Pampering Illegals, Endangering Americans: The Obama Administration’s Immigration Policy
The death of a Catholic nun and the serious injury of two elderly nuns in Virginia is more than just a tragedy. It’s the inevitable outcome of the Obama administration’s immigration policy — offering selective amnesty for many illegal aliens while spending tax money on pampering those who break our laws with relative impunity.
Carlos Montano, the drunken driver who crossed the center line and slammed head-on into the nuns’ car, already had two convictions for DUI. He had also been arrested or cited for reckless driving, speeding, and public drunkenness. Officials in Prince William County, Virginia, had previously notified the U.S. Immigrations and Customs Enforcement agency (ICE) at the Department of Homeland Security (DHS) about Montano. But Montano, an illegal alien, was released by ICE on his own recognizance pending deportation proceedings.
An anonymous immigration official at DHS told the Washington Post that Montano’s two prior DUI convictions were not “enough to warrant detention.” That may be the current policy of the Obama administration, but lawyers familiar with the Justice Department’s procedures for immigration and deportation proceedings tell me that is “absolutely not true.” It was common for ICE in the past to detain aliens with two DUI convictions, especially when they had no obvious basis to legalize their status in the United States (such as being married to a U.S. citizen).
And there is no evidence whatsoever in the public record that Montano has any legal basis to remain in the United States. The lawyers told me that aliens like Montano are frequently brought before immigration judges to decide whether the person is a threat to public safety and should be detained. If the immigration judge decides they are not, the judge can still set a bond rather than release the alien on his own recognizance based on the alien’s flight risk.
Montano would have warranted a high bond, and might have had bond denied if DHS had argued to the judge that he should not be released because of the two DUI convictions. Normally, such detainee cases are also brought up very quickly before immigration judges. Yet in this case, DHS apparently didn’t even hold Montano and bring him before an immigration judge when local authorities in Prince William County referred him to DHS.
Instead, ICE simply released Montano on his own recognizance despite the prior convictions. ICE’s requirement that Montano report to ICE on a monthly basis did nothing to keep him from drinking and driving again and killing a nun and seriously injuring two others. On the other hand, if Montano had remained detained in ICE custody until he was ordered removed from the country, he wouldn’t have been out on the streets and could not have harmed anyone.
DHS Secretary Janet Napolitano reportedly ordered an investigation into why “the removal proceedings [were] taking so long.” But that’s the intentionally wrong question designed to shift responsibility form DHS.
The real question: why was this illegal alien released to await removal proceedings instead of being held by ICE and DHS at one of their detention facilities? Answering that question requires no investigation — that is the very policy on the “apprehension, detention, and removal of aliens” instituted by Secretary Napolitano and President Obama.
This policy was formalized in a June 30, 2010, memorandum from ICE Director John Morton to all ICE employees. The priority of ICE, as outlined in the memo, is to remove certain “violent” criminals and essentially to ignore “non-violent” criminals and other illegal aliens. The memo makes no reference to aliens convicted of DUI and other such serious offenses, and there is no statement that such aliens remain a priority.
My sources tell me that this vague memo has created much confusion among ICE law enforcement personnel and will lead to much less focus on enforcement. It abuses “prosecutorial discretion” to order ICE employees to look the other way on most illegal aliens. It may also lead to other problems, such as liberal, activist, federal circuit court judges citing the memo as a basis for not affirming deportation orders against aliens who don’t fit the very limited criteria of “violent” criminals spelled out in the memo.
It essentially gives a de facto administrative amnesty to all other illegal aliens who are caught by ICE or arrested or detained by local and state police officials — including supposedly “non-violent” criminals such as Carlos Montano, whose prior history of DUI, public drunkenness, speeding, and reckless driving would not make him a “priority” for removal under John Morton’s memo. Neither would con men, thieves, burglars, robbers, and all of the other criminals who are supposedly not “violent” enough to warrant the administration’s attention.
With policies like this, it’s not surprising that the ICE employees union has no confidence in Morton’s leadership. Council 118 of the American Federation of Government Employees that represents about 7,000 ICE workers has accused Morton of abandoning the core enforcement mission of ICE to instead implement an amnesty program.
Worse, Morton justifies the Obama administration’s policy based on “the limited enforcement resources” that ICE supposedly has available. Of course, that didn’t prevent ICE from making plans to change the conditions at many of its detainee facilities at almost the same time as the June 30 memo. Internal ICE emails sent in May direct that changes be made within 30 days at nine detention facilities operated under contract to ICE by Corrections Corporation of America.
Those changes, which read like they were inspired by Martha Stewart, were proudly trumpeted to the Houston Chronicle by Beth Gibson, a senior counselor to Morton. They include the following:
– Soften the look for the facility with hanging plants, flower baskets, new paint color … wall graphics and framed pictures on the walls, and enhance the aesthetics of the living areas.
– Expand programming for detainees to include movie nights, bingo, arts and crafts, dance, walk and exercise classes, health and welfare classes, basic cooking classes, tutoring, and self-paced computer training on portable computer stations.
– Provide celebrations of special occasions and allow … a detainee to receive outside packaged food for celebrations.
– Provide fresh carrot sticks and celery or other vegetables in a bar format.
– Provide self-serve beverage bars.
– Offer water and tea in the housing area at all times.
– Provide a unit manager so detainees have someone available to talk to and to solve problems in the facility other than the immediate guard.
– Survey community-based immigration advocacy groups and immigration attorneys for suggestions that may improve communication and ease of access.
The email also directed an increase in legal supplies, postage for legal correspondence, and research resources at the law libraries; elimination of lockdowns and “pat down searches” of “noncriminals”; providing “non-penal clothing for detainees to wear”; email access and Internet-based free phone service; and “four hours or more … of recreation in a natural setting.”
All of this is in accord with another leaked memorandum from the Citizenship and Immigrations Services agency at DHS. That memorandum proposes that the administration circumvent existing immigration law and grant permanent residence to many illegal aliens, or allow aliens who should be deported to remain in the country by granting them “parole-in-place,” a euphemism for ignoring the law.
The bottom line here is pretty clear.
The political appointees who run the federal agency that is charged with enforcing our immigration laws and deporting illegal aliens like Carlos Montano are more interested in providing administrative amnesty and legal assistance to illegal aliens. They also care more about converting federal detention facilities to “an all-inclusive resort” as Tre Rebstock, president of the ICE union in Houston, told the Houston Chronicle.
ICE supposedly has only “limited enforcement resources” available. Yet it seems to have no problem spending its limited resources to provide illegal aliens with beverage bars and movie nights, hanging plants and flower baskets, portable computers and Internet access, and celebrations for special occasions — like perhaps successfully evading deportation and federal immigration laws?
Too bad that the numerous American citizens who have been killed, injured, robbed, and assaulted by illegal aliens, or who bear the enormous cost of public services extended to such aliens, won’t have access to the same types of facilities that they have paid for with their taxes.

There should be a national search team to seek the most qualified people to lead this great nation, not limited to those with political ambitions and millions dollars to support campaigns. Corporations and municipalities have been doing this successfully for years.

Most illegals are looking for a better life for them and their family. We need to find a different way to do things. Many times we need them and they need us..there has to be a better way than the unfortunate mess we have, murder, drugs, intimidation etc..

This article paints a distorted picture of what is going on. If nothing else it may be partly because Mr. Spakovsky has been inadequately prepared to deal with the topic by associates or friends that he trusts.
Prince William County Virginia, where Carlos Montano lives is not lily white in this issue. You can count the number of government, law enforcement and community business leaders that strongly oppose illegal immigration on one hand.
I’ve lived in Prince William County for over 35 years. The place is overrun with illegal Hispanic immigrants. In this county illegal Hispanics fill 95% or more of the domestic level jobs. They hold a large percentage of the business community’s management positions and an even greater percentage of local government positions.
In Prince William County crime is right on the edge of being out of control. Gangs of Illegal Hispanics and orientals are everywhere. Large groups of illegal Hispanics loiter in front of Seven-Elevens and gas stations everywhere you look.
The PWC Health Department is under-staffed, over loaded with severe public health complaints; everything from hair in restaurant food prepared and served by illegal Hispanics to rats running between the dumpsters of businesses, hotels, motels, hospitals and housing developments.
There is much, much more of the same going on. Schools, hospitals and diseases to name a few. In short, in spite of what legal citizens want or the laws and ordinances illegal Hispanics in Prince William County Virginia, for the most part, have free reign to do whatever they want.
The reasons for this are simple. That is what the local, regional and federal business, judicial and government leaders want. Considering their breadth, width and power there is nothing that can; worse yet wants to stop them.
While I detest President Obama and everything he stands for, it should be noted that he was / is smart enough to control and ride the gift-horse of illegal Hispanics in our country for everything it is worth.
The people, the voters throughout our nation have not yet made themselves heard on this issue with enough conviction to fix the problem. The politicians, Obama included are doing nothing more or less than what the people are allowing them to do.
Bottom Line: One of these days; probably sooner than later, it is going to be too damn late. The fat lady will have sang her last song, then up and died.

What does it matter that one Nun in Maryland dies, or one rancher in Arizona, or a cop in California? Only a small percentage of illegal aliens commit felonies. What percentage you ask? 27% of all prisoners in federal custody were illegals in 2004.

Deborah Schurman-Kauflin (Violent Crime Institute): …the illegal alien population includes 240,000 sex offenders – a “conservative estimate,” she says. She goes on to say, “This translates to 93 sex offenders and 12 serial sexual offenders coming across U.S. borders illegally per day.” She points out the 1,500 offenders in her study had a total of 5,999 victims, an average of four victims for each sex offender and says, “This places the estimate for victimization numbers around 960,000 for the 88 months examined in this study.” … Annualizing the results, that is 130,909 sex crimes committed annually by illegal aliens…
Of the 55,322 illegal aliens studied (about 21% of the incarcerated aliens), researchers found that they were arrested a total of 459,614 times, averaging about 8 arrests per illegal alien:
*They were arrested for a total of about 700,000 criminal offenses, averaging about 13 offenses per illegal alien.
*49% had previously been convicted of a felony, 20% of a drug offense; 18% a violent offense, and 11%, other felony offenses.

When I started reading the information the site above contained, I was appalled. The numbers are staggering.
We have lost employment to overseas workers. Simultaneously Americans at home are losing jobs to illegal aliens. Does no one have the cahones to at least fix the problem we have with the invasion of illegals that over burden our institutions and to secure the border from agents of our enemies who will create havoc when called upon? Well. Since he promised to reappear as ordered and thus was released on his own recognizance, what was ICE to do? I would imagine he’s already being evaluated for release based on his promise to register in some 12 step program. And probably being considered for PTSD services through some do-gooder outfit. Every day we read about another case where the illegal has been through our system and is somehow still here. Some of the killings are especially wanton barbaricism. There is pretended outrage by Napolitano but the truth is it will happen again and again. They really don’t care. The Head of ICE says he won’t support the law. What could be more crazy. The guy should be removed immediately. Illegals who get caught are given a court date and never show. They use court orders one after the other to stay here. They just show the latest one next time they are apprehended. We have police chiefs who believe we need more illegal aliens as snitches to catch the bad ones. If they weren’t here they wouldn’t be doing the crime. Studies show that the snitches are often involved in criminal activities and are playing the police to avoid scrutiny of their activities.

I’ve blogged about this quite a bit. It’s truly disgusting that not only is the Obama administration not doing enough to capture illegal immigrants, but it is more than willing to detain certain ones.
This administration has mismanaged the immigration so badly that I’m amazed more Americans are not screaming for something to be done by President Obama. That’s right, they are with protests of the Justice Department’s lawsuit against Arizona’s law, but once against the Obama administration doesn’t care what the majority of Americans want. So much for “majority rules.” I guess it’s only good enough to get him elected.

The Posse Comitatus Act of 1878 has been used numerous times in the past 130 odd years providing real U.S. Army combat troops to do everything from quell riots, i.e., L.A, Wounded Knee, supplement Law Enforcement in the War on Drugs, enforce Civil Rights Orders, etc., however, these troops kinda got a bad name after the Kent State Ohio shooting. I can see nothing wrong with using the U.S. Army and Air Force to secure our borders if the DHS isn’t up to the task.

That said, Prince William County, Virginia isn’t a bad place; truth known much different than anywhere else in the country WHEN it comes to the illegal Hispanics problem.
The concentration of illegals here in PWC is higher than other places, but that is because PWC is in the same corridor of jobs opportunities that involves the entire Norther Virginia, Maryland and Washington, DC metropolitan area.
Texas, Laredo included and Arizona serve as staging areas for coyotes bringing illegal Hispanics out of Mexico and points south. Here in PWC single family homes packed with 15 to 20 illegals that are rotated just as soon as their “paperwork” is fixed and ready are not unusual.
The illegals that used to own the house directly across the street from ours rented the storage area under their house to an illegal Hispanic couple. The storage area has about a 3 foot ceiling clearance. It was carpeted, with furniture and had large pieces of foam rubber taped to the rafters; presumably to cushion head bumps.
Calls to PWC Zoning Enforcement about rats running between the over loaded trash cans of this house and the coyote’s went unanswered until long after the banks foreclosed on the one directly across the street.
It took the new owner almost 6 months to gut, fumigate and make the house habitable after he went to settlement. House that the front yard and street look like a bomb went off and blew everything inside the house; including appliances, cabinets and drywall are not an uncommon sight.
Mr. Spakovsky’s article seeks to blame the feds and Obama by painting a fairy tale about what Prince William County, Virginia is doing.
I’m saying that the problem and the solution lies directly with the people, not PWC or the feds. This applies whether you live in PWC, Virginia, Laredo, TX or a cave in Tennessee. The cheese is bad and it stinks the same no matter where you are or how you sniff it.
I don’t think Army Troops can do much to change that.

I agree with you. It is appropriate for the United States to use military force on the border. We have and are experiencing an invasion. The Gov’t elected and appointed took an oath to protect this sovereign nation and this Govt’s cesspool has chosen to do nothing. They should go to jail but then who is left to put them there?

It may have helped the problem 20 years ago, but there’s a whole new class of illegal here now. Law enforcement hardly bothers with rounding up illegals at their employment any more (Arpaio is an exception). Local, state, and federal law enforcement here in AZ is stretched so thin, only the really serious offenders are investigated. Many of them are never apprehended, because they’ve been told to flee to Mexico once they become the subject of a manhunt. The ones who are caught are usually charged with drug and/or human trafficking, carjacking, home invasion, murder, etc.).
This is the impetus behind the state’s Prop 200, SB 1070, and other laws. Removing the attractive nusiance our economy poses to immigrant workers of goodwill would have very little effect on the current immigration problem, driven by drug- and human-smuggling cartels.
Somebody mentioned drying to draft VDH for 2012 (I disagree…because he’s needed doing what he’s doing…but…..)….if that’s a plan. Let’s go for it. And then I want Sheriff Joe for Homeland Security.
If increased enforcement has no impact on the smugglers/cartels, why would they put a $1 million dollar bounty on Sheriff Joe? And threaten to use snipers to shoot Nogales police? These stories of illegals packing boarding houses with mattresses and the total malfeasance of county zoning to do anything about sound really familiar – Loudoun County bends over backwards to ignore reports of boarding houses; there’s a house down the street that when it was repossessed and the buyer evicted the people living there, the new owner found 11 mattresses in this two bedroom townhouse, including two in an outdoor shed along with a bucket filled with urine and feces. And, of course, the place was full of bedbugs and cockroaches, and we discovered the source of the rats that we’d been seeing in the neighborhood. Despite complaints to Loudoun County zoning, the place was apparently never even inspected – if they’ve ever closed a single such boarding house (and there are dozens, likely hundreds of obvious one in Eastern Loudoun county), it would be news to me.
Here’s a tip – you can usually detect boarding houses by the mattresses they frequently discard – they’re full of bedbugs, and rather then fumigating, they just buy another mattress, which quickly gets re-infested.
Of course, we’ve had a large number of crimes committed by illegals who’d been arrested before, served time, and released back into the community, including a number of sexual predators. MS-13 gang-bangers can be found in even the most expensive neighborhoods like Ashburn and Lowes Island.
Here’s some questions for our government – why are illegals being given drivers licenses? Why are illegals receiving Medicaid and other benefits? Why are they over-crowding our schools, requiring us to build yet more schools we can’t afford? These things are *supposed* to be illegal, yet they’re commonplace.
You know we spend billions on these illegals, right? Here in Loudoun, we spend $17m a year on ESL classes alone.
It is really simple – if you don’t want the filth, crime, and staggering costs of allowing illegals in your community, don’t elect amnesty-mongers like the almost-entire Loudoun County BOS, and especially, our two weasel-faced amnesty-pimping Senators.

Thank you to Pajamas Media and all the commenters–Again! I thought I was the only one that was asking these questions about policy. Whew! Now, how do get the mainstream media to figure this out.
Two Questions:
1 – Did Carlos Montano have a drivers license?
2 – If he had a license, what state issued the license?
If this information has been posted, it has been on a very obscure site.
That is not all. If the illegal immigrant is froma country that won’t take him back, like Cuba, the person is released back to streets after 90 day ICE detention.

The illegal immigrant population in the AZ prison system has seen an average 15% increase each year from 1991 to 2000. Since 2000, the increase has averaged about 25%, so that the total prison population made up of illegals is just under 40%. That’s a big number, considering illegals only account for about 7-8% of AZ’s total population. Qualitative trends are telling too: illegals convicted of violent crimes (assault, sexual assault, armed robbery, homicide) are up dramatically; DUI and hit-and-run are also up. Both Sheriff Babeu (Pima County) and Sheriff Arpaio (Maricopa County) reportedly have bounties on their heads from the Mexican drug cartels.
With all this, it makes one wonder: why would any government entity support (at least tacitly, with its policies) illegal immigration or amnesty? There’s got to be more to it than Democrat voters, or Republican hired help. The end game has to be anarchy or revolution, because that’s where this thing appears to be headed.

I have a modest proposal to make. “They” say that there is no way we can deport 12 million illegal immigrants.
I say that is bullshit. I am usually very opposed to creating government positions to create jobs for the unemployed, put since the current notion of “economic stimulus” seems to consist of doing
just that lets create temporary government jobs that consist of hiring people to find, round up, and deport illegal aliens.
It should not be structured like the common bureaucracy. Start out with a set level of enforcers, and then look at the rate of people that they manage to apprehend and successfully deport. If it gets very high as to the number of aliens deported per enforcer, increase the number of enforcers. If it shrinks, then keep laying off the enforcers until the average number of deportations to enforcer gets higher.
And, oh yeah, the ratio of administrators to enforcers will remain the same in the case of layoffs. If the original structure has one administrator for every twelve enforcers, layoffs must include one administrator for every twelve enforcers. No exceptions.
And everyone deported should have at least one electronic tag implanted under their skins, like people do to their dogs so that if they get lost they can be identified again. If you have been deported once and are caught over here again–five years at hard labor. Of course if they have or get a medical condition their sentence should be reduced immediately and they should be deported at once. If you get caught a third time–you get shot.
Just think– it would create jobs for Americans in law enforcement, and would create jobs for Americans by deporting the illegals which would raise wages by lowering the supply of labor and provide positions that Americans could fill.
Its just a thought.
I have to say I do like your calling it BS….that’s one of those assertions that sort of is allowed to stand. Has anyone accused you of being a racist yet? If not, they will. Since the BS that you identify actually is a big steaming pile (I grew up on a farm, so I know about that)….I’m with you.
DAMN–I love that phrase “Assertions that are allowed to stand.” That is the key. That is the disease. So long as we keep pretending that reality can be anything we want it to be if we just keep pretending hard enough we are doomed.
Two things had to happen before the country finally realized prohibition doesn’t work. The St. Valentine’s Day Massacre and the Great Depression. The violence of Al Capone and other gangsters funded by bootlegging and the strain on public services, cops, prisons, etc. during tough economic times finally resulted in the repeal of the 18th Amendment. Maybe the same forces will allow us to admit we are losing the war on drugs. That would help.
Arizona lost a lot of its illegals when they went to mandatory E-Verify. Illegal aliens now have to commit fraud in order to get a job in Arizona. The system can be beat but it’s a lot harder and the consequences of getting caught are a lot graver. That would help.
Cities that have sanctuary status need to be sued every time an illegal harms an innocent person and that should include identity theft and car accidents. Social security cards need to be at least as hard as a credit card to forge and we need to investigate every card that appears to be used by more than one person. Credit card companies can track these, why can’t the government? That would help.
Finally, finish the damn fence. None of these things in and of themselves will solve the problem but together they would certainly get a handle on what is now an out of control situation.
This is such a tragedy and the liberal Benedictine sisters still don’t get it.

Another illegal alien costing the American tax payer in lives, and court costs.
Put me in charge, and get out of the way.
I’ll never forget my shock when I found out an illegal alien could drive in America without a license, with car insurance, and have total immunity. In Austin, Texas, 2001, I witnessed a young woman pedestrian crossing on a zebra, with the legal pedestrian right of way–pedestrian green light,–when she was struck by a driver gunning through an intersection. She flopped on the hood of the car, and was violently thrown down on the street on her back from the impact. I was in my car behind the driver who struck her, so I know how fast he took off at the light as he turned onto the street going too fast, and failed to yield to a pedestrian. (I don’t think he saw her. How? I don’t know. I saw her. Clear sunny day. No obstructed view.) I parked immediately to help the woman. She couldn’t get up, but was sitting conscious. She refused to stay still, typical shock behavior, wanted to get up off the street. I helped her walk, and then she collapsed onto the grass. The driver who hit her was a Mexican illegal. The cops knew it, and told me they couldn’t arrest him. He really didn’t look phased or upset in the least. No concern for his victim could be seen on his face. I couldn’t believe how nonchalant his demeanor was. I personally would have been very upset if I hit someone, and would have run to them to help. And I would have been horrified if I were driving without insurance. This man looked like he was waiting in line to order a hamburger. And his poor victim would have been on her own. I hope she had good health insurance. It was so sickening. What the hell is wrong with our politicians that law abiding American citizens pay through the nose for car insurance, abide by the law, and have to put up with all this double standard complete and utter BULLSHIT.
For clarification: The Illegal Mexican thirty-something male, was driving WITHOUT a driver’s license, with NO CAR INSURANCE, and was ILLEGALLY in our country. We simply cannot rely on our politicians to do right by us and protect American citizens first. We have to aggressively hold them accountable, and if they’re too damn stupid to utilize critical thinking skills that make sense and are fair to American citizens, FIRST and FOREMOST, we need to get them the hell out of office. We need to get the kind of bleeding hearts in office that firstly love America, and Americans, with NO mixed allegiances. I ‘m sick of Liberals and people who managed to get the American citizenship STATUS who actually hate Americans,but enjoy all the perks of living here, and feel entitled for the rest of us to pay for it.
