Being a racist (or at least sounding like one) will not derail Judge Sotomayor’s nomination. Harry Reid has the votes. If she makes a passable appearance in her Senate hearings, she’ll be confirmed with ease. This is another example of a so-called “compelling personal story” plus “empathy” for members of the right constituencies trumping judicial intellect and judgment. Above the west side of the U.S. Supreme Court building is the motto “Equal justice under law.” When Justice Sotomayor is seated, we should replace this with a modified version of Orwell’s famous Animal Farm line: “All … are equal but some … are more equal than others.”
