But what is most disturbing about this court order is that it strongly suggests that Assistant Attorney General Thomas Perez essentially lied in sworn testimony. At a hearing before the U.S. Commission on Civil Rights on May 14, 2010, Perez was asked by Commissioner Peter Kirsanow whether “any political leadership [was] involved in the decision not to pursue this particular case.” Perez’s answer, on page 79 of the transcript of that hearing, is an uncategorical “No.” When the statements of Perez are compared to the documents that Judicial Watch forced DOJ to release in the FOIA lawsuit, it is clear Judge Walton was polite when he said they are contradictory and “cast doubt on the accuracy” of Perez’s account.
A less diplomatic judge might have said that Perez testified falsely in his hearing testimony before the Commission on Civil Rights. In other words, he may have committed perjury if he knew his statements were false when uttered.
The Commission on Civil Rights repeatedly asked Attorney General Holder to appoint a special counsel to investigate the handling of the NPBB case by the Department and the refusal of Perez to comply with lawful documents requests and subpoenas served on DOJ by the Commission. When will the attorney general do so, and when will he ask for an investigation of this possible perjury by Perez?
Where is the investigation by the Justice Department’s Office of Professional Responsibility (OPR) of whether Perez violated his ethical and professional obligations as a DOJ attorney? Will the DOJ inspector general open an investigation of the possible violation by Perez of 18 U.S.C. §1621, which outlaws presenting false statements under oath in official federal proceedings? Or will they all respectively yawn and ignore this?
Imagine if a conservative political appointee at DOJ had just been cited in a federal court decision as having apparently testified falsely under oath. Not only would it be a top headline at The New York Times and The Washington Post, but the IG and OPR would be rushing to investigate. All of which is a sad commentary on the liberal bias not just of the media, but of too many of the offices and officials within the Justice Department who are supposed to administer justice in an objective, non-political, and impartial manner.
So does this mean we should add Perrelli and Hirsch to the list of people we can expect Obama to pardon before leaving office?

I know acts of political revenge are normally reserved to the Left, but if Romney wins the election there needs to be a bloodbath in several departments of government. State, Interior and Treasury (among others) need a root-and-branch purge. And there are many, many at Justice who if the title of their department is to mean anything will serve lengthy prison sentences. It’s rare for any Democrat executive at any level of government to leave holdovers other than some apolitical subject matter experts and in some cases people with their own adequately strong power base. The latter type of employee or appointee sometimes falls in the category of being better inside the tent peeing out than outside the tent peeing in.
Democrats aren’t reticent to reach far down into merit system ranks if somebody at that level has gotten crossthreaded with some Democrat constituency. I spent all but the last three and a half years of my tenure in government in the merit system a level or two below politically appointed management. Functionally and legally I was an apolitical technocrat/supervisor, yet I was very publicly on the Democrats’ hit list in every election. It is flattering if a bit daunting to have a Democrat candidate for Governor stand before an AFL-CIO convention and promise them your head on a platter if elected, and in just those words, or to have a Democrat legislator publicly say that he’s going to see to it that you never work again. I had my new Democrat boss back in ’94 come into our work area and tell us that he’d campaigned for the job with the unions and had promised them as a condition of their support that he’d fire all of us, merit system be damned. He didn’t get to keep that promise but you can only work doing things you hate for people you hate for so long, so all the old hands got our affairs in order and found other work. I went to work for the Republican controlled Legislature with that SOB’s misery as my mission. I definitely wasn’t apolitical after that and when I became the appointed head of the agency under the successor Republican administration some people looked around and realized that their worst nightmare had just come true; I didn’t disappoint them.
The ONLY way a Republican executive at any level of government can successfully govern is to fire EVERYONE that s/he has an arguable legal right to fire and do so as his/her hand is coming off The Bible. They get told by their “friends” that to do so would be too disruptive. The only thing that firing every appointee would disrupt is the contact lists of lobbyists and reporters and you could leave the position vacant for months and the only people who’d notice would be lobbyists and reporters and maybe a few “special friends” that might suddenly find themselves expected to take off their “promotion pads” and actually work.
Governments at all levels are basically designed by Democrats to employ the maximum number of Democrats and serve Democrat clients. The Democrats have nominally competent wannabe directors, commissioners, secretaries, and such nested in government all the way from janitor and clerk on up. A Republican couldn’t fill all the appointive positions in a state or the federal government with loyal, competent Republicans if his/her life depended on it. Consequently, they fill the highly visible positions with friends and supporters and leave the rest of the government in the Democrats’ hands. They they spend a term wondering why they are leaked, thwarted, and sabotaged at every turn. A Republican is much better off with the appointive position left vacant and the duties assumed by the merit system employee just below that level. It isn’t really like the high level merit system employee is going to be that loyal to the new administration; they know every appointee will make them happy at least once, the day they go to the appointee’s going away party. That said, the merit system manager well knows how hard it is to fix a wrecked or gutted agency, so they’ll keep it running smoothly because it is less work than having to fix it. The only places you really need your own appointees are the places where you want significant change. You can actually enact significant change without political managers by giving the merit system managers the necessary information about what change you want made. The necessary information is that the world is changing, they’re going to change it, and the only choice they have is whether to be in that world or not. Almost all of them will make the right decision and when some don’t, you know who to fire.
Of course the media and the talking heads will bleat and wail about the political executions of all those “selfless public servants” and they’ll have mommies dying of cancer because they lost their government health insurance and babies starving on the 6PM news the day you announce the dismissals, but nobody really much likes public employees and if you’re a Republican pretty much nobody who voted for you likes them, so the bleating and wailing won’t hurt you and won’t last longer than any other root canal. You just have to suck it up and not listen to your “friends.”

Don’t we all wish that their children would make a birthday wish that they stop lying for just one day. But then if they all told the truth we would might find more than suspect birth certificates and social security numbers.

The rule of law has become a quaint, outdated notion that no longer applies as far as the Attorney General is concerned.
