Obama and the Attempt to Destroy the Second Amendment
As a presidential candidate, Barack Obama must demonstrate executive experience, but he remains strangely silent about his eight years (1994-2002) as a director of the Joyce Foundation, a billion dollar tax-exempt organization. He has one obvious reason: during his time as director, Joyce Foundation spent millions creating and supporting anti-gun organizations.
There is another, less known, reason.
During Obama’s tenure, the Joyce Foundation board planned and implemented a program targeting the Supreme Court. The work began five years into Obama’s directorship, when the Foundation had experience in turning its millions into anti-gun “grassroots” organizations, but none at converting cash into legal scholarship.
The plan’s objective was bold: the judicial obliteration of the Second Amendment.
Joyce’s directors found a vulnerable point. When judges cannot rely upon past decisions, they sometimes turn to law review articles. Law reviews are impartial, and famed for meticulous cite-checking. They are also produced on a shoestring. Authors of articles receive no compensation; editors are law students who work for a tiny stipend.
In 1999, midway through Obama’s tenure, the Joyce board voted to grant the Chicago-Kent Law Review $84,000, a staggering sum by law review standards. The Review promptly published an issue in which all articles attacked the individual right view of the Second Amendment.
In a breach of law review custom, Chicago-Kent let an “outsider” serve as editor; he was Carl Bogus, a faculty member of a different law school. Bogus had a unique distinction: he had been a director of Handgun Control Inc. (today’s Brady Campaign), and was on the advisory board of the Joyce-funded Violence Policy Center.
Bogus solicited only articles hostile to the individual right view of the Second Amendment, offering authors $5,000 each. But word leaked out, and Prof. Randy Barnett of Boston University volunteered to write in defense of the individual right to arms. Bogus refused to allow him to write for the review, later explaining that “sometimes a more balanced debate is best served by an unbalanced symposium.” Prof. James Lindgren, a former Chicago-Kent faculty member, remembers that when Barnett sought an explanation he “was given conflicting reasons, but the opposition of the Joyce Foundation was one that surfaced at some time.” Joyce had bought a veto power over the review’s content.
Joyce Foundation apparently believed it held this power over the entire university. Glenn Reynolds later recalled that when he and two other professors were scheduled to discuss the Second Amendment on campus, Joyce’s staffers “objected strenuously” to their being allowed to speak, protesting that Joyce Foundation was being cheated by an “‘agenda of balance’ that was inconsistent with the Symposium’s purpose.” Joyce next bought up an issue of Fordham Law Review.
The plan worked smoothly. One court, in the course of ruling that there was no individual right to arms, cited the Chicago-Kent articles eight times. Then, in 2001, a federal Court of Appeals in Texas determined that the Second Amendment was an individual right.
The Joyce Foundation board (which still included Obama) responded by expanding its attack on the Second Amendment. Its next move came when Ohio State University announced it was establishing the “Second Amendment Research Center” as a thinktank headed by anti-individual-right historian Saul Cornell. Joyce put up no less than $400,000 to bankroll its creation. The grant was awarded at the board’s December 2002 meeting, Obama’s last function as a Joyce director. In reporting the grant, the OSU magazine Making History made clear that the purpose was to influence a future Supreme Court case:
“The effort is timely: a series of test cases – based on a new wave of scholarship, a recent decision by a federal Court of Appeals in Texas, and a revised Justice Department policy-are working their way through the courts. The litigants challenge the courts’ traditional reading of the Second Amendment as a protection of the states’ right to organize militia, asserting that the Amendment confers a much broader right for individuals to own guns. The United States Supreme Court is likely to resolve the debate within the next three to five years.”

The Center proceeded to generate articles denying the individual right to arms. The OSU connection also gave Joyce an academic money laundry. When it decided to buy an issue of the Stanford Law and Policy Review, it had a cover. Joyce handed OSU $125,000 for that purpose; all the law review editors knew was that OSU’s Foundation granted them that breathtaking sum, and a helpful Prof. Cornell volunteered to organize the issue. (The review was later sufficiently embarassed to publish an open letter on the affair).
The Joyce directorate’s plan almost succeeded. The individual rights view won out in the Heller Supreme Court appeal, but only by 5-4. The four dissenters were persuaded in part by Joyce-funded writings, down to relying on an article which misled them on critical historical documents.
Having lost that fight, Obama now claims he always held the individual rights view of the Second Amendment, and that he “respects the constitutional rights of Americans to bear arms.” But as a Joyce director, Obama was involved in a wealthy foundation’s attempt to manipulate the Supreme Court, buy legal scholarship, and obliterate the individual right to arms.
Voters who value the Constitution should ask whether someone who was party to that plan should be nominating future Supreme Court justices.

Hey; is it just my sat system or what? I’ve had my Dish Network sat receiver tune into Obama’s sat channel seemingly by default. Is the Sat Company doing this as a form of propaganda?. This is Orwellian. Some months ago, while surfing on the Joyce Foundation website researching Obama, I read where William Ayers wrote two grants for the foundation. That’s all it said, but I thought it was interesting.
Good article. It is clear to me that if people understood Obama’s past, and especially with regard to the Joyce Foundation, they would be highly … HIGHLY … skeptical of Obama’s claim of support for the second amendment.
As a proud gun owner, I almost wish Obama would go after the Second Amendment. His party would be eviscerated in the 2010 Congressional elections, and he could be laughed out of office in 2012. There is a reason why the Democratic-contolled Congress isn’t touching any major gun control legislation–they’re scared of standing against the popular Second Amendment.
Just take a look at Biden. He’s touting to people in Pennsylvania and Ohio the fact that he owns a Beretta.

re-chambered to a 257 Weatherby Magnum. I have seen many changes in the economy and been thru a few recessions, including the infamous Carter years when home loans soared to 18-20%. I served our flag in Vietnam and I have been to 49 states. But NEVER until now have I feared for the very existence of THE USA!! So take the words of a Senior Citizen. Stand proud, Vote for pro-gun, pro Constitution, fiscal conservatives into office and get this #^&$#* deficit paid down! We may not be a perfect country, but we’ve been the best by far. Obama is a master of deception. Don’t assume for a minute that any 2nd amendment restrictions would have his fingerprints all over it. Obama’s comment during the campaign–something to the effect of “I couldn’t take away your gun rights even if I wanted to”–is a good example. Between appointing federal judges who would be very friendly to the concept of a British/Canadian view of gun rights (i.e. none) and funding of research like the above, the 2nd Amendment could be circumventing without any sort of public legislation at the Federal level.
Somehow we, the People, must address the imbalance that has been allowed to grow between the branches of government. Specifically, the Judiciary has been allowed to make decisions far outside it’s legitimate constitutional mandate. Probably the only way to accomplish this is to start impeaching judges who insist upon legislating from the bench. It wouldn’t take more than one or two impeachments to encourage the others to clean up their acts.

The problem with the “paradigm shift” is that Senator Obama, soon to become POTUS, has been opaque about the contours of his ideology and intellectual templates. A lot of thoughtful citizens like myself have gone in quest of what these might be.
Generally, people are, in part, the sum total of their influences and education. So, you go in search of who advised, educated, influenced, and advanced this man. You also look at his voting record and his stable of advisers. Also, you look at statements he has made to groups out of the public spotlight to find out how he really thinks on a range of subjects. All of this takes time and effort. It does not come easily or cheaply. Especially when the Big Media is actively promoting Sen. Obama.
When you put it all together, it’s troubling, to say the least.

Candidate Obama cannot be a citizen of Kenya, although he is entitled to Kenyan citizenship. Kenya rule is ‘NO’ dual nationality. The Senator’s choice has been made.
I would call and complain to Dish. We had some weird things yesterday, my husband was trying to watch the Bronco game and about an hour was blanked out(yellow screen).
It did it for a few minutes when we were watching Amazing Race too.

Someone, it is already illegal to own an automatic weapon without a special permit. I also think that the weapon must have been manufactured before 1986, but I could be mistaken about that.
Given your demonstrated massive ignorance–which could have been corrected by doing an extremely simple google search–why should your opinion be treated with any more respect than one would give a 5 year old having a temper tantrum? Do you have any concept of the actual impact of personal firearms on violent crime, rather than feel-good intuitions? Do you know anyone who owns a gun and/or has used one to defend themselves?

Anyone should be allowed to own a gun for home protection. As long as they have an extensive background check and formal training in the proper use and care of firearms BEFORE they can actually take that gun home. And assault rifles are WAY beyond what any citizen (including hunters) should ever be allowed to own. Unless you live in a war zone.
There comes a time in every relationship when a person has just cause to take an objective look at the one they love and reevaluate them to answer the question, “Is he/she for real or am I just being a fool?”
In the real world such a moment comes when, for example, a friend breaks the awful truth to you that the one you love has been lying to you for months and behaving in sneaky ways very few people know about. It’s shameful such a person would do those kinds of things behind your back, but perhaps more shameful is the one who continues to support him despite knowing the REAL truth.
For those who are in love with Obama, articles like this one should bring them precisely to the point of questioning their relationship with the man. Unfortunately for many, love is blind and they will continue to deny and reject anything which challenges or tarnishes the image of the one whom they love so deeply.
Yet there is hope. If this article didn’t cause them to question the relationship then perhaps the next one will, or the next one, or the next one after that. Make no mistake: similar articles will keep coming and it is only a matter of time before everyone realizes the awful truth. Sadly, that time will come when it is already too late to do anything about it. They will have already committed themselves to him for the long-term.
For those who are willing to take an objective look, I applaud you for being open-minded. Set aside all the romantic plans, pleasant appearances, gentle mannerisms, and smooth words which stimulate your heart, ears, and eyes. Set aside blind trust and evaluate Obama’s potential ability to use lies, deception, and sneaky tactics in your relationship. Does he talk differently depending on the crowd he is addressing? Does he oppose something like the Second Amendment and then say he has always supported it? Does he promise you the moon despite not having proven he is capable of giving it to you? Has he been honest in all of his past relationships, associations, dealings, speech, and actions? If he is doing these kinds of things then isn’t it likely he is capable of doing the same kinds of things to you?
That’s one relationship I would get out of right away, before it’s too late. If you do it now, before November 4th, you can start anew with another and have hope in life. You’ll find plenty of supporters willing to help you through the process.

Pistols are a very good weapon for self defense and for the defense of property in any environment. I own a Smith & Wesson 9mm pistol, with a clip. I live in a rural environment in New Hampshire that is growing in population. I bought it because it is a good self-defense weapon and should the suburbanization of where I live brings in more criminals I will be able to defend myself and my family in the unfortunate event of a break in. The criminals get their guns mainly through an illegal gun network, not at the gunshops and not even mainly through home thefts. They tend to get weapons that they hope cannot be traced. I practice with it at a local rod and gun club. All of us are law-abiding citizens who like to shoot and hunt. We treat our weapons with care and respect.
I have heard no compelling arguments from the other side that what I own should be confiscated from me. And I’m keeping my hunting rifle, my shotgun, and my muzzleloader. As an Army veteran I know how to use weapons and safely store them. I’ve taught my daughters how to shoot, same for my wife. They enjoy the sport.
Clearly, there is a great divide in this country between rural Americans and urban Americans over guns, besides other issues. We rural Americans do not like urban Americans telling us how to live.

Apartment dwellers in a major city are very much at risk from criminals who are armed with semiautomatic pistols (automatic weapons are already against the law everywhere). I see no reason why the 2nd Amendment must be so circumscribed as to make it impossible for people to own a weapon of choice to match what the criminals can get. I know police officers in my area and not one has a problem with citizens being armed, provided that they learn how to use it properly, keep it stowed safely, and have no criminal record. They are not afraid of armed citizens like me one iota. Interestingly, the ones who don’t want citizens like me to have guns are the police chiefs in the larger cities in my state, and one ventures a guess that they say so out of concerns about local politics. Their rank and file, off the record, will tell you opinions very contrary to what the police chiefs say. And maybe when not being interviewed by the media, if they trust you even some police chiefs will express their true views. Off the record.
Wow…….so ask yourself this…..Does owning a gun make you safe from the government? At the rate weapons and tactics have evolved, you have already been neutered, even if you own a machine gun. That gun makes no difference. If you are worried about your second amendment rights then you really should be pushing for legislation to allow you to own a missle, or a nuclear submarine. You really think a pistol is going to help you keep the government in check?

In a free society, I don’t have to justify why I need to own a damned thing if my ownership of it doesn’t bring harm to anyone else.
As someone pointed out, machine guns are already heavily regulated. The “assault weapons” issue is about ordinary semi-automatic guns that look scary to the uninitiated. But if someone in an urban area wants to own an Uzi and take it to the range every once in a while, that’s his right as a free man. Try shooting a machine gun sometime, it’s a lot of fun.

As for your other question: Automatic weapons fire numerous rounds rapidly with only a single trigger pull. They are illegal to own or use for any purpose, except for the rare few who went through an unbelievable amount of red tape and expense to acquire a license for them. Some of those permit holders are simply collectors while others allow movie makers to use their weapons during filming. With all this in mind, your question isn’t really presenting a good argument given most average apartment dwellers cannot legally own an automatic weapon.
I suspect you meant your statement to say “semi-automatic”, as opposed to a cowboy-style revolver. Just in case someone doesn’t know the difference, Mel Gibson used a semi-automatic in the movie “Lethal Weapon” while his partner, Riggs, used a revolver.
Like a revolver, a semi-automatic pistol requires a single trigger pull for every round fired. Both types use the same ammunition so there is little difference between the power offered by either of the two gun types.
A revolver usually holds 6-8 rounds in a cylinder whereas a semi-automatic pistol uses magazines which have been pre-loaded with 6-15 rounds of ammunition (depending on the model). Some revolvers can hold more rounds than a semi-automatic, but usually they hold less.
Revolvers require less maintenance and are generally easier to operate. However, they are not quite so good for fast reloads, especially when light conditions are poor. Home invasions often happen at night so this is important for an apartment dweller to consider.
A semi-auto pistol would allow an apartment dweller to fire more rounds without having to reload his weapon, as well as to reload it more quickly and easily, even under darker conditions.

The Founders’ intent was for citizens to have guns to be tools in their livelihoods, protection from criminal elements, AND a means for citizens to enforce the Constitution on the government. Citizens brought their own weapons to the militias. That was the reality and the practice in 18th century America. They often would get their powder and shot at the armories. The regular armies of the Revolution did issue muskets to their troops who lacked their own weapons. Plus, they needed specialized muskets to accommodate the bayonet. The specialized units like Daniel Morgan’s Kentucky Riflemen often relied on the members to bring their own longrifles. These were specialized rifled bores that were the sniper weapon of their day.
Only in extremis would the citizens have to take action against the government. And I think it is precisely this that the Leftist leaders fear more than anything else. They also fear the military because they are never sure if it would remain under Presidential control under dire circumstances. In the loyalty oath officers take their loyalty is summoned to the Constitution FIRST and then the Commander in Chief. So, they have an “out” if they need it. We hope it never comes to this, but the Founders understood human nature and the tendency of government better than we moderns seem to.

I hate to infringe upon the ignorance displayed by many here, but it is not illegal under federal law to own a fully-automatic or selective-fire weapon in the United States.
NFA ’34 imposed a $200 transfer tax, and Congress instituted a ban on machine guns built after 1986 being put in civilian hands, but otherwise, anything from a small M-11 submachine gun to a water-cooled Browning or even a minigun are legal for law abiding citizens to own, providing it is legal in your state.
Federal Requirments:
“To become a registered owner, a complete FBI background investigation is conducted, checking for any criminal history or tendencies toward violence, and an application must be submitted to the BATF including two sets of fingerprints, a recent photo, a sworn affidavit that transfer of the NFA firearm is of “reasonable necessity,” and that sale to and possession of the weapon by the applicant “would be consistent with public safety.” The application form also requires the signature of a chief law enforcement officer with jurisdiction in the applicant’s residence.”
As of 1995, there were 240,000 legal machine guns registered with the ATF, about half of those were owned by police and other non-military government agencies, and the rest–roughly 120,000–were private-citizen owned.
As for legally-owned machine guns and crime, there have been precisely two known murders with legally owned machine guns since 1934, both committed in Ohio, both committed with M-11 .380 submachine guns, one of those committed by a police officer using a department-issued weapon to murder an informant.

I don’t particularly oppose bans on certain automatic weapons — on the grounds that criminals have better access to them than the police. But I have never believed that the anti-handgun activists had any motivation beyond deflecting attention from the criminal underclass who commit crime, for whom they display strangely positive feelings, particularly as they present themselves as representatives of victims of crime.
If these activists really cared to reduce crime victimization, they would find better ways of doing it than posturing feel-good “gun buybacks” than do nothing but spread free money around certain neighborhoods, make the evening news, and perpetuate charitable giving (including public money) to anti-gun activists. The anti-gun activists I worked with in state politics opposed stricter law enforcement in every instance, opposed mandatory sentencing, hated the police, and clearly believed that criminals were misunderstood and oppressed, innocent creatures, one and all. Their focus on handguns was merely a smokescreen for the usual pro-criminal, anti-victim, liberal bent, particularly tragic in those cases where the activists had lost loved ones but still could not being themselves to blame the criminals — so they blamed guns and the police and Republicans instead. I found your article most useful and enlightening. I was wondering if you had looked into how Senator Obama voted when he was on the board? Also, is it possible to look at the minutes of the meetings? It would make a great deal of difference if he was there arguing against these proposals and voting against them. On the other hand, if he is voting for these proposals it is all the more damming. As it is his supporters will surely say that he should not be held responsible for what the majority voted for. To hold him responsible in that way would have the effect of penalizing a person for serving on the board of an organization that did anything they disagreed with.

I have yet to read or see an argument in favor of greatly altering the 2nd Amendment (or any other one for that matter) that is convincing and compelling. I have challenged “public servants” at all levels regarding their DUTY to defend our Rights, and will continue to do so until I take my last breath. Even if Barack Obama did vote as a board member against the Chicago-Kent Law Review Symposium on the Second Amendment edited by Carl Bogus AND the establishment of the Second Amendment Research Center under the directorship of Saul Cornell at Ohio State University, he most assuredly did not go out and warn the American people that his fellow Joyce Foundation directors were surreptitiously attempting to undermine everyone’s individual rights by influencing judges with slanted historical information. The Obama campaign has been very slippery with the facts about Obama’s past views on gun control and the Second Amendment. At least in Bill Clinton’s case, his pro-gun control views were not deceptively packaged as just the opposite of what they really were.
I think it quite clear that Barack Obama did not disagree with the two Joyce Foundation votes on the slanted Second Amendment historical research while he was on its board of directors. There is no evidence he warned anyone about the two specific actions or that he he personally voted nay on them. All the evidence points to Barack Obama as a gun control advocate who does not actually support Americans’ Second Amendment rights but wants their vote anyway.

Your points are well taken: he has at the very least been deceptive. Still, in the absence of evidence to the contrary, I think people will naturally assume that the reason we do not specifically mention how he voted is because he voted against the moves. If it turns out to be the case that he voted against the measures and we (and here I am assuming that we are both opponents of the Senator) have been encouraging or at least allowing people to think that he had been on the side of the measures our criticisms will lose much of their force. It does seem a rather easy thing to look into and I can not help but think that the reason Mr. Hardy does not specifically discuss how Senator Obama voted is because because such a discussion would not advance his thesis. Again, I would be happy to be shown otherwise.

Obama’s campaign has already gone after the 1st Amendment. His lawyers have sent cease and desist letters to various media outlets around the midwest demanding that they stop airing certain NRA advertisments about Obama’s track record on gun-control issues that they allege are untrue.
The letter also threatens the stations that their FCC license may be in jeopardy if they continue airing said advertisments.
And then there is talk radio. Specifically, conservative talk radio. We already know what the DNC thinks about that. They would like nothing better than to bring back the so-called fairness doctrine.
In response–the votes of the Joyce Foundation, as private foundation with no members, are not public record, nor has Joyce ever chosen to reveal them. The most we have is what they choose to reveal, i.e., their grant awards. And a statement of a staffer that most of their votes were unanimous.
If Joyce chooses to make the records of votes public, or Sen. Obama chooses to ask them to do so, I would welcome it.
Why doesn’t McCain’s organization publish this info if it’s accurate. Obama is truly hypocritical and should be called out on these positions. McCain’s advisors seem to have their heads in the sand. Are they intent on losing this election and allowing our country to go comletely socialist?

While it is impossible to state what happened behind closed doors, one thing is for certain. The Joynce Foundation has bankrolled gun control advocates for a long time and it appoints its directors. They are not elected by membership like the NRA’s directors because there are no members. Someone not supportive of the Joyce adminstrators’ policy and agenda priorities will not be appointed, and someone appointed who did not support them, if that was possible, would not accept such appointment because it is obvious what the Joyce Foundation is – the bankroller of gun control in America.
The votes you are concerned about are very likely not what is being envisioned – a director being personally opposed to activities that are major policy innitiatives and agendas of the Foundation and voting against them for that reason. Instead, the voting at Joynce is probably more along the lines of whether projects A, B, and C, or projects E, F, and G are more important and get funded. Even in such wealthy orgnaizations, there still have to be priorities. Voting in such circumstances for A and against E does not exactly prove that someone is against E, only that they think A is more important to fund out of the current budget allotment. Joyce has to function on a budget because it cannot give all of its money away even if gun control advocates ask for all of it.
The evidence about Barack Obama’s gun control advocacy is not only to be found from his Joyce Foundation association and activity, but also in his prior Illinois Senate voting record. After reading Mr. Pearson’s first hand observations on Barack Obama’s views on firearms owners,their rights, and legislation he voted for, do you still think there is the slightest possibility he might have voted against any of the gun control advocacy projects while a Joyce director, including trashing the Second Amendment, because he was personnaly opposed to gun control? I had the “privilege” of taking Saul Cornell’s Constitutional History course at OSU. He was never very interested in the other side of the debate and I always got the distinct impression I was being shuffled out of office hours as quickly as possible. I am interested to hear how he reacted to the Heller case considering it made a book he published only two years ago obsolete.
That being said, in order to be fair, I need to mention that Professor Cornell knew I was in support of the individual right argument and I don’t feel that my grade suffered as a result.

President-elect Obama repeatedly states that he will not take away Guns, Last night in a speach he stated ” There is no need to be buying guns, and that he won’t take away, or effect the second ammendment” immediately thereafter he stated that he was behind the stamping requirement of all ammunition sold in the United States.

the second ammendment is in the bill of rights to ensure that Americans can protect themselves from a tyrannical Government more than it is meant for the right to protect of yourself from murders, home invasions, car-jackings and similiar crimes thereofe.
If in the event that we as Amercicans found it neccesary to “take Back our government (which I beleive we should be planning for) how do you think that you are going to fight a well organized, well trained, unit of operators that are descinding upon you, or any milita of the people if all you have to fight with is hunting rifles with limited round capacity, shotguns with three round limitations, and semi-automatic rifles that you cannot get ammuniton to use.
