The Justice Department Fix Is In
The New Black Panther fix is in. I have learned through sources inside and outside the Department of Justice that the long-awaited internal report on the New Black Panther voter intimidation dismissal is done, and sensible Americans aren’t going to be happy. In essence, it will adopt the outrageous position of Attorney General Eric Holder when he testified to Congressman Frank Wolf’s Appropriations subcommittee a few weeks ago: all this fuss about the New Black Panther dismissal does a disservice to his people, or to quote the attorney general at the hearing, “my people.”
I am told that the report is now being transmitted to the deputy attorney general.
The whitewash is authored by the DOJ Office of Professional Responsibility (OPR). While it sounds like an impartial shop, it isn’t. In January 2009, Attorney General Michael Mukasey blasted the draft OPR report about the John Yoo and James Bybee terror interrogation investigation as a “hatchet job.” OPR tried to ram through their sloppy work in the final days of the Bush administration and General Mukasey would have none of it. The repudiation was consistent with OPR’s sordid history of omitting relevant investigative facts and inventing legal standards that don’t exist.
Congressmen Frank Wolf and Lamar Smith have been demanding documents and explanations about the New Black Panther case for almost two years. In response, DOJ opened the OPR investigation. But OPR is now headed by Robin Ashton. Ashton, according to multiple sources who have worked alongside her, is a militant leftist partisan. She actually left DOJ to do a detail on the Senate Judiciary Committee for Senator Patrick Leahy. Hans von Spakovsky wrote this piece in which he describes Ashton’s bizarre behavior, such as searching through co-workers’ desks.
Holder appointed Ashton on Christmas Eve. Just a few days later, he essentially telegraphed what her findings should be in the Panther investigation during an interview with the New York Times. While the investigation was still ongoing, he instructed “there is no there, there.” Principled people call that “stacking the deck.”
Ashton is in a position to listen and comply — she answers directly to Eric Holder. His other statement to the New York Times – that the case was a “made-up controversy” — would have never been made by his predecessor, Attorney General Mukasey. Mukasey is a man of profound integrity and impartiality.
What does the OPR report conclude? Indications are that it will conclude that nobody did anything improper in dismissing the case. But it apparently goes even further and concludes that the case was brought because of racial bias, or at least with an insensitivity to Mr. Holder’s “people.” In doing so, signs are that the authors of the report are perfectly willing to adopt some of the favorite lines of the extreme left-wing blogosphere about people who worked on the case and the principle of equally enforcing the law.
Americans know a whitewash when they see it, especially a racially unfair one.
I have been silent until now about the OPR investigation because I assumed the people conducting the investigation were not as corrupt as the people responsible for ordering the case to be dismissed.
But the OPR investigation had many shortcomings. For starters, don’t expect the over 120 pages of analysis and discussion provided by the four trial team lawyers to be part of any leaked report by DOJ. Congress should seek and obtain those documents prepared by the four trial team attorneys, along with the hundreds of pages of exhibits they provided. They should be sized up against any work product produced by supporters of the dismissal, if such work even exists. Other shortcomings in the investigation are obvious and scrutiny from Congress and the public should follow, or else the report cannot be taken seriously.
Technically, reports produced by OPR are never released to the public. If the report is leaked, it will be a sure sign the fix is in. Here’s another test, if the report is leaked: Note how closely it echoes the spin and articles from some of the biggest defenders of the New Black Panther dismissal. Either OPR was taking cues from the left-wing blogosphere, or the left-wing blogosphere was getting inside information on the fix. There are only two options.
If indeed the report is leaked, it may eventually prove to be a good thing. For starters, America will at last have that conversation about race the attorney general has been pining for. After watching the outlandish behavior of his Justice Department (led by Loretta King no less) requiring Dayton, Ohio, to hire black police officers who fail exams, I suspect it is going to be a debate he will lose. This is a nation that treasures fair play.
If the report is leaked, I expect we’ll learn a whole lot more about the New Black Panther Party. Nearly all Americans are rightfully repulsed by the hateful and murderous rhetoric of the group.
If a leaked report ultimately concludes it was perfectly fine to let the New Black Panthers free, and scorches people, the worst fears about this Justice Department will prove true. Add another chapter to the building chronicle of administration lawlessness that already includes ignoring the Freedom of Information Act, annihilating Chrysler securities, and conniving to sustain an unconstitutional health care policy. Americans believe in the rule of law.
Americans are good and decent people who don’t expect armed thugs at the polls when they go to vote. We do expect our government to do something about it after thugs appear. When Americans conclude their government has sided with thugs, and against the people who tried to stop them, there will be a steep price to pay.

Elections have been substitutes for battles since the time of the ancient Greeks, when two phalanxes of hoplites stood around sweating in the sun and sizing each other up.
I think too many people have either completely forgotten or have never been taught that fundamentally an election is a means of finding out which side has the bigger army.
I’m afraid that they may have to relearn this lesson the hard way.
Thing is, the bigger army doesn’t always win a war. It has been a long time since manpower and firepower were one and the same, and superior manpower is no substitute for strategy and tactics.

The question people like Holder and his ilk have to ask themselves is if they think that what comes after will be more advantageous to them than what exists now?

I don’t see the leftists as having superior strategy and tactics. The left might have more money, but money doesn’t always buy what is needed to win. The leftist thugs lost in Wisconsin just a few days ago.
We’ve had enough. If the left thinks they can use physical force to take away our rights, and the leftist government won’t do anything about it (because they think it serves their short-term self-interest), we can, and will, pay them back in the same coin.

Or rather, any thugs of whatever color skin or background. It doesn’t matter what race they claim, any thuggery is wrong and should be stopped by any means necessary. Maybe it’s blacks this time but it was whites before and who knows what it will be next? It all has to stop. Honesty and Honor must prevail. Certainly there is no honor in the current administration. Judging by the voting patterns of the American public, fat chance of that ever happening. Our politicians are a reflection of us. Until we as a people change, the nature of our politics & politicians (corrupt, dishonest) certainly will not change.

I was reading these posts in order and posted my thought on the earlier piece by Hans A. von Spakovsky.
The answer is commencement of an impeachment process by Congress originating in the house. Not only does it expose the corruption of Holder and his baggage giving access to much information but also puts on record many of the Congressmen running for reelection.
For Obama’s remaining tenure it will also make the political flunkies think twice before violating the law.
I could only pray this process begins and fast. But I’m sure his regime has thought of this and will blantantly ignore it as they do any and everything concerning the U.S. Constitution.

So…are you saying that after an exhaustive investigation of itself, the DoJ will authoritatively conclude that it is entirely blameless, and that the NBPP’s actions at the Philadelphia polling place were simply an exercise of their First Amendment rights?

I was astonished (all over again) to watch Eric Holder justify, in an indignant tone of voice, his department’s decisions in the NBP party voter intimidation case under the rationale of America’s history of slavery.
Fundamentally, Holder alluded to righting the wrongs of 18th and 19th century America in deciding to drop the case against NBP party thugs in November 2008.
Eric Holder should be impeached, if not for outright perversion of American law then, at the very least, for abject stupidity.
He & his minions at the Department of Justice are making the notion of “rule of law” even a bigger joke than Bill Clinton did during Monicagate.
Where is our Congress on this matter and why has not someone stepped forward to start immediate impeachment hearings. Not that would do any good, being as corrupt as government is now.

I have said for quite awhile that Obama won’t run in 2012 because he’s doing everything to alienate the majority of America; trying to destroy this nation and all the ideals and values it stands for.
Obama even chooses a la carte which laws he chooses to follow. Well, neighbors, I suggest you do the same. The implications of doing this I realize are far reaching. But necessary. When the President breaks his oath to defend the Constitution, it becomes the role of the people to oust the miscreant. Using every means necessary, and politically intelligent.
The way things are going, he’ll declare marshal law before the election and then the s__t will really hit the fan. The economy is NOT on an upswing, the dollar, although recently rising in value a smidgeon, is on a downward trend. We, or should I say THE FED, just prints more and more money and since the price of cotton is also on the upswing, soon it will be economically unrealistic to print one dollar bills and we’ll just all use 2 dollar bills. Energy prices are rising precipitously even though Congress declined on the Cap & Tax bill since the big O has put the Dept. of Energy and the Environmental Protection Agency in charge making it soon to be illegal to exhale too much. I know, I know, taking things a bit far in my rambling but just wait until the Surgeon General doesn’t just warn of us hazards in our food and medical areas BUT TELLS us what we have to eat since if we don’t eat right it will cost too much to treat our illnesses with Obamacare. Also, any dangerous activities that MAY cause injury, from mountain climbing, sky diving or even riding a bicycle on crowded city streets will be either outlawed or taxed. Oh, never mind, I forgot, we will ALL be riding bicycles or walking because the price of oil will make gasoline so prohibitively expensive. After all, the big O himself said that energy prices will necessarily skyrocket. Not to worry, wind and solar energy farms the size of Nevada will take care of all our needs, and will help China, since they’ll be building all the solar panels and windmills. Good luck all.

America (like most judeo-based western countries) is far bigger and far stronger than one single despot. Vast damage will be done (there’s a lot of ruin in a country they say), but if the people will it, things will get better.
Someone above compared him with Mugabe. It’s probably true that if he was in Mugabe’s position he’d be acting in the same manner (Mugabe was also an academic, affirmative action western educated socialist, lifted up by the global left). But therein one sees the difference. America as an institution and her tradtions makes it nearly impossible for one man to take control like Mugabe did in Rhodesia.

It’s martial in reference to that nature of “law,” not “marshal.” Martial law.
Take a cell phone with camera capability when you go vote. Do not hesitate to call the police (not the voting officials) and take a picture for proof. Whether it is Black Panther or SEIU doing the intimidation, do it.
One more thing: I took a constitutional law class. We covered the case where burning the flag was okayed by the Supreme Court as “free speech”. The reason it was allowed is because burning the flag was not deemed “fighting words” which would have been considered inciting a riot and illegal. Why was it not deemed “fighting words” because no one tried to stop the man burning the flag in the case, there were no riots caused by his actions.
Traditional Americans are law abiding people who don’t want a fight (verbal or otherwise) and who don’t want to cause a scene in a public place. But you must. If you are a type A personality walk up to the bully and tell them to get out of the doorway. If you are a type B cry and call the police and tell them these people made you afraid to vote. But whatever, you do don’t walk away from the situation until it is resolved. Cause a scene or loose your country. (notice I didn’t say hit anyone) Making a scene or looking foolish crying in the corner is little enough to pay for your country.
Call the police, and then call a sympathetic reporter. Film at 11.
“Americans are good and descent people –” I note that you left out smart, wise, and informed. Obama , Holder, and friends rely on these missing traits. It worked for them in 2008 and will likely work again in 2012. Too bad.

One problem with Holder’s viewpoint is that it was corrupted laws and law enforcement that allowed lynchings and other forms of intimidation to take place in the Old South. In terms of condoning and enabling criminality, then, AG Holder’s actions are comparable to those of Bull Connor even if the specific acts of the New Black Panthers weren’t deadly in this instance.
Chicago will be prime intimidation territory come 2012. The new mayor owes it to “the one”.

I’d suggest police presence at polling places that are likely to be problematic… but the niggling doubt of liberal union police rises in my mind.
Wonder if individual Tea Party groups could have teams at polling places, with cameras, etc. If it’s legal for the NBP to do it, why not anybody? Oh, wait, it’s different if they’re not a minority…

As I understand it, all the complaints regarding this case originated from places outside the district where this took place. That should be enough to warrant a dismissal of this case. That pretty much undermines the whole premise of this article, which was pretty weak to begin with, as it consisted of “this happened, and these people deny it happened for what I think are these reasons.”
What you should have done is “this happened, and here’s my evidence” then you can move onto “and these people deny it happened for these reasons”. Btw, your “reasons” are pretty flawed too, considering that they not only rely on unproven knowledge of the person’s thinking process, they depend on a version of the events that is in dispute.

Not entirely true. I believe that a man that helped blacks to vote at polls back in the 60′s just happened to be there to vote, and I may be wrong, but I believe he said that it was the worst case of intimidation he had seen. This coming from someone like that, I would think would have some substance.
There has only been about 800 articles describing the facts of this case. Wrong. The complaints came from victims at the polling site. Nice try though.

Holder and Obama are institutionalizing racist policies in the DOJ.
They are promoting unconstitutional law and black supremacist ideology by legalizing black racism and making civil rights laws an exclusive body of law “for blacks only,” which is inherently unequal and unconstitutional.
Coincidentally, this also happens to be the same racist, supremacist ideology of Louis Farrakhan’s Nation of Islam and Sharia Law. All members of the NBPP are members of the Nation of Islam. The DC Sniper was also a former body guard of Louis Farrakahn, and an Islamist, whose goal was to kill 6 white people per day.
Obama and Holder are racist traitors to the US constitutional they took an oath to uphold.
At the heart of the matter is trust in the democratic process of elections. When people lose that trust, when the government condones intimidation and fraud in the electoral process, the people will take matters into their own hands. I am saddened to hear the comments about sniper rifles and armies, but this is symptomatic of what happens when corrupt politicians substitute cronyism and favoritism for justice. This is the United States of America, not some banana republic. It is past time for Eric Holder to go, and for someone, anyone, to restore the rule of law in this country. Anything less is unacceptable.
One thing I do know: the next sane person to occupy the oval office needs to clean out the Department of Justice and the State department down to the receptionist at the door. This was one of Bush’s biggest mistakes. Clinton, right before he left office, turned hundreds of presidential appointment job slots into career jobs at State and Justice by executive order. Bush should have reversed that day one. Clinton sure did. Day one of his administration he cleaned out the Attorney’s Generals, the Secret Service and even the travel office down to the telephone receptionist.
This so called Justice Department is nothing but an arm of The Black Liberation/Black Panther Party. Anyone that is white must keep themselves armed and ready to protect their own in America. We can no longer trust our Government.
Obama knows that without a miracle he will lose the election in 2012 because he has lost the mushy middle of the electorate. All they can do in preparation is encourage their base (union members, blacks, fetus harvesters,…) to vote in order to save as many democrat politicians as possible from themselves getting harvested.
If they had been white racist thugs, the Justice Department would have moved against them. Because they were black, they were let go. This asymmetric treatment clearly marks the Obama Justice Department as racist. Only some Blacks and most of the Progressive Elitists will not see this. Or do they, but their like their racism?
