FEDS MOVE TO LOOSEN MOVIE DISTRIBUTION RULES, WHICH COULD HURT INDIE THEATERS:

The Justice Department is moving to terminate legal rules that have governed the movie industry since the late 1940s, a step that could shake up how movies are distributed and the terms on which they hit the big screen.

The department’s antitrust division has concluded that the rules, laid out in long-ago legal settlements known as the Paramount consent decrees, have outlived their usefulness in a world where the movie business has changed considerably.

“As the movie industry goes through more changes with technological innovation, with new streaming businesses and new business models, it is our hope that the termination of the Paramount decrees clears the way for consumer-friendly innovation,” Makan Delrahim, the department’s top antitrust official, said at an American Bar Association conference in Washington, D.C. on Monday.

I’m OK with this, provided the Hollywood tax cuts are also repealed.

MICHAEL BARONE: The Democrats’ Impeachment Pseudo-Event.

The Image: A Guide to Pseudo-Events is the title of a 1960s book by historian and Librarian of Congress Daniel Boorstin. Pseudo-events, he wrote, are staged solely to generate news media coverage. Real events, in contrast, involve independent actors and have unpredictable outcomes.

It’s not difficult to say which category the House Democrats’ impeachment hearings belongs in. It’s a classic pseudo-event stage-managed to prod sympathetic media into running predictable stories. Inconvenient questions from Republican members are blocked. Even the name of the original “whistleblower” is concealed, though no law requires that, and the stage managers know who he is.

Yet on the front pages and cable news, this pseudo-event is crowding out two genuine events of potentially world-shaking importance and uncertain outcome.

Indeed. Of course, to be fair, this is with the full and knowing cooperation of the news media.

HOW THE GREAT TRUTH DAWNED:

For all prisoners, the first discovery was of unprecedented evil, evil they could never have imagined and in as pure a form as possible. One way Solzhenitsyn conveys this evil is to compare it with earlier supposed embodiments of it, especially the tsarist regime, which, throughout the Western world, was regarded as the symbol of pure oppression. Solzhenitsyn reflects: From 1876 to 1904, a period when Russian terrorists killed many top officials, including Tsar Alexander II, the regime executed 486 people, or 17 per year. From 1905 to 1908—including the period of the revolution of 1905—executions “rocketed upwards” to 2,200, or 45 per month before coming to an abrupt halt. Although terrorists in those years killed more tsarist officials than that—were more sinning than sinned against—such brutality “astound[ed] Russian imaginations, calling forth tears from Tolstoy and indignation from Korolenko.” Of course, from 1917 to the death of Stalin in 1953, 2,200 was about the number of people killed on an average day.

Why is it, Solzhenitsyn asks, that Macbeth, Iago, and other Shakespearean evildoers stopped short at a dozen corpses, while Lenin and Stalin did in millions? The answer is that Macbeth and Iago “had no ideology.” Ideology makes the killer and torturer an agent of good, “so that he won’t hear reproaches and curses but will receive praise and honors.” Ideology never achieved such power and scale before the twentieth century.

And that socialist ideology would eventually pour out of the Soviet Union, to be aped by Germany’s National Socialism and Mussolini’s socialist-inspired fascism. As Tom Wolfe wrote in his 1996 article, “Sorry, But Your Soul Just Died,” in 1882, Nietzsche declared that “God is Dead.” And as a consequence, “predicted (in Ecce Homo) that the twentieth century would be a century of ‘wars such as have never happened on earth,’ wars catastrophic beyond all imagining. And why? Because human beings would no longer have a god to turn to, to absolve them of their guilt; but they would still be racked by guilt, since guilt is an impulse instilled in children when they are very young, before the age of reason. As a result, people would loathe not only one another but themselves. The blind and reassuring faith they formerly poured into their belief in God, said Nietzsche, they would now pour into a belief in barbaric nationalistic brotherhoods.”

HIGHER EDUCATION BUBBLE UPDATE, “DIVERSITY AND INCLUSION” EDITION: A professor joined the Trump administration and faced systemic bias when she returned, lawsuit says.

Whitney Bailey’s career at Oklahoma State University was going great – until the professor accepted an appointment to the Trump administration.

When she returned to campus after her public service, Bailey says she faced political discrimination from administrators, whom a review committee found had engaged in “systematic failure to follow university policy” regarding Bailey. It resulted in her also losing paid gigs she put on hold for public service.

Bailey filed a First Amendment lawsuit against the taxpayer-funded institution, as well as its provost, dean, department and assistant department heads, News 9 reports. The officials were in charge of her promotion request when Bailey returned.

I’D FAVOR MAKING GOVERNMENT OFFICIALS PERSONALLY LIABLE FOR BAD DECISIONS: California Regulators Shut Down a Distillery for Serving Alcohol.

“While Type 74 license states that distilleries can only serve up to 1.5 oz. of alcohol per person per day, we are allowed to have private events, in which the drink restriction is waived,” Blinking Owl explains. “It is under this section of code which many small distilleries in the state have found a much-needed revenue source by hosting private events or functions. To that end, we segregated private events with wristbands, something we believed the public was accustomed to and well understood the meaning of, and we subsequently operated in a manner we understood to be in complete compliance.”

That seems eminently reasonable. But what seems eminently reasonable to a business often strikes regulators—who are interpreting the same, oftentimes poorly worded regulations that businesses are, but with an eye to punishing scofflaws—as something entirely different. Just how the temporary closure came about demonstrates this fact.

Before making his first undercover visit, according to his account, ABC trade enforcement officer Eric Gray did not speak with anyone at Blinking Owl about being part of a private party. When he arrived at the distillery, he was served one drink and was told Blinking Owl could not serve him another legally. He paid and left.

Before his next visit, Agent Gray called Blinking Owl. He was told this met the requirements for being considered a private party. After arriving at the distillery, Blinking Owl confirmed Gray had called ahead to be placed on a private party guest list and was served a second drink.

It was this second visit that caused Agent Gray to conclude Blinking Owl had violated ABC rules, allegedly “by exceeding the amount of 1.5 ounces of distilled spirits that is permitted to be served per person per day by selling two separate cocktails to Department Agents that contained 1.5 ounce in each drink.”

For this purported transgression, the state chose last week to punish Blinking Owl by forcing the distillery to close for 25 days.

But we can at least make clear that Eric Gray seems like kind of a jerk.

Plus: “These laws largely serve no purpose other than to ensnare small business owners and produce fines for agencies that struggle to justify their own existence.”

After one vote failed, members went into a back room, and when they came out, one of the members who voted ‘no’ was crying. They did a do-over and she changed her vote. Board member Jennifer Mallo lectured to constituents who voiced displeasure, saying it was a ‘privilege’ that they got to witness the meeting, admonishing them not criticize her on social media, and complaining about her salary. Immigrants from China and the former Soviet Union said that what they were witnessing reminded them of the totalitarian regimes where they grew up.”

HONG KONG: A friend who lives there writes:

Just returned from voting for my District Councillor.
(Voting for District Council doesn’t really amount to much – their job is about garbage pickup, etc. – but this is an opportunity for people to have their voices be heard, albeit at a minimal level).

In every other election, I have gone in the afternoon and there are maybe 3 or 4 people in line.
I show up just after 8 am this morning and the line goes out the room – a least 100 deep.
I see a building neighbour, a fellow Foreign Correspondent Club member, a Chinese International School parent / friend, and C H Tung (first Chief Executive).
(I was tempted to go to CH Tung and say, “this voting concept seems to be pretty popular” – but I refrained).

I asked if it is alway this crowded in the morning as I usually vote in the afternoon.
About 5 people all chirped up saying basically, “Oh no, not at all. I think we all know how we feel about the matter”.

And the line was longer when I left than when I arrived.

Maybe I’m wrong, but I suspect that the pro-Government candidates are going to lose quite badly in most parts of Hong Kong today.
People are mad and want their voices heard – not dismissed.

Just my “on the ground” observations.

Good to know.

OUTREACH TO THE OTHER PARTY? TREASON! Democrats furious as video of Buttigieg saying nice things about Tea Party emerges.

Democratic presidential candidate Pete Buttigieg faced some strong criticism online after a 2010 video of him speaking at an Indiana state Tea Party event resurfaced this week, with critics of the South Bend mayor accusing him of “sidling up to racists” and saying he’s “absolutely done.”

In his remarks to the group, which came during his unsuccessful 2010 run for Indiana state treasurer, Buttigieg discussed how he understood the economic concerns of the Tea Party voters and candidates.

“There are some, especially in my party, who think that the Tea Party is a wholly owned subsidiary of the Republican Party,” Buttigieg said at the time. “But there are many others who believe that the Tea Party is motivated by real concerns about the direction of our government and the responsiveness of our government to citizens—and above all, a frustration with business as usual. That is what motivated me to run,” he continued. “And so, while we may come from often very different perspectives, I believe we might have a lot in common on that front.”

Responding to the resurfaced clip, Jodi Jacobson, an editor and analyst, called the clip “unreal.”

“@PeteButtigieg literally sidling up to racist Tea Partiers. And he’s got it wrong: @GOP is a wholly owned subsidiary of the Tea Party,” she tweeted.

The Tea Party movement was not racist in the least, particularly by comparison to today’s Democratic Party. And as for the GOP being a wholly owned subsidiary of the Tea Party — if only!

DISPATCHES FROM THE EDUCATION APOCALYPSE: Watch The Intellectuals.

I’m not interested in hearing Ann Coulter speak, but I am very, very much interested in fighting the mob culture that seeks to shut down speakers like Ann Coulter, in part by howling curses at, and attempting to humiliate, Americans who are interested in what she has to say.

If you think this is going to stay in Berkeley, you’re mistaken. This mob action might not spread to places outside of the coasts, but here’s what’s going to happen: those young people who join the mobs, they are going to graduate and move into the institutions of American life. They are going to carry their militant illiberalism, including their contempt for free speech and open discourse, into those institutions, and are going to do their damnedest to institutionalize them. One thing I have learned from the past few months spent studying Soviet-bloc communism: watch the intellectual class. It is a very big mistake to think that what they say and do only matters in the shadow of the ivory tower.

I DON’T UNDERSTAND WHY THEY’RE PICKING THIS FIGHT WITH TRUMP. BECAUSE THAT’S WHAT THEY’RE DOING. Navy Is Said to Proceed With Disciplinary Plans Against Edward Gallagher.

There is precedent for presidents intervening in military justice matters. John F. Kennedy stopped the punishment of an Army Reserve soldier who was court-martialed for bad-mouthing him. Abraham Lincoln infuriated some of his generals by regularly combing through court-martial orders for Union troops who were charged with desertion and other crimes and scrawling impromptu one-line orders for leniency, like “Let him fight instead of being shot.”

But experts say the constitutional arrangement of civilian control over the military can become strained when a president disregards the counsel of generals and admirals, or never seeks it in the first place.

Well, that’s one way it can become strained. Another is when people inferior to the President set themselves up in judgment over his orders, and publicly challenge them. Lt. Col. Vindman is apparently not alone in this.

The annual Harvard-Yale football game Saturday was briefly delayed due to protesters on the field at the Yale Bowl. The protest, which caused a 48-minute delay, began following the second quarter of the game at the Yale Bowl when more than 150 people stormed the field with signs. The protesters, led by students and alumni of both schools, were demanding the colleges stop funding of fossil fuel companies.

DESPERATE CLEVELAND BROWNS DRAFT JUSSIE SMOLLETT AS DEFENSIVE LINEMAN: Myles Garrett and the Excuses That Fall Flat.

The NFL suspended Garrett indefinitely, adding that the suspension would be, at minimum, for the rest of the year. The league also gave multiple-game suspensions to several other players who participated in the fight.

Thursday, while appealing to the league to lessen his suspension, Garrett claimed Rudolph called him a racial slur just prior to the brawl.

Garrett encountered quite a bit of skepticism over this claim. He never mentioned it at all in any interview over the past week, and his post-game statement declared that he had made “a terrible mistake,” and selfishly “lost his cool,” and apologized to Rudolph.

Meanwhile, not surprisingly: Mason Rudolph isn’t taking Myles Garrett’s racial-slur accusation well.
