Judge Sotomayor has stated on numerous occasions that she does not know if it is possible for a judge to overcome his or her bias nor does she think it important that a judge do so. So much for the concept of the “detached and disinterested judge”. Regardless of Sotomayor’s achievements, I have a real concern that she can be a fair justice. She certainly was not in the Ricci case.
And to Mr. Navarrette, your logic concerning the fault you found in Rehnquist, Alito and Roberts excusing Sotomayor’s bigotry is that of a five year old who still thinks two wrongs make a right. If you think those three should have been questioned for their actions or remarks, then shouldn’t Sotomayor be questioned? At least be consistent or one might think you are a bit biased.
