Gunwalker: Justice Dept. Violated U.S. Laws Beyond Those Being Investigated
As an aside: having spent many hours in discussions and negotiations over the exception in the Kingpin Act for authorized law enforcement and the intelligence community, I can assure the reader that the intent of this provision was not to allow for the transfer of thousands of semi-automatic weapons to cartel members. The intent of this portion of this particular Act is to allow for cash payments by U.S. law enforcement and intelligence agencies to confidential informants and intelligence sources within cartels to aid in their dismantlement, and not to facilitate the transfer of weapons used to murder hundreds of innocent civilians in Mexico and a U.S. Federal Border Agent.
As part of Congress’ ongoing investigation, as well as its constitutionally mandated oversight activities, it should be asked of Attorney General Holder if any such specific licenses were requested or granted by the Treasury Department. Additionally, Treasury Secretary Geithner should explain whether his Department has begun an investigation into these apparent violations of IEEPA and the Kingpin Act.
Interestingly, and of serious note — if Secretary Geithner finds that the laws and programs which his Department administers have been violated, Treasury procedures mandate that the matter be referred to Eric Holder’s Justice Department for enforcement!
Perhaps the appointment of a special prosecutor is necessary after all.

Once Holder realizes he has violated this law, (probably after reading this article), you can be sure that he will arrange to have the required licenses, appropriately back dated, to cover his behind.

I see the humor in that … and also in the suggestion of appointing a special prosecutor … Heh! “Treasury procedures”?? – I bet the WH has that one covered too. I am sick and tired of this administration; “lawless” doesn’t even begin to describe it. Something is amiss when an entire administration dedicates itself to interpreting/revising and selectively applying our laws in pursuit of the almighty agenda of fairness; it strikes at the very heart of our nation and it feels dirty and looks ugly. For the sake of every singly person that lost their lives both here and in Mexico; I hope that justice comes to those that perpetrated this awful abuse of power.
What’s concerns me more, … is what this wanton abandonment, twisting and perversion of law will allow a unified Government to perpetrate, be it Democrat party led OR Republican party lead against an increasingly less free American people.

All partisans need to remember that the law cuts both ways – it can’t suddenly be okay to do normally unsavory things just because ‘your guy’ is in office. Someone else can and will use the new cuts in the law to conduct their own scandals, even assuming if the one who enacted those changes did it for good purposes.

Walt, you might want to consider that you weren’t invited to these meetings or conferences simply because you did the job the way it was/is supposed to be done, and that represents being too honest for the crooks to want to try to convert. I would like to see PJMedia do an analysis of the National Defense Authorization Act’s section that seems to allow the government to imprison US citizens, on an accusation of terrorism, indefinitely and without charges. One section says that doesn’t apply to American citizens, and the next leaves that open. To me, this is clearly unconstitutional when applied to US citizens on US soil. It seems to me that the FBI would be the appropriate agency to arrest American traitors acting on US soil, and then charging them, which would allow for a trial. Any Americans captured on the battlefield outside the US would fall under the authority of the military.
McCain seems to have lost his marbles. I heard his explanation of why these statutes were acceptable and found it seriously wanting. What with him first trying to limit political free speech via his campaign finance reform law, and now this attempt to deny US citizens right to a trial, I have to question his commitment to the oath he took to support and defend the Constitution. His previous military service doesn’t excuse him from his current stance.

You are interested in subtitle D – Detainee Matters
Section 1031 contains a recitation of the authority governing this subtitle. It is modified by Section 1032(b)(1) and (2).
Section 1032(b) (1) specifically states that this subtitle does NOT apply to American citizens.
I don’t know whether people keep picking up on legitimate questions that were raised and addressed already, or they just don’t know how to read legislation.
That’s why I asked PJMedia to run an analysis of those sections in question, because I do not understand them, even after reading the bill. Language above the section that excludes US citizens, does not exclude US citizens from arrest and indefinite detainment by the military.
While I am all in favor of dealing with American traitors, it seems to me that any American citizen involved in terrorism on US soil, should be dealt with by the FBI, arrested, charged, tried, and then shot if found guilty. By no means should the US military be involved in same on US soil, except in the case of a catastrophic event.
Americans engaged in terrorism overseas, in zones where US forces are engaged in combat operation, should be dealt with by the military.
Terrorist Americans, overseas where US forces are not engaged in combat operations, should be dealt with by the CIA, under the legal guidelines they operate under overseas.
AND, it’s entirely up to obama to decide who is a terrorist and what is determined as terrorist actions.
And why would anyone in their right mind give THIS President that kind of power.
Plus, there are enough provisions written into this law, that allow for waivers, that there is plenty of wiggle room for the government to do whatever it wants.
We have seen in the past, that the government always pushes the edges of the envelope, and we can certainly see them doing so in this instance.

Persons who commit acts of terrorism against the US whether citizen or foreign become terrorists not combatants and are not subject to American civil or criminal laws, or even the Geneva Convention. They are not actors on the battlefield, they are terrorists. This is not new.

Add to this, Where is the Secretary of State Hillary Clinton and the Directorate of Defense Trade Controls (DDTC)? They oversee the US International Traffic in Arms Regulations (ITAR).
When firearms were showing up in Mexico of US origin which had not been licensed for export by DDTC, why was there no investigation opened?
Why did the Secretary of State not investigate this blatant violation of the President’s exclusive conduct of foreign policy powers? Could it be that she already knew the export of the firearms was being conducted by federal agencies? Could it be the refusal to investigate the US entities and persons where the firearms originated for export violations was Administration-wide policy to avoid revealing Gunwalker?
I always wondered, and commented, why the DDTC couldn’t shut down the US origination points with their administrative and civil penalties, much less criminal charges, by simply showing the exporter knew or should have known the firearms were being sold to individuals intent on smuggling them to Mexico.
We have seen this before. It is worth recalling that Attorney General John Mitchell was found guilty, in 1975, of conspiracy, obstruction of justice, and perjury. He was sentenced to two and a half to eight years in prison. His base crime was his role in the Watergate break-in and cover-up. It did not involve the illegal delivery of thousands of weapons to know drug lords, the murder of a US peace officer, or the slaughter of hundreds of innocents. By comparison, the current alleged crime(s) are far worse.
There are several conflicting legal issues in the case. All federal prosecutions run through the Department of Justice, so it is impossible to prosecute yourself. History has proven that an independent prosecutor is an inherently flawed remedy. It is a band aid attempt to cure a problem beyond the scope of our Constitution, a criminal Executive Branch. But there is no statute of limitations on murder. Hence, a new Administration, Senate, and House would have full powers to clean house, indict, prosecute, and punish serious felonies.
Those of us, with gray hair, remember that John Michell’s boss, President Nixon resigned his Presidency in the face of certain impeachment, and removal from office, for Watergate. Today, the path to impeachment would not ripen before election day. But the issues will be debated in the campaign.
Nixon, Clinton, Obama: we must do better in selecting leaders, or cease to exist as a free nation.
Why don’t we let the Mexican authorities type up the indictment and extradite their butts to Mexico…hmmm sounds like a plan….

Ah, it’s a tangled web they weave. I presume they also violated Mexican national laws regarding gun running, and we do have an extradition treaty with Mexico; American presidential pardons do not apply to Mexico’s controlling legal authority. It would be ironic to see the Holder department denying extradition on the grounds of possible Mexican custodial civil rights violations regarding prison standards and practices.

If you watched Huckabee over the weekend, 3 states attorneys general (Florida, Pennsylvania & Oklahoma) questioned each republican candidate on the fairly obvious and deliberate attempts of this administration to trash Constitutional limitations on the power of the federal government and the Constitution in general.

It’s curious how the Holder crowd reopened the enhanced interrogation legal authorizations and possible CIA agent violations of those transparent authorizations legal opinions and conditions, and the lawyers who made them, to further investigations for possible violations, but they spent the last year denying that any department lawyers knew or approved anything regarding an alleged illegal gun running operation to Mexico that did not happen. If memory serves me right, the special prosecutor law regarding presidents expired on a bipartisan basis. That only leaves impeachment when it comes to presidents. Suppose Obama gets re-elected, could be interesting times.
Obama has not retracted or even amended his statement of “full confidence” in Eric Holder.
It should follow the trajectory of his refusal to disavow Reverend Wright, until, one day, Obama’s hand was forced and there went the ole Rev., under the bus.

We are now getting reports that it isn’t just guns. The DOJ apparently also engaged in money laundering of cartel funds. It seems that would also be illegal and a violation of this particular law.
The comments indicate to me that Americans are skeptical that those in the Obama administration will obey or enforce the laws, be they state, federal or local.
The significance of this is huge.

No wonder people don’t feel protected by the law anymore. No wonder gun and ammo sales are shooting through the roof.
Another four years of Obama and this nation will be unrecognizable to anyone who died in 2009 and magically came back.
One more thing, to give my politically correct neighbors a chance to fire a volley of racist charges at me, I’m reminded of the roaming bands of blacks attacking whites willy-nilly, especially outside public events like the Wisconsin State Fair.

One of the “kingpins” of the Downtown prostitution, drugs, and theiving operations was actually a pretty good customer and to a point I could ignore the fact that people who worked for him and I were practically at war over their attempts to remove stuff from my shelves and racks and my trying to keep my stuff. He remarked to me shortly after Jackson abolished the Foot Patrol, “Now y’all won’t be able to put us in jail no more.” I didn’t really realize how right he was. Soon, if we saw a cop at all they were “investigating” a complaint that I or some other merchant in the area had brandished a weapon or had threatened someone. I wouldn’t think of my wife making the run to the bank anymore and I’d have rather done it with no pants than no pistol. Between the Arab Oil Embargo and crime making Downtown Atlanta uninhabitable, I got what little I could for the business and took off “North to the Future.” The only times my shadow has darkened Atlanta since is however long it took to get my rental car at the airport and get to I-75 South, except I did drive up from the civilized part of Georgia to take my nephew to a Braves game since he’d never seen one and drove up a little early one time so I could take my wife to the Hyatt Regency so she could sit in the revolving lounge, from which you now only see taller surrounding buildings, and see where Jimmy Buffet wrote “Let’s Get Drunk and Screw.” And what was tragic, the bartender didn’t even know the story.

Mark, you paint with too broad a brush. We only know about this at all because some people in law enforcement sacrificed their careers to be whistleblowers. Now I’m not one of those naive people that thinks the cops or the military will side with “The People” if they’re given an order to move on us, but most in law enforcement, or the military for that matter, are just doing their job and they don’t think much about what they’re being asked to do or who’s doing the asking. There’s really not a lot a difference between a cop, even a federal cop, and any other working stiff except s/he probably gets paid more and has more job security.
That said, the political level of law enforcement can be really rotten, really corrupt SOBs. It is pretty clear that the political level of the management of the FBI, DEA, BATFE, ICE etc. were pursuing with missionary zeal an operation to plant US gunstore weapons in Mexico to provoke popular support for, at minimum, re-institution of the “assault weapon ban.” Leftists NEVER forget a defeat and they never forgive the people who defeat them. The Left won’t rest until they outlaw scary black guns and this was their “under the radar” plot to make that possible. Comrade Obama had to have least known enough to give a tacit approval while maintaining plausible deniability of being directly involved. Holder and Clinton were almost certainly the approving officers and were thoroughly briefed though always orally; even Lefties aren’t stupid enough to write this stuff down – usually. There is unlikely to ever be any objective proof of either knowlege or approval at the Cabinet level or above and you’ll never move the useful idiots and wild-eyed moderates and independents with a circumstantial case against people this high up the food chain. The most that can be hoped for is to defeat the Communist SOBs in ’12 and perp walk the political level management whose direct reports carried out this operation.

It also appears that the Arms Export Control Act has also been violated. Furthermore, each and every individual gun that made it across the border is considered a separate violation. It IS possible to get exemptions but as best as I can discern those exemptions were never applied for or granted.

Justice Department is doing the classic ‘duck dodge and downplay’ and we -have- to call them on it. People have died as a result of this scandal and I think we can all agree it has gone far beyond the scope and impact of Watergate. Secretary Holder was never cleared to receive this, uh, level of information. This is clearly for NYT eyes only. He, uh, is utterly in the dark about all this. In upstate New York, the anti gun assault has now opened fire on the second amendment in a new way.
It’s a sort of a sting operation that works like this.
As weapons are being brought into gun shows or gun auctions, a fed or state agent offers to buy the guns from the owners. This happens on the “look see” day; a day or so before the show or auction actually takes place.
As the guns are brought in the door, the fed or state agents pounce on wood-be sellers.
The agents offer the sellers money for the guns; then arrest the sellers for not doing required background checks.
At this point, it appears to be a fed directed state operation.
Whether it’s a legal operation or not is up in the air. But it’s probably entrapment; an example of Bamabits and Eric the terrible bastardizing the law for their corrupt agendas.
Or just another typical example of “Law Enforcement” at its “finest”. Who needs a steenkin’ oath to “…preserve, protect, and defend the Constitution…”? Surely not the Blue Wall…

Trouble is, the commenters in here are in my opinion, the only ones who’ve nailed Obama and Holder and the rest of the gang for what they really are, and what they really want.
The Obamunists don’t act of of ignorance, naivete, or miscalculations or misunderstanding. They know exactly what they want. They want to take away the second amendment and every other of the Bill of Rights along with it. They’re out to shred the Constitution. To bankrupt America both morally and financially. They’re as singularly motivated as the Japanese of WW2.

Folks, when American Thinker writes”they cannot get past their own narcissism and ignorance enough to ever admit failure” they’re got it all wrong. This isn’t about narcissism and ignorance. It’s about operating government with the intent to destroy this country. What Obama does he means to do.
Hugh Hewitt, Michelle Malkin and all the others except Rush Limbaugh are misreading Obama. Ignorant, miscalculating, misunderstanding he’s not. What he is, is out to corrupt this nation any way he can.
He’s out to destroy us. It’s a distinction that, if America fails to make, could take us four more years down the road to hell. Then not even Audie Murphy in his prime could save us.
I agree wholeheartedly that all of this (the entirety of Obama’s agendas) is deliberate; it troubles me that most on our side want to rest their laurels on the notion that all this is coming from narcissism or ignorance, but I cannot help but wonder if it isn’t a case of just not wanting to admit that all this is deliberate because of the race-card issue. No one out there is displaying a resolve to get this man out of office NOW instead of waiting for next year’s election. This administration has done things that literally dwarf the significance of Nixon’s Watergate mess, Reagan’s issues with the Contra affair & anything the Clintons did while in office. Why impeachment proceedings are not underway makes no sense to me unless there is the issue with the race card. It’s all very disgusting to my mind & all these people up there who can do something about this administration should hang their heads in utter shame for sitting on their hands.
It would be impossible to convict Holder, Obama, or any other Democrat miscreant before a Democrat controlled Senate and the Democrats and the media will simply trash the Republican controlled HOR. Few of the Republican leaders survived the Clinton impeachment debacle and some of the survivors were fundamentally changed by it, e.g., Sen. Graham. Those of you who deride him as a RINO these days might recall that he was a firebrand leader of the Clinton impeachment; once burned, twice shy.
