Is this the end of the IRS abuse scandal, or a prelude to another tactic? Today the House Oversight and Government Reform Committee released its report on Lois Lerner’s involvement in the IRS abuse scandal.

We’ll have an extensive look at the report on the PJ front page.

The report includes many emails to and from Lerner within the IRS. These emails capture Lerner passing media stories about Democratic efforts to undermine the Citizens United decision. They show Lerner’s evident agreement with Democratic Sen. Max Baucus, who publicly called for the IRS to go after conservative-oriented groups.  The report also details Lerner’s use of unofficial email to conduct official business. This practice has shown up in the Obama administration before, as former EPA chief Lisa Jackson even used a pseudonym and an unofficial email account to conduct official business. The Committee report notes that in Lerner’s case, her use of unofficial email complicates its efforts to obtain all of her communications regarding the abuse of conservative-oriented groups.

The report concludes that Lerner’s left-leaning politics were well known since her time at the Federal Election Commission, and that she was keenly aware of Democratic partisan arguments for undermining Citizens United. One email even shows Lerner hoping that the FEC steps in and “saves the day,” undoing Citizens United.

The report describes both Lerner’s motive for abusing conservative groups, and her methods for doing so — subjecting them to extra scrutiny, and slow-dragging them through an invasive process that hindered their ability to function. The report specifically finds that Lerner used three methods:

1) Scrutiny of new applicants for tax-exempt status (which began as Tea Party targeting);

2) Plans to scrutinize organizations, like those supported by the “Koch Brothers,” that
were already acting as 501(c)(4) organizations; and

3) “[O]ff plan” efforts to write new rules cracking down on political activity to replace
those that had been in place since 1959.

The report also finds that Lerner engaged in acts of cover-up, and made false statements to Congress.

But the report does not answer an important question: Whether Lerner acted on her own initiative, or was working in concert with others higher up within either the IRS or the Obama White House. Democrats including Sen. Baucus, White House counsel Bob Bauer and even President Barack Obama had publicly called for Citizens United to be overturned. They set the tone that Lerner followed. But did they o anyone else in a position of power do more than that?

Presumably, Lerner has answered that question in her secret testimony to the Department of Justice. But she has twice refused to testify openly before Congress.

Is the Committee’s report the end of its investigation, or does it tee up the Committee to find Lerner in contempt of Congress for refusing to testify?

Is the Committee’s report the end of its investigation, or does it tee up the Committee to find Lerner in contempt of Congress for refusing to testify?

Who cares. The issue is why DOJ isn't prosecuting and why she isn't in jail. Of course the answers are obvious, but what that means is we have a constitutional crisis, open lawlessness by the executive branch and no action by Congress.

Those groups who were targeted need to file a lawsuit against Ms. Lerner. Not the Government, not the IRS, but against Ms. Lerner personally. She obviously went against what her superiors wanted her to do, she violated the law without her superiors permission or knowledge. Therefore she cannot be protected by the government and, because she violated the law, must be held responsible personally, not as a government employee. She personally used her position to violate their rights. Then see if she will make a deal or not.

Oh, that's great. Could this be the end of the investigation? Are you kidding me? So, okay -- go ahead IRS and go ahead Dems...go ahead and use the IRS to make it harder on conservative groups to match up against Liberal groups.

What the f*** is going on here? What is in the DOJ report that has Lerner's "secret" testimony? ALL of this stinks to high-heaven. If the IRS were going after Liberal groups like this, we would never hear the end of it, RIGHTFULLY SO, and the government probably would have come to a STAND STILL until this was resolved. What the f*** is going on here? Do I still live in America, or have I been deported to Putin's Russia?

Liberals and Democrat legislators can publically call on the IRS to investigate conservative groups and the IRS obliges (WHICH IS F***** OBVIOUS THAT THEY DID), and we can't get to the bottom of this because an IRS employee PLEADS THE 5TH?!?

You know what? NOW I wish that Nixon had gotten away with it. I really do. I didn't used to, but now I do. If I were a GOP leader in DC, I would be organizing to shut down the entire federal government until we get answers and no more of this Democrat stonewalling BS. The House should stop funding EVERYTHING until we start getting answers because we have a FEDERAL AGENCY USING ITS POWERS TO FAVOR ONE GROUP OVER ANOTHER AND IF THIS ISN'T UNCONSTITUTIONAL THAN I GUESS THAT I NEVER KNEW WHAT IT MEANT TO HAVE OUR CONSTITUTION AND WE REALLY ARE JUST ANOTHER BANANA REPUBLIC. The GOP in DC should filibuster, cut off any and all funding for everything, shut it all down and maybe THEN, maybe THEN, the Dems and the MSM will take this crap seriously.

The founders must be turning over in their respective graves.

The FBI has declined to investigate any more. The essentially said the IRS was doing it job catching tax dodgers .

These new regulations against voter education etc are utterly outside the jurisdiction of the IRS, and arguably outside the jurisdiction of the federal goverment. Neither has anything to do with tax dodging. Having the FBI give cover to active criminals by having them not even look at the offensive behaviors is a further crime.

OTOH, where in the constitution does it say that a President can't use the federal government to destroy all opposition?

Makes you wonder why this woman is still breathing free air. She needs filtered air - IE - filtered by bars. Canaries tend to sing well behind bars - maybe she will sing.

And Baucus Schumer et al should be forewarned that public statements encouraging such behavior are the same as aiding and abetting elements like Lerner. A little jail time might shut these idiots up.

If she has information that shows that people above her are legally culpable, she should be given some sort of immunity if she can produce enough evidence to bring indictments to those above her. Otherwise, she should enjoy the hospitality of the US for 10 to 20 years.

She should get 10-20 anyway - reduced to 5-10 IF she decides to cooperate. She knew exactly what she was doing - and she knew that what she did was against the law. The emails should be enough to convict her.

Lerner wasn't doing her job when she acted against conservative groups, so there shouldn't be any problem filing a lawsuit against her.

Lerner didn't require instruction to do this because she arrived at the IRS equipped with a totalitarian mindset. Obama has surrounded himself with people who already have his worldview, not unlike Adolf Hitler.

There are explicit instructions and implicit instructions. No one may have said, "Do this." but a meaningful glance and gesture during a conversation might have said enough.

Exactly. This is how the Marxist conspiracy (mostly) works. It does not require dramatic secret meetings complete with magic handshakes and passwords.

All it requires is a shared vision and an understanding of the overall plan, which is public information. Between the Communist & Humanist Manifestos, Alinsky's Rules for Radicals, and other such publications, they have most of what they need to work together without any obvious and provable conspiracy.

Throw in a few leading public voices (New York Times, etc.) to sound the latest battle cry and provide the latest talking points, and they have a very effective command and control system that cannot be identified as such.

It's a great system, the more so because few Americans are aware that such an overall plan exists, let alone that such a well-crafted system is in place for coordinating the efforts of the useful idiots and fellow travelers.

Maybe Baghdad Carney can convince people they lead to Bush.

Yes, that's what Obama should have Carney do, say that Bush must have ordered it, just to make Obama look bad. Bush must have got on the phone, impersonated Obama's voice, and told Lerner what he wanted her to do.

Nixon deserved what he got. Republican or Democrat, they all need to follow the laws. Just because we agree with someone doesn't meant we should look the other way when they break the law. If we do, it's like having no laws, which is where this bunch seems to be taking us.
