already racist Civil Rights division? A division that has announced that it does not believe civil rights belong to the white race...because of their skin color.

Those three reasons are all failures of political management. No lawsuit can be filed by a line attorney in the Justice Department. The assignment of a case to an attorney needs approval from management. All the Attorney General or his designee needs to do is stop assigning cases in a particular area. Furthermore the Attorney General can transfer and assign any type of case to an employee. Once these attorneys start getting anti-trust cases, espionage cases, or are assigned to defend the government in tort cases, they will probably quit. The President can also move money around in the DOJ budget, take from CRD and give to criminal prosecutions. This was a major failing of Bush. Even better, the AG can start assigning cases of discrimination against whites to the radical lawyers, who will refuse to work on those cases, then the AG can fire those attorneys for insubordination.

There are a lot of decent black kids out there, but what chance do most have? They are surrounded by a thug culture. Chances are they don't know who their fathers' are. They may live with a mother who pops out kids so the state can pay her more. And if they try to learn so they can get ahead in the world they are "acting white"!

How about identify these leftists, and transfer them all to a separate building, take away their internet, and give them " busywork" to do! Hopefully many quit! The ones who stay, try and find something to discipline them on, with the goal of termination!

Disparate outcomes policies are unconstitutional. Even Tom Perez knows that, otherwise he would not have worked so hard to prevent several cases from being adjudicated. It is only a matter of time before this ridiculous theory is thrown out the door. And it couldn't come soon enough.

This is just so stupid! The reason more black kids are disciplined is that they are more poorly behaved than others. Most of them come from single parent families who's mom is on welfare. Their idea of a male role model is some gangsta rapper or the guy toking on a bong selling crack down on the corner. Bad behavior is bad behavior period-back, green, yellow,white, brown, etc. It is quite telling though, that o's hero was a guy that tried to beat a hispanic guy to death-"he could have been my son." So what's the message here? A pothead & thief is a great model for black kids. Oh, please! The doj is just a radical branch of the old KGB if ya ask me. Race baiters & nut jobs. In the real world, you eventually have to pay for your bad behavior, unless you are a politician. But you know what the doj is made up of...

Thanks, Art. My Dad lost a job after an election put him at odds with the party that had won. It wasn't much later that he found another with a resume that included West Point, B-17 squadron commander, and a tour in Korea rescuing downed pilots.

The infestation of our government by those with leftists ideals seems to be something we'll have quite a problem dealing with unless there are people willing to put their careers on the line. For some strange reason, taking a conservative out is easy, whereas a leftist requires an act of Congress. Such is the power of collectivism? Power to the People? As a former hippy (long hair, loved the British Invasion rock&roll) I'm astonished at the intolerance exhibited by former flower power folks who now occupy the offices of The Man. These people wouldn't know the Natural Man if, while passing through, he kicked them in the nuts.

Americans have to wake up to what a disgrace Progressivism is. I've tried throwing water on them. I've tried backing-up into their Prius so their air-bag deploys. It doesn't work. They are asleep and will get up when they're damn, good, and starving. And, just what is it about Costa Rica? Can that place even hold all the people that'd like to go there? Why can't California be like Costa Rica? What have they got that we don't? Brains? Beaches? We've got serfers!

The fastest way to get rid of the attorneys in the Civil Right division of DoJ is to abolish the division. Make very sure the political appointees understand that none of those people may be rehired. Then move over to the Election folks and do the same thing. In a year or so a similar office might be resurrected, but by then those who lost their positions earlier will no longer have re-employment rights.
