Lerner Lawyers Up

March 5th, 2014 - 10:33 am

We knew this was coming:

A House hearing on the IRS targeting scandal rapidly broke down into a heated and deeply personal argument between a top Democrat and Republican, moments after former IRS official Lois Lerner once again invoked her Fifth Amendment right not to testify.

Lerner, who last year refused to answer questions about her role in singling out Tea Party and other conservative groups for extra scrutiny when they applied for tax-exempt status, was called back before the House Oversight and Government Reform Committee on Wednesday. Though Republicans argue she waived her Fifth Amendment right by giving a statement during the last hearing, Lerner continued to invoke that right on Wednesday.

“On the advice of my counsel, I respectfully exercise my Fifth Amendment right and decline to answer that question,” she said in response to several questions.

Give her immunity and let’s see how near the head this fish rots.

Issa's no fool, and this is being carefully orchestrated. A likely scenario is a Contempt of Congress vote, then a trip to a federal judge, where they get a court order for incarceration. These fascist bureaucrats are not harmless, they are attacking the first amendment, in direct violation of their oaths, and need to be punished so that the rest of them know what will happen to them. Issa's out for blood. Good, then he needs to work his way up the chain.

Great, just great. So the "Stupid Party" strikes again by headlining Lucy [Lois Lerner] yanking the football [claiming the 5th AGAIN] away from Charliie Brown [Issa and company] live on TV. Trey Gowdy predicted this what happen without a profer of at least conditional immunity, but hey, why listen to the guy with 16 years as a prosecuter. Idiots, effin idiots.

Gelding The Lilly Of Truth

Lois Lerner’s back to be grilled
Her evasions artful & skilled
We find her Judgement
Piscatorially pungent
And our hopes for the truth unfulfilled

No...I would not give her immunity, at least certainly not yet and not even close to being ready to do that.

I'm not a lawyer, but Lerner KNOWS something big and probably many big things that will lead straight to the upper echelons of the IRS AND the Democrat party. I don't know what the House and Senate (if the GOP picks it up) can do in terms of appointing some sort of investigation similar to a special prosecutor, but I'd wait until they can do something in that realm and force Lerner to talk using legal means.

She knows something and I don't trust her at all. Find another way.

Here is the deal: OBAMA ALREADY GAVE LERNER IMMUNITY, when he stated there was not a smidgen of corruption in this entire IRS targeting scandal. He then hired a major donor to cover up or perform ANY investigation into the matter......Stonewall thy name is LERNER. There is NEVER going to be an arrest or firing of anyone in any Obama scandal, and Lerner knows this. She can testify anyway, because she is protected by the Prez.....her invoking of the 5th amendment AGAIN just goes to show that she is definitely hiding something. Slap her with contempt, no congressional immunity and I want to see her in handcuffs headed to jail...I have a question for the lawyers out there: CAN THE VICTIMS OF THE TARGETING SUE HER AND OTHER IRS INDIVIDUALS IN CIVIL COURT FOR DAMAGES, IN ORDER TO COMPEL DISCOVERY???

Give her immunity only when she identifies what she'll disclose and who she'll give up. She should rot in jail for a while if shedoesn't.

jail her for contempt, give her immunity and she's not going to say a meaningful word. Where's the Republican outrage, Boehner is incompetent but so are the majority of Republicans who've kept the inarticulate goof as leader.

Holding pattern. Even if (and that is a big IF) she will go to jail for a little while, Obama will pardon her on his last day in office (a la Clinton). My reading of the situation is that they (both dems. and reps.) want to bury the story one way or another.

Boehner certainly could have slapped her with a contempt charge back in . . . May, was it? Maybe he meant to but changed his mind after a round of gold with Obama.

Agreed -- we're lucky to have Issa up there because he is no fool, the Dems know that and are VERY worried about it, plus they know that Issa doesn't give up or back down.

Let Issa handle this the way that he sees fit.

Can she be prosecuted for perjury without the Justice Dept.?

If not, time to fold.

Trombonist, what do you mean by "fold?" Just let it all go and let the Dems run over the Tea Party and other conservative organizations with their Hummer, the IRS? I don't think so.

I'm not a lawyer, but I think this is outside the DOJ. She'll be held in contempt of Congress, not contempt of Court; get nailed for perjuring herself before Congress, not Court, etc.

Which brings me to a b!tch about taking the fifth. I just read the text of that amendment. Lois Lerner is supposed to be delivering facts to the American public in her capacity as a public servant, not as a criminal defendant. I bet one could make a case that the fifth doesn't even apply.

"Give her immunity and let’s see how near the head this fish rots."

Give her no such thing. She waived her right to protection of the 5th when she gave her opening statement last time.
If that is the government's position, then have it affirmed by the courts and compel her testimony.

Then if she still wants to play the Sphinx, clap her into the hoosegow until the IRS evolves evolves into a SkyNet-type computer program and we all have chips embedded in us.

If she's a True Believer, then she should WELCOME the opportunity to sacrifice her freedom to her cause.

No, she waived the privilege. IF she won't testify, bring her to court for contempt. If she still refuse to testify, put her in jail.

She should not get off the hook, and cannot be trusted to tell the truth about higher ups.

She looks like she had a facelift. She still looks arrogant, though.
