No mention of empathy as a trait to be sought in any judge (let alone a Supreme Court judge appointed for life) anywhere in the Federalist papers or Article III (the judiciary) or anywhere else in the Constitution.
Why do you think Lady Justice is blindfolded ? Her job isn’t to empathize with one party or the other, but to administer the law impartially and evenhandedly.
In her opinion in the New Haven case, Judge Sotomayer empathized with the black firefighters who were unable to pass the exam.
This is a flagrant miscarriage of justice.
