Cain wouldn’t necessarily have to be directly involved; depends on how much settlement authority the HR person or attorney was given. He would have to at least be aware of any non-disclosure provisions so that he would be able to perform.

That said, I’ve done thousands of settlements of grievances and complaints and while in most of them I had the authority to settle whether or not the principal wanted the settlement, there were only a couple in over 20 years that I used that authority and just did it without the principal’s involvement and OK.
