I think that one point, perhaps not discussed much in comments, is that every state is different. In Texas, the right of survivorship is not granted to legal marriage, so it can be easier to sort out. Cost me $100 to get a contract written by a lawyer to sort out right of refusal and right of survivorship on a house. I think that many of the fees are perhaps high, but they all point out vast hassles. I think that the biggest issue that seems unfair to me is that every state is different.
