Out of extremely thin air, the Obama administration is now conjuring the narrative that Congress actually did approve a Libyan no-fly zone before President Barack Obama signed onto the project with the United Nations. Speaking last Sunday on ABC’s This Week, Secretary of State Hillary Clinton mentioned (though she wasn’t quite sure of the date): “The United States Senate called for a no-fly zone in the resolution that it passed, um, I think on March the first.”
ABC News, under the headline “Fact Check: Senate Did Favor No-Fly Zone,” is now reporting:
Some lawmakers are grousing loudly that President Barack Obama sent the nation’s military to Libya without Congress’ blessing. They’re ignoring a key fact: The Senate a month ago voted to support imposing a no-fly zone to protect civilians from attacks by Col. Moammar Gadhafi’s forces.

With no objections, the Senate on March 1 backed a resolution strongly condemning “the gross and systematic violations of human rights in Libya” and urging the U.N. Security Council to take action, “including the possible imposition of a no-fly zone over Libyan territory.”
ABC goes on to quote Defense Secretary Robert Gates’s testimony yesterday before the Senate Armed Services Committee, in which Gates said: “In its own way, the Congress consulted with the president and particularly with this body that unanimously in a resolution called for the imposition of a no-fly zone.”
Lower in the article, ABC then touches on the many and large qualifiers. For an articulate account of what those are, you’ll do better to skip the ABC backing and filling, and go straight to Andy McCarthy’s post on NRO’s Corner: “How the most transparent administration in history gets a transparent congressional debate on the war in Libya.” As Andy notes, this resolution — Senate Resolution 85 — was nonbinding. It has no force of law. Nor is the Senate the same as the full Congress. And, as Andy notes in another post, this nonbinding resolution was “hotlined” through the Senate with no debate and no vote, receiving “the same amount of consideration as a bill to rename a post office.” It neither authorizes nor endorses American use of force.
Among my own sources, a congressional aide says the resolution was passed late in the day, with few members around, and the no-fly zone slipped quietly into the final version.
To this I’ll add my own observation. When this resolution passed, on March 1, the Obama administration to all appearances couldn’t have cared less. Obama did not at that point issue a clarion public call for a no-fly zone, or rush to the Security Council brandishing Resolution 85 and demanding action. Nor did the administration turn to Congress for anything of genuine heft. For almost two more weeks — during which Muammar Gaddafi’s forces were regaining the advantage and slaughtering Libyans — President Obama waited and dithered. On March 11, he held a press conference in which he talked about organizing “conversations” with NATO and consulting with the “international community” on Libya. He made not a single reference to the March 1 Senate resolution. He made precisely three mentions of the Senate. None of these had anything to do with Libya; they were strictly about the U.S. budget.

I am sure that since 1789 there exists a resolution which can be used to justify military action against any country at any time.
Of course the conundrum of the Libya Crisis is that while failure of the Franco/Anglo/American/UN effort may be embarrassing to their respective political leaders, failure, to the Tripoli regime, means total annihilation. This should cause anyone who’s thought Obama to be a masterly politician to take fresh stock of that notion. It’s the clumsiest imaginable deceit hanging from the barest frayed fiber of fact.
All America’s wars prior to the Korean War were declared by the House of Representatives and the Senate in joint conference. Congressional resolutions authorizing the use of military force abroad have since been treated as functionally equivalent to declarations of war. But only in the cases of Korea, in which Truman acted without Congressional sanction, and Grenada, in which case Reagan acted to protect the lives of American students trapped on the island, has the president sent American forces to war outside the United States without first informing Congress that it would do so and securing the requisite approval.
Perhaps Obama wants to argue that, since Truman acted on a UN Security Council resolution without Congressional confirmation, he can do so as well. But that’s logically equivalent to claiming that a lawbreaker who evades punishment for his crime has nullified the law and indemnified anyone else who might break it.
If the War Powers clause of the Constitution is still in force, Obama has violated his oath of office. If it isn’t, I want to see the relevant amendment — now.
We are seeing the real war now. Forget Libya. It’s a third-rate country with a wacko leader. The real war is between the Prince of Fools (B. Hussein Obama) and the US Constitution. Thus far, the Constitution appears to be losing.
At least Truman, in the case of Korea, could say that American forces had been attacked (what few of them still remained at that time on the penensula) – no one has tried to claim, and the world is unaware of, that any American Forces were in Libya, or had been attacked.
Once more it has been shown that if the Left can’t lie about something, they have nothing to add to a discussion.

A little correction: Obama never was even close to the “Rushdie Zone”, since he is patently unable to comment in an intellectually incisive way on the demoniacal cult known as Islam, let alone to tell the truth on any subject. Also his security detail is of a size precluding entry in the zone of deadly fatwas.
A person’s religion is not determined by documents or birth, it is determined by how the person acts. Normally it is also indicated by what he says, but in Obama’s case he lies about everything so that isn’t accurate. Obama’s actions and even some things he says indicate he is as true a Muslim as you’ll run across anywhere.
I disagree: I think that President Obama simply thinks muslims are cool and with cool names just like the Black Panthers did. Yes, Japan definitely had a part in it. There was a flaw in their Constitution that gave the power to the military whenever there was an active war. The Kodo-ha (Japan’s Nazis) took advantage of that flaw. A colonel of a regiment would order his troops across the border and start a war, which would then go without reproof, because the military would then be in charge, and about a third of them were Kodo-ha.
However, when they invaded Indochina after the fall of France, Roosevelt just could not make himself stay out of it, despite promises to the public. In October, he instituted an oil embargo amongst Japan’s suppliers. The oil stays off until you leave Indochina.
Now, he either didn’t know that that would mean a tremendous loss of face to the Japanese (intolerable), or he did know, and he was boxing them in. Which was it? Was it ignorance or malice? Was he a knave or a fool? The result was the same and inevitable. The Japs had only 3 months reserves. They had to strike to take the oil by the end of December, or surrender.
Despite the proven capability of an air attack on Pearl Harbor (demonstrated by us in 1937), Roosevelt took no steps to prepare us, resulting in the “surprise attack” on Pearl Harbor. Again, either he didn’t know (ignorance), or he did know (malice). The result was the same, and it got us into WWII.
I’m not saying that was not a good war to fight. The Fascists needed to be put down like dogs. I am only saying that Roosevelt definitely DID get us into that war. What did we care whether or not the Japs took Indochina from France?
Presidents find ways to force us into war. They have to, because Congress will rarely take a stand. They are poltroons who need political cover always. The wars are rarely justifiable.
And yes, Johnson did get us into Vietnam. Sure we had “advisors” in Vietnam, but it was Johnson’s decision to either pull out or go the whole hog. At that point, we had lost 201 men in Vietnam. He wanted to get re-elected. He did not want to be portrayed as soft on defense and soft on Communism. So, he committed us to a war he KNEW would end badly. KNEW it, mind you. We proceeded to lose 57,292 more men in a losing, pointless, unjust war, so that he could bring us his “Great Society” and Medicare.
Medicare was bought with the blood of our troops. Johnson was scum.
Wilson brought us WWI. Roosevelt brought us WWII. Truman brought us Korea. Kennedy brought us the Bay of Pigs and the start of Vietnam. Johnson gave us full-fledged Vietnam. Nixon continued and finished that war. Carter’s weakness brought us the unpunished seizing of our embassy (an act of war). Reagan gave us only a few tiny actions (Beirut, Grenada, Honduras). Bush 41 gave us war in Kuwait. Clinton gave us Kosovo (We’re still there) and Somalia. Bush ’43 brought us Irag and Afghanistan. Obama brings us Libya and a ramped-up Afghanistan.
The only Presidents we have had in the past hundred years who did not bring us war were Ford, Nixon, Eisenhower, Hoover, Coolidge, and Harding… all Republicans, mind you. Democrats always bring us war. Always.
For the Senate to pass a Resolution that

This same Resolution also urged the ‘African nations to take action to address the human rights crisis in Libya’.
With regard to the use of force by the US – not a word. Instead, it “welcomes the outreach that has begun by the United States Government to Libyan opposition figures”. Period.
Obama and his Gang – are manipulators. Obama has no principles, no integrity; he just likes power.
He’s pulling a page out of Pelosi’s playbook, “deeming it passed” by the Senate, which is almost like passing it, so close enough. I guess they’re afraid of the optics of going to war without congressional sanction, while vacationing in Latin America. It amuses me when I come across articles written by well intended, articulate authors (such as Claudia Rosett) framing an issue (any issue, not just this one about the no-fly zone over Libya and the lack of Congressional authozation to BHO hereto) where actions (or lack thereof) by this fraud in the WH are analyzed.
In fact, I must admit I’m kind of tired reading such otherwise well documented treatises. My reaction always comes down to this: why do we offer this fraud any legitimacy at all? Why do we even bother to document our positions on any subject having to do with him and his (economically and politically) corrupt to the bone administration, when he’s shown the American people such disrespect by not supplying us the necessary documentation to prove to us that he’s a legitimate and trustworthy individual to occupy the Office he’s currently occupying and with whom we could have such discussions?
I’m beyond analyzing this fraud and his (in)actions anymore. Anything he does/says carries no credibility whatsoever at least with me (and from what I can tell from various polls with hundreds of millions of Americans). Everything this president has done demonstrates that he operates under the belief that it’s easier to get forgiveness than it is to get permission. As long as he gets away with it, he’ll continue to do whatever he likes, and provide justifications later. He has all the makings of a Hugo Chavez.

The Democrat Party indulged in typical Democrat law-making (no debate, not knowing the contents of the bill, etc.), and the Congress did approve the no-fly zone, at least that part of the Congress that is important–the half controlled by the Democrat Party. That other part doesn’t count. And since the part that did count approved in its usual fashion, the whole approved, because if the President does it, it is Constitutional and it is legal.
