LEAKED: Obama Executive Order Intends to Implement Portions of DISCLOSE Act

An impeccable source has provided me with a copy of a draft Executive Order that the White House is apparently circulating for comments from several government agencies. Titled “Disclosure of Political Spending By Government Contractors,” it appears to be an attempt by the Obama administration to implement — by executive fiat — portions of the DISCLOSE Act.

This was the bill introduced last year by Sen. Chuck Schumer and Rep. Chris Van Hollen to overturn the Supreme Court’s decision in Citizens United v. FEC. The bill had onerous requirements that were duplicative of existing law and burdensome to political speech. It never passed Congress because of principled opposition to its unfair, one-side requirements that benefited labor unions at the expense of corporations. Democratic commissioners at the Federal Election Commission then tried to implement portions of the bill in new regulations.  Fortunately, those regulations were not adopted because of the united opposition of the Republican commissioners.

The draft Executive Order says it is intended to “increase transparency and accountability,” an interesting claim given the fact that federal contractors are already completely barred by 2 U.S.C. § 441c from making:

Any contribution of money or other things of value, or to promise expressly or impliedly to make any such contribution to any political party, committee, or candidate for public office or to any person for any political purpose or use.

Yet this proposed Executive Order would require government contractors to disclose:

(a) All contributions or expenditures to or on behalf of federal candidates, parties or party committees made by the bidding entity, its directors or officers, or any affiliates or subsidiaries within its control.

(b) Any contributions made to third party entities with the intention or reasonable expectation that parties would use those contributions to make independent expenditures or electioneering communications.

The problem is that this will require companies to delve into the personal political activities of their officers and directors — and require them to report political contributions those employees have made, not out of corporate funds (which is illegal), but out of their personal funds.

And note that these disclosure requirements will only apply to companies that make bids on government contracts. Federal employee unions that negotiate contracts for their members worth many times the value of some government contracts are not affected by this order. Neither are the recipients of hundreds of millions of dollars of federal grants.

Clearly, this administration is not interested in increasing “transparency and accountability” when it comes to forcing union leaders or the heads of liberal advocacy organizations such as Planned Parenthood from disclosing the personal political contributions they make to candidates running for federal office.

    May be way past time for citizens to IGNORE the gov’t, including business entities.The only way to deal with dictatorial regimes IS to upend them.

            Why are we walking on eggs around Obama? No president has been treated in this manner in the past. If the Panthers don’t like it, so what? The Panthers are mighty and ferocious when confronting elderly citizens at polling places but they are cowards when confronted by an angry mob of men. Their mouths run constantly and quickly most of the time and their legs do, too, when the opposition arrives. This government is being run by criminals; unfortunately the president is the leader of the criminal gang and these people must be confronted or the rest of us wind up enslaved. People need to start thinking about how we confront such a situation. Had the thinking begun years ago we would not be in this mess now. Timidity in the face of a bully is ineffectual.

        A signal? Any signal would have to come from those inside the government who realize the danger and that it is time to act to save the Republic. That would assume, that there are still those inside government who are committed to the Constitutional Republic establised by the Founders. Do such patriots still exist, or are those in power simply looking at how the new order will benefit them, their power, and their positon.

            Gumption: 1. initiative; aggressiveness; resourcefulness: With his gumption he’ll make a success of himself.
            2. courage; spunk; guts: It takes gumption to quit a high-paying job.
            3. common sense; shrewdness.

            I’m sure all the smart, classy people who post here can find others.

          election of 2012 is in 1.5 years

          do we win the white house and the senate?
          do we win just the senate, more seats in house, and more state offices?
          does the obama machine pull out every stop, rig every poll site, and regain the power that was had in 2008?

          if we win senate (gain a supermajority) but obama gets reelected then it will be a stalemate for a couple years

          i am not suggesting we wait 3/5 years before we get concerned
          we should fight every battle as if it’s our last— i agree with this

          but i am suggesting that the next few years show if we have blunted the rise of tyrant obama or we have failed to do our duty solely through the election process, at which point we must seek the alternatives (which i pray we wont have to do)

    I have been saying for a while, its just a matter of time before he goes around congress. Thought he would wait until after the election, BUT with this edict it will help him get reelected thus the reason for it i would guess.

    We must have congress put a stop to this, if he can do this then what is the difference between a dictator and us?

      He will indeed to anything he wants, constrained momentarily by the desire for re-election in 2012. If he wins then, what little reserve he has will go down the toilet. At that time, he can do ANYthing, and he will. This is not just an incompetent president, but a bad person, IMHO.

        If he is reelected then will come the great test of the We The American people!

        Well historically speaking yes. Marx originally thought the revolution could happen peacefully and internationally. He just miscalculated the possibility of changing the trade-union conciousness to a socialist conciousness. It was Lenin and Stalin who refused any compromise with those wanting a democratic-like government and violently destroyed anyone who stood in the way of the dictatorship. Obama is more like Stalin than Marx. After the purges, Stalin believed in manipulation to accomplish his goals. If he were like Lenin we would be dead now.

          Lenin and Stalin both understood that the western/capitalist nations’ standards of living were so good that a “fundamental transformation” of those political/economic systems could only be achieved by violent overthrow of their governments.

          Lenin fomented revolution in Europe but died before any of it came to fruition. Stalin continued the plan but was thwarted (ironically) by Hitler’s National Socialism.

          After WW II, Stalin tried to invade Persia but was stopped by Truman and the threat of American nukes (Stalin hadn’t stolen the secrets yet). Stalin then convinced (and supplied) North Korea to invade South Korea.

          The ComIntern and the internationalists in the socialism movement finally got one of their fellow travelers in the White House. It’s not by accident that Obama thinks that pesky old document (the Constitution) should be shredded. The Chuckie Schumers of the Senate see big things on the horizon (as soon as they throw freedom under the bus).

          It’s been a long, hard road for the socialists, but they see victory ahead in the USA. Once the USA falls to socialism, the rest of the world will submit.

The other great deception in our generation is; modern-liberals have convinced people history doesn’t matter. I have been reading about the revolutionaries of the 19th century (like LaSalle, Marx, Proudhon, and Bakunin) and I find they all seem to have been lazy plagerizers. but had enough wealth or sponsers to allow them all the idle time to construct their diabolical plans.   4. I’ve written in 2008 on my blog that Obama’s rise to some extent mirrors the rise of Vladimir Putin. Stealth candidate with rather dark past jumps on the political stage, claiming his committment to hope and change.

    What Obama is doing now, is called “using the administrative resources” in Russia. You will see more and more of that.

After all, Obama has been in a continual attack mode of the Republic and the Constitution since 1/21/09.     So whats news about that today? This has become the process of the times by both parties in the Executive Branch and Office of the President!

    The construct of the constitutions mandates and authorities for the branches of government have long been disposed of except for an occasional side show.

    The people of the land obviously have no vested interest in what they do other than for the pleasure of poolhall debate.

          Thanks Don! From ['essentially'] 1934 presidents have signed executive orders granting themselves powers inconsitent with their constitutional authorities. Some folks have been around long enough to observe many of those signings and many today, haven’t a clue.

          Presidential executive orders and signing statements have become the most unconstitutional abuses within the Executive Branch today. In the most recent of modern times, from President Reagan forward, this abuse continues. One of the longest running effects in our more modern times would be that of the National Larbor Relation Board (NLRB), signed into existence by a presidential order in 1934.

      The Roman Republic (Before the Cesars destroyed it with tyranny) had the greatest ‘checks and balance’ system in the world. There were two presidents (consuls) who shared authority, but were not allowed to do anything unless it was approved by the other two parts of the government; the Senate and the Public Assembly. Citizens we’re required to take an active role in the administration of government in order to keep the balance of government level.

      America once had a similar system but greed for power (Cesars) have destroyed the balance. From activism in the courts, overreaching presidents and congress, to voters who are only interested in voting themselves wealth, we are on the brink of a Constitutional collapse. The American voter has failed the country by putting the country into the hands of an idealogues with too much power. A republic is about exchange of ideas with advice and consent from opposing views. But Obama is not interested in anybody’s view but his own, which were born out of associations with communist mentors and socialist supporters. He is the spearhead of a major change in this country and if we can’t stop him now, too late is just around the corner

    Have been wondering for quite awhile — where are the conservative power brokers? We know they exist and have worked behind the scenes for decades, yet the past two years, it has seemed that only the leftist/islamist cabal has been seen in action. When does obama step on the wrong toes, and when does the backlash start?

    Anyone watching closely for the past year knows this is predictable behavior by the administration. Over 80 years of increasing the power of the presidency coupled with trading the rule of law for administration edicts via the multiple agencies have resulted in a dictatorship. The guy and his handlers know no one will try to impeach him, because it would make Watts look like a Sunday picnic….

    the (righteous) rage that I read in the comments above makes me very sad. This administration is actively trying to divide the Nation , in ways that have never been seen before.
    Against the true spirit of the Republic, this administration promotes class warfare and demotes liberty.

    To Gary Fales: You don’t see the WH succeedintg with this attempt? Obama basically ordered the health insurance companies not to communicate negative things about his Obamacare bill. This shut them up. The government has enormous resources and pressure to use against anyone or any company.

    The only way I can explain Obama is a lawless thug politican. He MUST be stopped. With a cowardly Rat leadership, I don’t see anyone really calling him out. He has gotten away with plenty already.

    I don’t see how he thinks he will enforce this. Only Congress can pass laws enforceable on the general public, the president cannot. Executive orders can only be enforced on government entities under the direct authority of the executive branch. Contractors, while doing business with the government, are not under the direct authority of the executive branch. They are private businesses and have all the Bill of Rights freedoms of any private business. They can just ignore this, and should. It is utterly unenforceable.

    The usurper and his shadow government haven’t blinked yet. There is no doubt now in my mind there are any instruments of constitution and rule of law in the traditional sense capable of stopping this train of abuses of power. Obama and his ilk are going to take this country and everyone they can into perdition before they relinquish one iota of tyranny and treason they live by. Truth is they haven’t to date. The Nomenklaturer class and their bosses have not given an inch of ground since January 2009 no matter what has been thrown at them.

    Somebody tell me how you get rid of power and greed like this? Other than the higher power of the Good Lord and the Will of The Sovereign, that’s us peons, through traditional constitutional redress, if those forms of redress are ignored and brushed aside at every turn? Is it going to come down to forcible redress in the form of a second declaration of independence from tyranny?

    If we make it to 2012 with any semblance of rule of law intact it will be beyond remarkable. I see so many signs of tyranny and coupe from inside out, the nuclear option of Marshal Law being declared under false flag pretenses, in order to keep the will of the people from prevailing over tyranny in 2012, is a logical distinct probability. It is certainly the most likely progressive step in retaining unlawful power in a Republic. Or whats remaining of it.

    They do not actually have to implement. Merely suggesting that they might try sends a message. “Sure, you can resist, but if you do not comply, you will get no more government contracts.” When the government controls your livelihood, you do what the government tells you. When the Government is big, the Citizen is small.

    This is an attack on the opposition’s campaign money tree… and on individual freedoms. It is purely a raw power move. Thugs.

    The question is not if Obama will be re-elected. The question is how he will steal the election. Take a close look at Harry Reid and his re-election to office in Nevada. Reid was a beaten man, yet he won re-election in one of the most bizarre ways ever. One union controlled the voting machines (the slot machine union ran the voting machines) , that union delivered to required vote to keep him in office. Nobody will ever really know what the actual vote count will ever be. You have groups in place to throw the election in Philadelphia, Houston and other large cities. What will be the result if Obama is “re-elected” with a cloud of suspicion? Can this republic withstand such a situation? Will Congress move to throw out the election? Will the Supreme Court make the election illegal? Or, will Congress buckle, and the Supreme Court fail to guard our freedom? To me this is the most dangerous time in history. One of the most stabilizing influences we have in this country right now is the Tea Party. It goes out of its way to maintain national sanity. Should it fail in its endeavor, are we then at the mercy of the kooks of society?

    and then rallied (SC and Congress) and had the election w/o the marxist/socialist candidate, i feel confident
    the dems have an extra card up their sleeve. they don’t want to play it
    unless needed, but they had to make sure ole harry wasn’t sidelined like
    powerless pelosi. i was waiting to hear ole harry won to confirm my suspicions. the fix was in, as they say on t.v. (ombafia style).

    imho – this isn’t going to end well, so folks might as well get it in their heads we are not going quietly into this good night. there are no kings or dictators in the US of A. never have been, never will be as long as good men still live and breathe. there really isn’t any choice on our part.

Once it comes out that unions are excluded the public is going to freak. When the DISCLOSE Act failed the first time he still had decent approval and trust. Dictating a law he couldn’t pass will be the straw that breaks the camel’s back. Come October would anyone be surprised to see Hllary run when his numbers are still in the low 40s?

    The answer in 2012 is Paul Ryan. Obama clearly fears him, all you have to do is look at his face when he gets confronted by Ryan. This we don’t elect congressman to the White House is nonsense. It’s happened twice and the first guy had only spent 1 term in office.

      Cp4three2-I agree with you about Obama’s abject fear of Ryan.This fear is based on the fact that he understands Ryan truly is an intellectual heavyweight, one who understands economics and has a keen sense of history.
      The fact that Obama had NOTHING to offer of substance compared to Ryan should give Ryan’s candidacy much consideration. The main caveat is-whether Ryan has enough heavyweight backers to support him.Obama had many powerful hidden hands gracing his path, some of which will come to light, others will remain forever hidden.
      Therefore, if one looks to a candidate who can take Obama to the cleaners on the economic front-just for starters-Ryan is an obvious choice.

    I guess any contractor can get standing to challenge this requirement if it writes something like “decline to answer on the ground of the 1st Amendment” on the pertinent part of the application and gets its application rejected for that reason. Or: An individual would have standing, if an officer or director has 1st Amendment protected contributions disclosed, as part of the required application process.

    The president may be committed to an “unprecedented level of openness in Government” but it is unprecedented only because few administrations have been so opaque.

    The expectation of transparency created by President Barack Hussein Obama has morphed into a veil of secrecy which threatens to make the Obama administration the most clandestine government in America’s history made even more secretive by media acolytes which aid and abet the administration’s shrouded activities.

    It seems that virtually everything of consequence Obama does is cloaked in mystery and hidden from the public eye or restricted to carefully-selected witnesses such as his immigration reform summit. Inexplicably, Al Sharpton was invited to that confab. Even more inexplicably, governors of every border state were not.

    Last month, Obama added an almost-comical touch to his secretiveness by accepting a transparency award behind closed White House doors. This week, Press Secretary Jay Carney added to the comedy but telling reporter Jay Kinsolving at a news briefing, “I’m not going to take your questions.” Kinsolving had planned to ask about Obama’s openness.

    Aside from the entertainment value of those incidents, the administration’s lack of transparency is unsettling to say the least.

    From the outset of the Obama administration, it seems Democrats led by the president have acted overtly and covertly to conceal the inner workings and information available to the federal government, that “national asset,” from the scrutiny of the public eye. . .

    The truly interesting thing about this is that while it purports to make the bidding-awarding process less susceptible to undue political interference (or lessen the appearance of impropriety) it undoubtedly increases that perception.

    Now, when the decision-maker gets to simultaneously look at a list of what contributions each company bidding on a particular contract has made, then the system has a greater potential to be *more* corrupt than ever. Now one have all the information one needs to exclude one’s political enemies and reward one’s allies, regardless of the merits of the bidding.

    Of course, knowing that contract-awarding officers have this capability will certainly influence both CEO’s and individuals to alter their contribution behavior to the extent necessary to survive as businesses. And that’s largely the point.

    Is this the Hope, or the Change? It certainly is “audacious” to claim this is about improving the perceived integrity of the contract-selection system.
