Proof: New Records Show DOJ Lied About New Black Panther Dismissal
Judicial Watch made an explosive announcement today about the Justice Department’s stonewalling in the New Black Panther voter intimidation case dismissal. Forced to bring a Freedom of Information Act (FOIA) lawsuit after DOJ rebuffed its public records request (so much for transparency), Judicial Watch obtained a privilege log from the DOJ last week.
It shows — in a rather dramatic way — that the DOJ has been untruthful about who was involved in the dismissal of the case.
In July, I complied with a subpoena and provided testimony to the United States Commission on Civil Rights. I did so in part because inaccurate statements had been made about the case by DOJ officials. Some of these statements falsely claimed that ethical rules mandated the dismissal of the charges against the New Black Panthers. This was nonsense.
But the real whopper? DOJ’s claim — repeated over and over again — that career civil servants were wholly responsible for the spiking of the case.
Today we learn, from the Department’s own records, that this claim is demonstrably false.
The privilege log produced in the FOIA litigation contains stunning entries. They show regular discussions and deliberations between the highest political officials inside the DOJ, including the deputy attorney general and the associate attorney general, about what to do with the case. This contradicts numerous statements made to Congress, the Civil Rights Commission, and to the public.
Some of these statements were under oath.
For example: on May 10, 2009, the third highest-ranking official inside the DOJ — Associate Attorney General Tom Perrelli — emailed Sam Hirsch, one of his deputies:
Where are we on the Black Panther case?
The description of the email contains a bombshell:
asking for update on the NBPP litigation between officials in the [Associate’s office] and noting the [deputy attorney general’s] current thoughts on the case.
The deputy attorney general is the second highest-ranking official in the Department. The use of the term “current thoughts” implies that there were prior thoughts and ongoing discussions with the second highest-ranking political official at DOJ about how to handle the case.
Further, the logs show dozens of communications between senior DOJ political officials in the two weeks prior to the dismissal of the case.
Congress and the public have been told — for over a year — that the dismissal of the New Black Panther case resulted from nothing more than a dispute between lowly career civil servants. Lapdog reporters have repeated this lie, if they even covered the case at all. The documents uncovered by Judicial Watch expose the ruse.
Rarely in our nation’s history have officials in the Department of Justice engaged in a dishonest misinformation campaign to Congress, the public, and other fact-finding tribunals. Thankfully, these few episodes have been confined to the darkest and most corrupt eras of the republic.
Sam Hirsch is a former Democratic Party operative, and one of the most partisan election law attorneys in the entire nation. He worked for the Democratic Party in numerous redistricting fights, trying to squeeze every last drop of partisan advantage from plans in places like Texas. He has led efforts to impose racial divisions on Hawaii by creating native classifications and powers — and he is proud of it. He was heavily involved in the Obama presidential campaign.
As deputy associate attorney general — a senior Obama political appointee — Hirsch emerges in the privilege logs as the fulcrum around which the New Black Panther case was dismissed. Throughout April and May 2009, Civil Rights Division political appointee Steve Rosenbaum engaged in extensive legal analysis with Hirsch. In turn, Hirsch had extensive communications with Associate Attorney General Perrelli about the case. The emails are sometimes described as “deliberations” between the senior political appointees. These are deliberations which the DOJ inferred never existed. Nothing more than a dispute between civil servants, they repeated without equivocation.
The privilege logs show at least thirteen communications between Hirsch and Perelli in the two weeks before the dismissal on May 15.
On April 30 alone, Hirsch and Rosenbaum communicated at least eight separate times about the case. This occurred the day before the Voting Section decided not to seek a final injunction, and instead asked the court for a two-week delay. Someone, somewhere, didn’t want the easily obtained victory by default. Perhaps it was now-resigned Deputy Attorney General David Ogden. After all, he had some “current thinking” he was eager to share. Perhaps it was someone else.
On May 8, the same day that the logs show the Voting Section provided its analysis supporting a full remedy against all four defendants, Rosenbaum immediately forwarded the Voting Section’s work to the associate attorney general’s office. It’s clear from the logs who was calling the shots — and it wasn’t the career civil servants. Rosenbaum looks like an errand boy, nothing more.
The logs also show extensive communications between Rosenbaum and multiple lawyers inside the Civil Rights Division’s Appellate Section. Apparently Rosenbaum was looking for a second opinion to back up political hostility to the case. He never got it.
According to the logs, the Civil Rights Division’s Criminal Section was also recruited to help kill the case. On May 12, Rosenbaum wrote an email to political appointee Hirsh, which the privilege log describes as follows:
[Rosenbaum] provides [Associate AG] in charge of CRT with requested follow-up information and confirmation that additional actions would be conducted by Criminal Section Chief per his request.
The logs reveal a full court press to find someone, anyone, willing to provide a death blow to the case with the imprimatur of the civil service.
They never got it.
Political officials Rosenbaum and Hirsch communicate an additional twenty-two times in the days before the case is finally dismissed on May 15. Hirsch even had to review the scaled-down final order which prevents King Samir Shabazz from brandishing a weapon until 2012, and only in Philadelphia.
Reading the logs, one is struck by the level of intimate involvement by the highest-ranking political officials at the DOJ. Frankly, the level of political coordination saddened me, especially given the countless statements to Congress and the public characterizing the decision as having been made only by civil servants.
For example, DOJ press spokesperson Tracy Schmaler has crowed about the Panther dismissal being made solely by career civil service attorneys, and the resulting controversy being nothing more than a “disagreement among career attorneys.” False. Assistant Attorney General Thomas Perez repeated the same mantra to the Civil Rights Commission. Again, not true.
When Justice Department officials deliberately misrepresent facts to the public and to Congress, there must be consequences.
Schmaler is the same press spokesperson who accused me of deliberately misrepresenting facts to advance an agenda. My testimony was under oath. I gave up a great job at the Department so I could truthfully comply with a subpoena. My only agenda is the truth.
Schmaler, or another Justice official, told Fox News that I had been reassigned to other duties and was therefore a disgruntled employee. This was laughably false. I hadn’t been reassigned anywhere — instead, I had been promoted two weeks before I resigned, and had the same duties with a GS-15-9 pay grade. When I heard this lie, I was astounded that someone at DOJ would not only breach personnel privacy policies, but engage in gutter tactics so completely divorced from the truth.
General Holder should ensure that the first obligation of his press shop is to tell the truth, then spin afterwards. And reporters dealing with Tracy Schmaler should be cautious.
The logs show political officials Hirsch and Rosenbaum, and a press spokesperson, swinging into action as soon as the press reported the dismissal on May 28, 2009. “Response to Malkin” shows up on May 28 — they were coordinating a response to Michelle Malkin’s exclusive breaking the story of the outrageous dismissal. These communications are characterized by the log as “pre-decisional,” and therefore protected. Of course, the decision to dismiss the case had already been made. I can’t wait to see what the court does with that in the FOIA litigation. (Though I suppose the decisions about how to cover up the truth of the dismissal were in the formative, pre-decisional process.)
If Congress ultimately suspects that they were lied to, they might scrutinize an undated entry: Karen Stevens is listed as an author of “talking points for the Attorney General regarding the DOJ’s handling of the NBPP litigation and the decision to drop charges.” She should get a subpoena from Congress next year also.
Similar entries evidencing the creation of an ultimately dishonest spin are throughout the log.
I would not be surprised if the log omitted documents. Inspector General Glenn Fine’s investigation of the Voting Section should include an inquiry into whether the Department is fully responsive to various requests from Congress, the press, and the Civil Rights Commission.
The log provided by DOJ to Judicial Watch contains numerous unidentified documents. The listing provides no information whatsoever about these documents, as the identity of both the authors and recipients are omitted. Congress might also demand to know what all the untitled, undated entries are in the log.
Today was a very bad day for the Justice Department, but a worse day for our country. The privilege logs show what most Americans suspected all along: that the Department was lying, and the corrupt dismissal of the New Black Panther Case was made high up the political chain of command.
Let’s see if the Department’s defenders in the press and on the Civil Rights Commission keep repeating the lies.

Thank you Mr. Adams, for shining light on the former justice department. These thugs stole someone’s vote, on camera no less, and they should be prosecuted to the fullest extent of the law. The fact that our jutice department is, quite literally, using skin pigmentation as a factor in upholding our laws should be of great concern to everyone. Rule of law is central to any successful society, and we cannot have it being arbitrarily applied based on the whims of whoever happens to be in charge at the time. By applying it in exactly that manner in this case, the department undermines its own ability to apply justice in the long run. The seeds of doubt and uncertainty planted in the minds of the people by these actions is dangerous to us all. If we, as a society, want justice to apply differently based on skin pigmentation, genatalia, sexual preferences, and religion, then we should enact laws specifically madating such segregation (which I suppose “hate crimes” legislation already does in a way). This “social justice” approach is ripping the country apart and should be eradicated from the planet like the cancerous tumor that it is.

I noticed it too. People use “imply” and “infer” interchangeably, when their meanings are almost opposite. It’s not too serious unless you know the difference. Once you know the difference, it’s confusing.

The “why” in this case is easy. You only punish for those crimes that you wish to deter. First of all, I think the defendants in this case are criminals, and that voter intimidation should not be tolerated. However, the reason they’re not in jail is not the fault of the Obama DOJ.
Here are some facts on the case:
The Bush DOJ downgraded this case from a criminal case to a civil case. So there’s no way any of the defendants would have gone to jail. The Obama DOJ did prosecute the civil case for worst offender, Shabazz, and he barely got a slap on the wrist. His ‘sentence’ was decided by a federal judge, not by the Obama DOJ.
What was his sentence? He’s prohibited from carrying a weapon near any polling locations in Philadelphia until after the 2010 elections. Yes, it’s a pathetic punishment. But the fact that it’s a pathetic punishment is not the fault of the Obama DOJ. It’s the fault of weak voter intimidation laws.
This article proves nothing other than the fact that upper-level DOJ officials were interested in this case. This is not shocking at all, given the public attention the case received.
Ultimately, the stakes of the Black Panther case were very low. As yet, no actual victims of voter intimidation have surfaced. This doesn’t mean that it didn’t happen, but it does make it hard for a federal judge to assign a strict punishment. If the Obama DOJ hadn’t dropped the case, the defendants still would not have gone to jail. Maybe it would have been nice if the defendants would have lost the civil suit, but is that really worth wasting our tax dollars on?
Aaron is repeating the false spin of the DOJ. The Bush adminstration downgraded nothing. In fact, criminal charges could be pursued tommorow. In fact, civil charges are routinely brought BEFORE criminal charges in voting matters so a quick injunction can be obtained preventing future behavior. King Samir Shabazz and his confederates could be indicted this week, still.
His “sentance” mirroed what the DOJ asked for.
Aaron is also wrong about “no actual victims” have surfaced. I suggest he read the testimony from the April civil rights commission hearing.

Ummm, according to Mr. Adams, these documents show that contrary to many of their statements and in some cases, their sworn testimony, the upper levels of the DoJ management were KEENLY interested and ACTIVELY involved in the denouement of this affair.
That suggests that perjury was committed at the highest levels of the DoJ…and that IS shocking, (at least it should be).
As for what is “proven”, let’s leave that for a court…whether civil, criminal, or a court of impeachment, no matter.

In light of the reference helpfully provided by Aslan and Tom, I wouldn’t exactly say it’s a “slam-dunk”, since it would have to be established that AAG Perez knew at the time he gave his testimony, that the facts were otherwise than what he stated, but it certainly seems to reasonably merit further investigation, does it not?
On the one hand, and in the most favorable light, we would have an AAG spouting off under oath to Congress about things he has no direct knowledge of,(I can see why “I have not yet read SB 1070″ AG Holder would favor him).
On the other, we would have one of the top Law Enforcement Officers in the Republic himself being a lying crook.
This isn’t something that can be swept under the rug or shouted down. And even if it could be, a reasonable person wouldn’t want this.

I can’t really say I have much of an opinion one way or the other about the NBPP case, but I really don’t understand why Chris Coates cannot testify to the Civil Rights Commission.
I have a feeling that we’ve only seen the tip of the iceberg, not just the DOJ, but that many Federal departments have been playing fast and loose when it comes to the law and ethical decisions.

Let me preface things by saying that I come to places like this because: A) I like a good forum fight (I miss Usenet for this); B) I really want to track and understand how dis/misinformation is spread (a longtime interest of mine), especially when it ends up as a hardened myth; and C) conservatives make up a substantial part of the overall US population, but are rare in my personal travels, except for the odd libertarian here and there. And despite my, at times, snarky retorts, I’m not exactly completely comfortable dismissing them all as clueless dummies.
I actually hold the corporate mainstream media in greater contempt, because I think their ever increasingly erratic “coverage” of news, especially involving anything at all complicated and needing research and clear explanations, has driven both the left and the right to seek alternative news sources of wildly random quality. Add in what most of you probably never heard of,”SEO manipulation,” which has enormously screwed around with Internet search results, and you illogically end up with a situation where it’s much harder now to be well informed than it was 10 years ago despite having in theory many more news sources easily available.
Also while I’m a no-nonsense progressive when it comes to social and cultural issues, I actually have more in common with traditional conservitives when it comes to genuinely wasteful spending and abuse of resources, which I’ve seen by the supertanker full over the past several years. It’s actually been pretty infuriating to see insane amounts of money go to waste in certain government circles while deserving programs on the periphery, and needing pittance to keep going, struggle. There were all sorts of warning signs that the shenanigans in the financial markets were creating a very high and very, very expensive tower of cards that was doomed to collapse, but everyone was too busy counting their Monopoly money to care, and when that collapse did happen, it seemed to mostly show up how wildly inefficient and inattentive government, from the town level on up, had become.
But back to your points, there was a discussion on a healthcare thread, al all things, that actually had thoughtful comments, especially on tort reform, that made me think that not all conservatives hate facts and research.

Almost always, I only comment on things I know something about, and in that context I’m usually pointing out errors in facts or logic. It usually isn’t rhetorical debate on philosophical matters so I don’t really change my mind per se, but there have been instances when a very vigorous “debate” produced greater insight into a matter I thought I already knew inside out. That happened with my “favorite” urban myth, the Killian memos.
Early into it, I noticed a few little discrepencies with the whole “forgery” meme: none of the people making the charges were applicable experts; the commentary on common 70′s office tech was wildly confused; the commentary on proper military document formattting was all unsupported; and the release of key official records the day before the CBS broadcast (which was only a me-too effort) got virtually ignored, as was a very belated later release that had some funkily formatted documents unlike any of Bush’s other official records, including the only proportionally printed document. Some follow-up research quickly showed that the forgery charges had seriously wrong info about early 70′s office tech (IBM was making more money selling & leasing word processors than typewriters by 1971), official military formats (memos and personal letters have the signature block on the right and *not* the left, a little fact that everyone but the supposed forger got wrong), and how common proportional printing was (while memos are usually never archived, most of the declassified military and government memos from the 60′s and early 70′s are proportionally printed) and overall were laughably more inconsistent with available records than the “forged” memos supposedly were.
The biggest hit on the forgery charges actually occurred during a little debate I had on another right wing site, Wizbang: an idea popped into my head then about the timing of when CBS obtained the memos compared to when certain records were released (under duress) by the DoD. It turned out that a short memo titled “Flight Qualifications” that CBS never used in its broadcast had info that could only have been obtained by careful examination of Bush’s flight records. Ok, so what — obviously the forger simply rummaged through the official records to make the memos real seeming, no? No — the flight records were not released until the day before the CBS broadcast, Sept 7th, which is after CBS had obtained all the memos over the course of two days, Sept. 2nd and Sept 5th. And until the DoD had released those records, they had not been otherwise publicly available for decades.
Maybe none of this has an answer you were hoping for, but….

The only thing good about that journalistic train wreck known as the “Killian memos” is the slack jawed, deer in headlights frozen confusion that usually pops up when I point out, with links, how the forgery theory, despite all the hue and cry at the time, has no pants. “Buckhead” was an idiot whose tech experience amounted to working in an office with typewriters and Wangs in the 80′s. Charles Johnson’s little animated overlay trick fails completely on the longer, more complicated memos, which is what you would expect from overlaying a digital Times Roman recreation over a old document created with a mechanically generated Roman-style print element. None of the “st” ordinals are superscripted in the Killian memos, and only some of the “th” ones are, which only makes sense if this was a manual mechanical operation — old word processing systems and proportional typewriters often had a small “th” typeface you could select, but not an “st” one by convention, and a plain old half-line feed would superscript perfectly. And misc claims like how the formatting and terminology were not correct and that Killian ordered Bush to take a medical exam on Mother’s Day were just all no more than just tacked-on BS contradicted by old USAF writing guides and the official records. Most of all, nobody seemed to pay much attention to how Bush and his official spokespeople blew off any and all attempts to get Bush to answer any questions about whether the memos were real or not. Let’s face it, if they had been truly forged, would they have reacted this way?
But at this point, it’s all water under the bridge and out to sea. Nobody cares.

When I complained about my rights being violated, no one cared at the DOJ. When they had me arrested on bogus rape charges and I found out who was behind it, I filed another complaint with the DOJ, nothing happened.

What I would really like to see is the log on all the misrepresentation and threats that the DOJ and its chain of command has been involved in in keeping the Judges from hearing the cases about Obama’s birth place. They have really twisted (or should I say “broken”) arms to keep anyone from hearing those cases. That intimidation included Obama, Pelosi and Reid threatening Supreme Court Justices on public television. If there is something deserving of impeachment in the lives of the Supreme Court Justices, you do it, you don’t get up and theaten Supreme Court Justices with impeachment if they don’t rule the way or do what you want. That threatening in itself is a felony calling for impeachment…
The Police should go after them for dressing their CHILDREN like that!!!!

If you want to correct this and endless other Crimes Against Liberty take a hard look at top management. Each and every organization reflects the ethics and standards of top management. These guys are no different. We are being lied to every day in every way by a top management which has a Master Plan to replace the America we all know and love. These lies are spewed by and with support of willing accomplices called a ‘media’ which, in fact, are traitors to their so-called professionalism of Jornalism. Our America is based on our Creator, exceptionalism, hard work, opportunity, free enterprise and minimum government. The Master Plan replaces our America with a socialist state which rejects our Creator, exceptionalism, hard work, opportunity, free enterprise and minimum government. Everyone is equally miserable. This Master Plan has three objectives. Destroy the Middle Class. Confiscate, or ‘nationalize’, all IRA’s, SEPP’s and personal savings to fund the Trillions of $ of debt and wasteful, extravagant social programs imposed on us in the last 18 months. Rule this nation with an iron hand in which only government, or the ‘ruling class’, takes and controls everything.
