I think you may have mistaken me for the strawman you are attacking. I’ve been talking about equality of opportunity from the start, which is what equal protection amounts to.

You misunderstand affirmative action – it doesn’t favor any particular groups. Demographics vary from place to place, but affirmative action always protects a minority population from exclusion. Equal protection. Same sex marriage is about consenting adults being refused the right to choose their spouse. Equal protection. If you don’t understand why these are equal protection cases, let me spell it out.

Affirmative action will protect you from being discriminated against because of your skin color, hair color, gender, or any other non-substantive criteria. Same sex marriage has to be permitted if the state sanctions marriage. Otherwise the state is clearly favoring one group over another by providing the rights and privileges of marriage to one set of partners, and not another.

Equality of results is a farcical strawman that you need to put away if you want anyone to take you seriously. A social safety net is not the same thing as equality of results, despite what you might think.
