Video: Meg Whitman Denies Ever Receiving a No-Match Letter on Her Former Nanny (Updated)
The stars have aligned and the national press corps is screaming to push the story that Meg Whitman broke the law by employing an illegal immigrant nanny, then cold-heartedly firing her to get her out of the way of her run for governor of California.
Thus, lawyered up with Gloria Allred in tow, an unknown nanny went viral tabloid style, claiming that she was”exploited, disrespected, humiliated, and emotionally and financially abused,” and “treated like garbage.’’
The story at this point hinges upon a supposed “no-match” letter sent by the Social Security Administration to the Whitman household several years ago. At a news conference today, Whitman offered up a very strong denial:
Whitman: “If there is a letter out there, I don’t know how they got it, it’s not in our house. … We never saw that letter.”
As Ed Driscoll pointed us to the “Obi-Won Kenobi” of campaign predictors, this October surprise has been an expected wild card in the California electoral playbook. Political geeks in the audience will recall that a similar Nannygate flap killed candidate Michael Huffington’s 1996 California Senate run. Yes that Huffington, in case you didn’t know. Likewise, Bush appointees Linda Chavez and Bernie Kerik were both felled by the Nannygate-sword.
To cross the hypothetical bridge to nowhere in Whitman’s Nannygate we are offered inch-thick, mile-wide evidence, anecdotal, tabloid, and otherwise.
Highlights:
1). Show me the papers! Yesterday Meg Whitman offered that she had no idea that her maid was an illegal immigrant and that a valid Social Security card was presented from Santillan’s hiring agency. Attorney Gloria Allred countered this, claiming that the Social Security Administration sent a letter to the Whitman household in 2003 red-flagging Santillan’s Social Security number. This is key to this case. Whitman says she never got it and has put that ball back in Allred’s court. Will Allred produce this letter? Or will she dangle it up high above election heads and then drop it, say, Halloween day? Boo! If Allred produces it, the fickle finger of blame gets pointed right back at her and the nanny: How did they get it? Did the nanny add mail theft to immigration law violations?
2). Hell hath no fury like the ego of a woman desperately seeking the spotlight. Gloria Allred has a colorful history of pulling last minute, ego-stroking stunts like this. Allred attempted to derail Arnold Schwarzenegger’s 2003 recall election by drumming up sexual harassment charges and a lawsuit from a Hollywood stuntwoman named Rhonda Miller. Miller claimed that Schwarzenegger “pulled up her shirt” and “suckled her breasts” on the Terminator 2 set. She also alleged that Schwarzenegger fondled her during the filming of True Lies. Despite the salacious allegations, Rhonda Miller’s suit was later dismissed. For more on this listen to Hugh Hewitt’s interview with Allred yesterday.
3). It’s all in the timing. Santillan was fired from the Whitman household in 2009. How long has her attorney Gloria Allred been in contact with her? And why the October surprise bombshell, one month before the election? The appearance of political timing on Allred’s part, nearly a Democratic operative in her own right, is suspect at best. There is either a substantive issue of law here or a timed political move, one or the other. On queue, the maid’s story reads like pure political chicanery and Gloria Allred’s side in the letter is even worse. It reminds me of “Shadow Party” behavior that Bryan Preston has written about here at PJ Media.

4). If the nanny provided false information on her application for employment at Casa Whitman, then isn’t she actually the one that is guilty of a crime here? Forgive me if I am wrong, but the Whitman campaign released documents specifically showing paperwork that Santillan signed, stating under the penalty of perjury that she was a “lawful permanent resident” of the United States. According to pages 12-14, the documents show an allegedly fraudulent Social Security card along with a California’s driver’s license, an IRS W4 form, and an INS verification form. Is Allred therefore harboring a document-forging criminal? Attorneys in the audience — speak up.
Nannygate is a salient example of just how bizarre politics and the Democratic Party’s stranglehold is upon my once-proud and prosperous state. Moonbeam himself picked up the story and spread it like a Los Angeles brush fire on a 115 degree July afternoon. There is even a Jersey Shore connection to the affair. All aspects of the account, from the second rate gossip rag TMZ breaking it, to ambulance-chaser Gloria Allred‘s accusations, to the tear-soaked “press conference” today, are florid and idiotic and fit for the National Enquirer cover, next to headlines of “Obama’s Mistress” and “Three-headed Baby Found on Mars.”
Yesterday Nannygate hit the wires as Meg Whitman hosted a jobs-related news conference with Cisco System’s CEO John Chambers. The San Francisco Chronicle quotes her as saying to Chambers that “politics is a bloodsport.”
More like a tabloid freak show, in this case.
We’ll see how it all plays out in the state home to the highest unemployment in the nation.
Update (Bryan): Well, Allred has produced what she says is the SSA letter, complete with a hand-written note from Whitman’s husband on it ordering the nanny to check it. Here’s the letter itself, and it’s dated April 22, 2003.

You should not use this letter to take any adverse action against an employee just because his or her Social Security number appears on the list, such as laying off, suspending, firing , or discriminating against the individual. Doing so could, in fact, violate state or federal law and subject you to legal consequences.
So…what are employers supposed to do when they get one of these letters? DHS tried clearing this up and ended up thwarted by the usual suspects, and then the Obama administration came in and dropped the matter entirely, according to Mark Krikorian. Of course they did. Obama is entirely disinterested in having anything to do with border security. Krikorian also notes that one of those who fought the 2002-2003 crackdown on hiring illegals now works for the Obama White House. How nice!
So the Democrats are reduced to using an illegal alien and probable felon, whom Allred is absurdly comparing to Rosa Parks (an insult to Parks, by the way), against a Republican candidate so they can hang onto the governor’s seat in a big blue state, even though the Democrats themselves put advocates for illegal immigration high up in their own administration. Can you spell I-N-S-A-N-E? Then you can spell the one word that best defines our current political predicament.
Update (Bryan): Team Whitman volleys back, saying that the husband thinks it could be his handwriting, but the letter doesn’t really prove what Allred insists it proves. Here’s part of their statement:
“While I honestly do not recall receiving this letter, as it was sent to me seven years ago, I can say it is possible that I would’ve scratched a follow up note on a letter like this, which is a request for information to make certain Nicky received her Social Security benefits and W-2 tax refund for withheld wages. Since we believed her to be legal, I would have had no reason to suspect that she would not have filled it in and done what was needed to secure her benefits.
“It is important to note what this letter actually says: ‘this letter makes no statement about your employee’s immigration status.’
I have to say, I think the Whitmans have the better argument here. The SSA letter specifically states that it says nothing about the nanny’s immigration status. It says they should take no punitive action against her. It’s entirely plausible and likely that Whitman’s husband saw the letter in 2003, scribbled his note to the nanny, and then forgot about it. Absent something more damning, Allred’s gone all in and turned out to be all wet.
But — she’s still harboring a known illegal alien and probable felon, the idiotic “Rosa Parks” bit notwithstanding. So I suppose the difference between Allred and Jerry Brown on the one hand and Whitman on the other, is that both Allred and Brown know they have an illegal alien presently working for them.

From what I’ve seen, the letter wasn’t addressed to the nanny but to her employers, so how did Ms Allwet get her grimy little paws on it? Did some Governor Moonbeam operative pull a Watergate (Nannygate?)on the Whitmans, or did ninnynanny go diving into their filecabinets before she departed for her 15 min of fame? On the John & Ken show, KFI AM 640 received e-mails on this subject. Many of them were from folks who said that they didn’t know who to vote for, Whitman or Brown. Now that Allred has pulled another one of her political stunts they’re voting for Meg. They hate Gloria that much.

Any honest lawyers out there (yes, I know, I know)? Wasn’t there recently an employer who got into trouble for racial discrimination in employment for looking behind the documents provided by Spanish speaking applicants? After all, a valid in-state drivers license and a legit social security card are about as good as any of us could do. But, if the documents, including the social security account, were “good” because they belonged to her legit sister, why would the feds have issued a “bad number” letter? The SSA number would have been valid and there would have been no question about it’s validity. So, the maid was lying then and is lying now.

Even assuming that Harsh is the one who wrote the note on the letter and gave it to Santillan… that in no way proves that Harsh (much less Whitman) knew that Santillan was in the country illegally.
In the original press conference, didn’t Santillan admit that she “confessed” to Whitman in 2009? If she really believed that Whitman knew of her status for years, what’s the need to confess?

So, I get a letter that tells me: (1) the SSAN doesn’t match your employee’s name; (2) try to find additional information about this person’s ID and send it to us so we can get the SS tax etc right; (3) this letter isn’t a determination of immigration status and it’s illegal for you to use it that way. And it was in 2003? 2007?
Just to emphasize what ICE said:
The SSA letter itself specifically state that using it to take employment actions is illegal. I repeat, if Whitman had used the SSA letter to fire the housekeeper she would have been in legal trouble. If she starts investigating the Maid’s employment status she can also get into trouble for ‘racial profiling’ as an employer and discrimination. She did the only thing she could do, inform the affected employee and tell them to sort it out.
Note, the SSA letter is an accounting issue. It’s basically saying, Hey you withheld money from someone and we can’t figure out what SSN to allocate it to. Please help us sort out the accounting.
If Whitman was trying to benefit from hiring an illegal- i.e. get cheaper labor, she sure wouldn’t have been reporting the employment, paying top dollar, and fulfilled her legal obligations to withhold SSN and taxes.

Whitman was presented what appeared to be valid employment papers when she hired the maid, from the employment agency she used. Whitman was the victim of fraud, perpetrated by the maid. The maid also committed a crime in that she used fake documents.
The letter clearly states that taking any punitive action against the employee can be punished by law. It also states that the letter does not indicate the employee is illegal. Put yourself in the husband’s place. You receive a letter from SSA stating the SS# used by a well-liked (and well-paid, btw–she made $23/hr), trusted employee may be false. What do you do? Fire the employee and get hit with a wrongful termination suit? Or ask the employee to fix the problem, assuming that she is legal and just made an error in some paperwork? Seriously, think about this…
So on what grounds are you demanding that Whitman be imprisoned for? Failing to fire the maid when her husband received the letter, that there is no evidence Whitman ever even saw? Failing to assume that since the maid was Hispanic, she was illegal? What? Whitman obeyed the law; when the maid admitted she was illegal, Whitman fired her. Until that point, she was operating under the assumption that, since the maid had presented the proper documentation, she was legal.
Do you have any idea how many illegal aliens there are in California, and how hard it is to identify them, especially given that some municipalities have sanctuary policies that prevent anyone from even asking? So are you saying everyone should profile, and risk being hit with civil rights charges? Possibly preventing legal Hispanics from obtaining work, because people are afraid to hire someone who has what appear to be proper documents but might be illegal? Do you think every household employer should be required to run a background check on all employees because they *might* be illegal? Be realistic here.
Bottom line, if our borders were secure and immigration laws enforced, there would be a lot less of this. And this is nothing but a cheap, poorly-planned, badly executed, political gotcha stunt. Allred has exposed her client to criminal charges and deportation, richly deserved. And Allred is now knowingly harboring an illegal alien.
She did everything the law allows to knowingly hire a LEGAL and DOCUMENTED worker. Is every employer now required to become an expert at detecting brilliantly forged papers or ID better trained than the CA state gov? What BS. If you ask for their papers, you’re guilty of discrimination or racial profiling. If you don’t, your creepy political opponents dig through your garbage and throw it at you 10 years later. Nice precident that will have a lot of potential employers thinking twice. Why isn’t this illegal deported, she entered the country illegal, apparently stole an identity by falsifying a SSN and now she has the audacity to cry about being underpaid and overworked. Here’s an idea, if you were so overworked and underpaid, why didn’t you return to your home in Mexico. Guess it wasn’t that bad, she stuck around in Cali. Social Security and the IRS do not care about identity theft. My daughter is 20, mentally handicapped, and her SS# is being used by an illegal working construction in Texas. Neither agency can or will do anything about it.
My sympathy for you and your daughter. Not only does the gov not care if illegals are using your daughter’s SSN, they like. Why? Because the Social Security money collected under that SSN DOES NOT go to your daughter’s account, but into the general fund. It is a giant scam and both the Mexico and USA goves are in on it.

Today’s San Jose Mercury-News (aka, the Murky), has a BIG full color photo of the brown-skinned Latina illegal alien crying and being comforted by Allred.
The EMOTIONAL message is that this poor Mexican is being beaten and reduced to tears by one of the richest WHITE ladies in the state who just happens to want the top job in the state government.
The audience for this stunt is not THINKING people but emotional people who can not reason well.
I will note that just about every campaign photo of Whitman shows her surrounded by women. Carly won the GOP primary with the argument that it takes a woman to take on Boxer. The battle is for the woman voter this election and this will have an impact.
Meg can prove she’s a good leader by following Rahm Emanuel’s advice: never waste a good crisis. For those of us old enough to remember, I’m thinking DYNASTY. Very nicely put. I was not even paying attention to the campaign or registered to vote until the she(nanny)gains. This woman will be voting for Whitman as a protest of rich white male liberal politics as usual. Allred has also just guaranteed I will NEVER hire Hispanic house help. Ever. (I joined FlyLady instead.) Why? Because if I don’t have time to do all the housekeeping myself, I most definitely don’t have time to become a certified specialist in forged document or administer lie detector tests to potential maids, gardeners, et al. Allred and Brown just threw Nicky and the Hispanic workforce (“documented” or not) under the bus.
In my opinion, you can take Whitman and Brown and flush them down the same toilet. To say it clearly, I dislike both. Whitman lied to the Republicans of this State in order to beat Steve Poizner in the run off election, which was fought on the basis of who would be harder on illegal immigration. After winning the Republican candidacy, Whitman recanted her anti-illegals stance.
The only person I could dislike more than Whitman is Gloria Allred. I remember her fighting to get female news commentators into men’s locker rooms. I didn’t see her try to get men into women’s locker rooms. To this day, I don’t understand how anyone could violate such basic rules as right to privacy especially in a designated locker room. I’ve seen her on the wrong side of every headline grabbing law suit since then. Say the name Gloria Allred to most attorneys and they roll their eyes.
I hate it, but Meg Whitman finally got my vote!

I hope the maid is deported back to where she will make less than a dollar an hour. She was earning more than $20 while working for Meg. That’s almost as much as I earned when I was teaching….and a lot more than I earned for many years.
I was 40 years old before i finally got above $20 an hour. I think I’ll apply for a job as Meg’s Nanny. I can sure as hell do the things listed on the work sheet. And no one in their right mind, or even their left one, would mistake me for an illegal alien latina… LOL

Oh come on. You know Boxer’s people insisted that each of those Hispanics prove they’re here legally and then paid their payroll taxes, as required by law. At a cost of “I’ll take anything,” the taxes should be pretty low. I think we can assume the sign-holders were paid at least minimum wage, probably more than $23/hour, because Boxer, unlike Whitman, would never abuse Hispanics monetarily.

I think the fact that the husband asked the maid to follow up on this proves they didn’t know she was illegal. He thought there was maybe an error, as the letter states it probably is, and asked her to check it. She probably lied, told him it was an error, and provided the new number. And it doesn’t prove Meg knew anything about it.
Allred sounded like a complete and total idiot in that Levin interview.
And it is so hysterical that Dems are trying to smear Meg Whitman for *employing* an *undocumented worker*. They don’t want to kick out illegals, don’t want to call them illegals, but don’t want them to find employment?
In 2005, my company hired several Hispanic workers, only one could speak English well. In asking for their documentation as required, we photocopied it, reported it to the state and put them in our employ. All of them wanted me to not take taxes out which I did not comply with.
Some time after giving them W=2′s, I got the same kind of letter about all of them but one as Meg Whitman supposedly got. I also saw a news story that year that there were over 9 Million W-2′s that year that did not match up! There was no way to verify their legality with the government, no way at all. I let them go but knew then that employers would eventually be in a Cache 22 with employees lying to you with forged documents and a government that gave you no way to verify.
With Allred in this, it has to be a scam. The minute I heard she was involved, I dismissed the entire episode.
None of this changes the situation in California at all. You have one sentient human and one something else running for Governor.
So who are you voting for, a person you don’t really like, or the second showing of Governor Moonbeam?
If Gloria Allred has a letter to the Whitman’s from the Social Security Administration, she has it illegally and is committing a federal crime. That, and all letters re: SSA matters re: individual employers and employees, are confidential. Any SSA employee providing this letter to her is committing a federal crime as well, under confidentiality rules and should be prosecuted. If an Obama official from the SSA provided Allred the letter, similarly, that person belongs in jail. In the end, a lot of people trying to hang Whitman should be in jail, including the illegal alien who knowingly violated our immigration laws and lied about it for years. Unless Allred got the letter through a FOIA request, and I doubt whether she filed one, or even filed a lawsuit at all, she has no right to possess that letter to Whitman. Whitman shines as a great person rising above all the bleak vermin gnawing at her heels.
The letter was obviously given to Allred by the poor, tortured Latina nanny, since it had a note on it that was probably written by Meg Whitman’s husband. Lucky for Allred that the nanny kept the letter for, what, 7 years? (Longer, even, than Monica kept the blue dress.) I suppose the nanny was still investigating SS’s error when she realized she was here illegally, confessed, and was dismissed. I haven’t read whether she was given a nice severance package; maybe not, since she’s willing to attack her former employer.
You have to wonder about Meg’s wisdom in putting such a stoopid person in charge of her children. That’s the tactic Moonbeam should adopt at this point.
So as I see it, liberal scummers are attacking a republican for employing this woman. The same liberal scummers who will not defend our borders, who call people racist who do want the borders protected and who want welfare & medical benefits for illegals. They add new meaning to the word “filth”.
I don’t see the problem. The SSA raised a question. Whitman’s husband gave the letter to the maid asking her to check on the discrepancy. What’s wrong with that?
One needn’t have a law degree to read through this smoke and mirror show. Allred has been caught red-handed on this, the letter she has from her client states that the employer cannot use the letter to take adverse action. The more documentation that surfaces the more dishonest Allred and her client appear. It is a new place in time Allred, we no longer take at face value what comes via the Lame Street Media.
The reason he wouldn’t have remembered the letter is because he got it, read it, and gave it to the maid to clear up the matter, hence the note. Pretty standard if you ask me. I have had bosses do the same thing: “There’s a problem, it involves your paperwork, I am busy so fix it.” That would be how she has the original or a copy of the letter. Allred fired her shot and the round never left the barrel.
I expect that when the SSA letter arrived, the “Nanny” intercepted it, and never let it get to Meg Whitman. So now we have to add mail theft to document fraud, illegal entry, perjury, etc. etc.
Allred’s despicable stunt will harm illegals, and will probably help Whitman in the long run:
One: People inclined to hire a maid won’t. many with maids will ease them out and get someone legal. Unemployment in the community of illegals working as maids and nannys will rise: but what is human misery when compared to the chance for some publicity and another chance to trowel on some make up, right Gloria?
Two: the Rules of Professional Conduct prohibit as I recall, things that place your client at risk of criminal prosecution: so far the list is being illegally in the US, submitting forged federal social security documents and maybe not paying taxes. Absent one hell of a informed waiver or consent, Allred appears to have violated the Rules of Professional Conduct. hello? State Bar? Hello?
Three: Voters especially Democrats who are good hearted and decent will wonder: is it really right that someone here illegally, paid 23/hr, who lied to her employer, ought to be able to sue the employer? Like s Whitman’s fault? Like Whitman should ahve fired her on receipt of a letter she probably never saw and whihc warns the recipeint that it is not a basis for determinig citizenship? Is this the country I want? And who is more likely to fix this problem? The answer is “any republican candidate.”
Finally, I predict a huge backlash that will favor Whitman: voters will be furious at being “played” like this for an illegal paid 23/hr; Latinos will resent Allred, see that Whitman paid generously and treated the woman well until she had to let her go by law. Whitman didn’t “turn her in” to ICE and that was a decent decision.
Allred: you lose!
Four: an awful lot of Democrats will wonder how an illegal paid 23/hr after lying to her agency and employer can sue the employer and whihc party is more likely to rectify this obvious imbalance in common sense:

Alred needs to be introduced to the other side of quid pro quo and watch her “nanny” face a qui tam action paid and initiated by none other than Meg Whitman.
Where did Alred get the SSA letter? Information not provided outside that maybe the husband scribbled some notes on it and passed it on to the nanny to handle. The letter still belongs to the Whitman’s and should not be in anyone’s possession other than a copy retained by the SSA. Now the letter it is the hands of Alred, as an attorney she should have made an effort to return it to the addressee.
I smell a real sweet future story for legal action not distracting from Whitman’s run for the Governor’s office in California. Obviously Whitman has proved she can multitask, something our president claims to be able to do but hasn’t delivered.
Another thing about the California Driver’s License. If it’s real and not faked, the nanny committed perjury and fraud in obtaining it.
Additionally, she could have registered to vote under the moter-voter law at the same time. Not saying she did, just something to think about…

I’m with you. I wasn’t even registered before this, but will now be voting for Whitman, the lesser of two evils. (Face it, a 3rd party vote is a vote for Brown.) I can’t believe they were willing to dry up the market for Hispanic labor while throwing someone with the IQ of a tortilla chip under their bus. Poor thing. I don’t know what specifically Whitman et al were supposed to do but I would point out this.
As I understand it, Whitman asked an employment agency to find her a nanny who could legally work in the US. Someone was referred and filled out whatever documentation that Whitman wanted and presented (presumably) adequate documentation of the ability to legally work in the US. The hired person apparently performed the duties satisfactorily which included driving the Whitman children to school (Whitman required a driver’s license).
NOW, the SSA sends a letter that there’s a problem and Whitman (actually her husband it seems) looks at it, probably thinks that this is some typical screwup by the government and, because the employment agency was supposed to send a legal worker and the documentation she had presented seemed adequate, scrawls on the letter, “please handle”, then forgets about it. After all, the nanny is supposed to be legal, right? Give her the benefit of the doubt.
Certainly seems (to me) like a reasonable course of action of a busy man, who has more important things to do than harrass a presumably legal, effective and trustworthy employee.
Reading this story just breaks my heart. I know at least 8 people (both women and men) who would love nothing more than a job that pays half that wage. I and most of the people I work with haven’t received a wage increase for three years now and I have to listen to how Meg Whitman discriminated against this poor, poor, ILLEGAL immigrant with a $23.00/hr job?!?

I would only hire house help of the kind Meg did if I was overwhelmed. I just learned via Allred that I would only be subjecting myself to more work and additional duties. Who wants to take on MORE work while paying for the privilege, not to mention extra liability. Or the pain and betrayal of trusting someone who might come back to bite you in the butt a decade later. Or become a pawn of your enemies. It’s just not worth it.
I was considering hiring (possibly illegal ‘coz who really knows anymore?) house help to clean out the closets and help with the filing, cooking and an occasional ride to the doctor, dentist or vet. Instead, I’m bartering or trading help with friends. That means, like it or not, the unholy trinity of Allred, Brown and their pawn Diaz just cost someone paying work in a crap economy. Way to go!!
As for Diaz, deport her law breaking, ungrateful, whiny ass back to Mexico.
