Bullfrog is right. I actually read the CA same-sex marriage decision and the justices’ argument was mainly based on whether denying gays the term “marriage” violated the constitution. It wasn’t about them getting less rights but whether the terms itself denies them “dignity.” I am actually for gay marriage…makes no difference to me. But I am not for judicial activism and the CA court did exactly that.
