BREAKING: DOJ Undermines Pentagon, Allows Wisconsin To Ignore Military Voting Protections

This is a disgrace, plain and simple. Military voters, their families, and veterans organizations should be outraged at the Holder DOJ.

It is 2008 all over again. Today the Department of Justice effectively rewrote the 2009 MOVE Act designed to protect military voters. In a settlement reached with the Wisconsin Government Accountability Board, the Holder Justice Department allowed Wisconsin to mail ballots to overseas military voters only 32 days before the election, instead of the statutorily mandated 45 days.

Once again, it is no accident this embarrassing settlement is being released on a Friday, so fewer might notice.

The Pentagon had denied Wisconsin’s application for a waiver from the 45-day requirement: “The states granted waivers presented thorough and comprehensive plans to protect the voting opportunities for military and overseas voters,” Bob Carey, director of the Federal Voting Assistance Program, said in a statement. Wisconsin’s waiver application didn’t even come close to compliance with the MOVE Act. They wanted to send ballots only 29 days before the election. The folks at the Pentagon rightfully denied the waiver request.

The victory for military voters was short-lived.

Instead of aggressively suing Wisconsin immediately after the waiver denial, the DOJ engaged in secret negotiations. An immediate lawsuit would have strengthened the negotiating position of the DOJ as well as preserved various equitable legal arguments, including the argument DOJ waited too long to commence litigation. Instead of doing the right thing, the DOJ did the easy thing and reached a settlement with Wisconsin that undermined the Pentagon’s denial of Wisconsin’s waiver request.

The tough negotiating stance of the Holder DOJ extracted a whopping additional three days out of Wisconsin. Ballots will mail 32 days before the election instead of 29. A consent decree filed Friday will reflect this quisling agreement.

This is a disgrace, plain and simple. Military voters, their families and veterans organizations should be outraged at the Holder DOJ.

It is true that time was added to allow ballots to roll in after the election, but time after the election is different in quality than time before. The MOVE Act was explicitly designed to add time before an election to ensure the solider would get a ballot in time to benefit from the express delivery requirement under the MOVE Act. This guarantees that ballots placed in military mail at least 7 days before an election will be returned in time to be counted. By sending ballots only 32 days before the election, many overseas soldiers will be denied this important guarantee. Congress specifically rejected post-election add-on time as a solution. Compressing the pre-election time ignores both of these important statutory purposes.

The limp DOJ settlement demonstrates a core fear inside Justice of litigating military voting cases. Even when the DOJ actually acts to protect military voters, the investigative methods resemble the Keystone Cops.

After the administration changes, an increasing possibility in 2013, it will be essential to clean house and install litigators who don’t flinch under fire, both in the courtroom and also on the battlefield. It’s time to put someone in charge of protecting military voters who cares about military voters, preferably with military experience.

Senator John Cornyn has put the heat on Justice, and blocked the nomination of James Cole to be Deputy Attorney General. Justice was desperate to have Cole confirmed weeks ago, and the military voting mess has aggravated top DOJ leadership. Americans rightfully outraged by the DOJ concession should send notes of support to Senator Cornyn for his efforts to protect military voters. The shameful Wisconsin settlement will likely strengthen Cornyn’s resolve on the Cole hold.

Could Wisconsin have done something differently? Lots.

    How long will this madness be allowed to continue before Congress finally starts to conduct some real oversight? And based on prior articles, it appears that Becky Wertz is the career official responsible for this non-enforcement. She really needs to be fired!!

    Why does this action from the DOJ surprise anyone. This administration is about divide and conquer. I hope that the true America comes out. You know, the one that could not be divided or conquered.

    Great article! This fits a pattern we’ve seen in Texas for years, with the Democratic Party trying various methods to disenfranchise military voters either stationed at bases here or being from here and stationed elsewhere. It’s a disgrace that that party owns from the top down.

    Beyond the immense disrespect to our US Military, could this decision in Wisconsin have any thing to do with the tight race democrat Senator Russ Feingold finds for himself? Is the dem party using all means available to hold on to any elected seat?

      Yes. And IF Feinie, or Kohl for that matter, CARED about ALL WI voters and believed they had a right to choose, they WOULD be NON stop talking about this. But they are not. Feinie gave a lil blurt about it, blahblahblah but nothing came of it. He’s too busy trying to keep HIS job – the cushy one that allows him to live off taxpayer dolla – to worry about a bunch of patriots from the state who ‘probably wouldn’t vote for him anyways’.

      Are you kidding? Voter fraud has been epidemic in AT A MINIMUM the last 3 elections in Wisconsin.

      I live here – Milwaukee is the worst. Milwaukee IS THE POSTER CHILD (and test platform) FOR ACORN VOTE FRAUD PROGRAMS – especially those based on absentee ballots. They tested it here before they used this system to put that fecal dropping Al Frankin in as Senator in Minnesota.

      1) No voter ID is allowed – fought for tooth and nail by our Governor to “protect the voting rights of disenfranchised citizens” (the dead, the completely mentally handicapped, those that need to vote quickly and often, imported voters from as near as Illinois to as far away as South America, the very important synthetic person). Jim Doyle is one of the most corrupt politicians that has ever sat in office in this country.

      2) We always “find” one more box of absentee ballots in any important and close election.

      3) We are banned from investigating and verifying the validity of the voter roles.

      4) Poll watchers and poll investigations are “discouraged” in many areas of Milwaukee – especially amongst those who are supposed to be investigating fraud attached to the Milwaukee Police Department.

      5) Election officials who are hired or rehired in the city of Milwaukee have a history of convictions for past conduct (the 2004 Election Commissioner had just gotten out of prison to run the election after being convicted in buying votes from the homeless in exchange for cigarettes).

      6) US Representative Gwen Moore’s son lead a group (gang) of his friends to destroy Republican campaign offices and vehicles and got off with a wrist slap misdemeanor.

      7) People who have tried to act as witnesses for vote fraud at their polling places have had their identities out from within the Milwaukee PD and have been confronted in their homes by thugs to silence them.

      8) Of course, Doyle vigorously defended NOT allowing timer for military votes.

      It goes on and on and, with a corrupt Governor (a close friend of Obama’s people) who was elected under this system after having been the former State Attorney General and having a real iron control over the legal system of this state, no one has made any headway to investigating are controlling this mess.

      The Demoncraps own this state and the folks in the Berkeley of the Midwest – Madison – aren’t about to willingly lose their control over this state … that’s why Obama spends an inordinate amount of time here.

    Of course, it is just coincidence that voting patterns of Puerto Rican voters trends towards Democrats and voting patterns of military families tends toward Republicans.

    That would be a crass political move worthy of investigation. This is merely bureaucratic red tape, not nefarious gerryrigging of elections. However, we could always ask ACORN to assist, they are a neutral third party, helping with getting our voting process free from illegal and improper influence.

    When the election process is demeaned down to the level of a banana republic, when the credit card check verification is shut off, when club wielding thugs are allowed to plant themselves in front of polling places and get to talk about killing “cracker babies”, when counties enroll more voters than there are voting age adults…we ARE no better than a banana republic.

    It is more important for leftists to “win” than it is for those charged with protecting this nation to ensure fairness in the contests…then we can no longer call ourselves a democracy. We are a sham. And, if that doesn’t bother the people who are mandated to protect us, we need to get different people…or admit we don’t care.

    This action is a slap in the face by both Wisconsin and the DOJ to those who are willing to risk their lives for our country. How will this affect the closer races Wisconsin voters will face this November such as the US Senate seat currently held by Sen. Feingold? Shame on Wisconsin and more shame on the DOJ.

      Folks, this kind of stuff is getting out of hand.

      The democratic national committee is actively funding local races in large urban cities for County treasurers in Texas. These are the people in charge of registering and counting votes. The fraud in rampant, and that fraud is slanted 100% to the left.

      The DNC has had monumental success with a similar program to infiltrate operatives on the state level. Their secretary of state initiative gave us that bufoon Al Franken. Any reasonable person that actually looks at that little fraud in Minnesota further than what the left wing MSM presents, will be not be just disgusted, but angry. It was a total fraud.

    I don’t get HOW anyone supports a democratic head? they fight for an illegals right to vote – they SCREAM about disenfranchising when other are saying: we MUST have a voter ID card (well.. Mickey Mouse and the Dallas Cowboys dont have ID specifically to show thats WHO they are!) Texas votes in question, as fire destroys ballot machines, ACORN operates under a slew of new names, Large amount of stimulus money directed towards union jobs, and Military votes at risk. Holders refusal to prosecute a slam dunk case against the New Black Panthers should have been a wake up call. As thing have developed in the last few days it appears that Obama will allow the NBP to be his enforcement arm to secure the votes in those areas that they operate in with impunity.

    Notice it is the “blue” states that have a problem meeting the
    needs of the military vote. Elections matter.

    The Secretary of State and Attorney General of each state is responsible
    for protecting voter rights. These positions are either voted into office
    or appointed by the governor of each state. It is also their responsibility
    to adhere to federal election laws. If you care about the voting rights of
    all Americans then vote carefully for your Governor (appoints), Secretary of
    State and Attorney General.

    If we change Congress in November, I pray they have the guts to convict
    the racist Holder of contempt of the Constitution and the American people.
    Holder deserves a special cell in Gitmo.

Sure, we have to elect conservatives to Congress but yes, the change has to start at the local and state level and until the general public understands this it is going to be very difficult to get real political change in this country.     The DOJ is turning into a hotbed of pure thuggery.

    A friend of mine very innocently started withdrawing cash via the ATM, maximum ATM withdrawal at a time from one of his bank accounts and deposited the withdrawals in another bank. It was a clumsy and innocent attempt to protect his money during the financial meltdown. The DOJ flagged him for “suspicious behavior” (i.e., “money laundering”), and seized his accounts. Now get this: the DOJ offered to NOT prosecute him if he agreed to let them keep 60% of his money. WTF? He committed no crime, none whatsoever, and broke no laws at all. None. Period. Even a federal lawyer from another agency said he was being extorted. He also subsequently lost his job.

    They are criminals over at DOJ. Criminals plain and simple.

    I’ve been outraged with Holder since he *ucked up the Florida convictions 10+ years ago.

    Then again, the FCIC (Financial Crisis INquiry Commission) who’s responsible for investigating the 2008 economic meltdown. And has provided NOTHING when the Oversight Committee and numerous newspapers have asked for spending, their findings.

    The FCIC were given an $8 million kitty. They’re now asking for an extra $1.8 million. Also, the FCIC Chairman and Vice Chairman are shopping for a publisher for the report!

    It would be so funny if it weren’t so sad..

    I would guess they are. But the Holder DOJ doesn’t really give a flip, so it really doesn’t matter much how outraged anyone is.

    We need to not only clean out the Congress, but the appointed thugs and slaves that will be left in place to keep on eating away at the foundations of our liberties even after the thugs at the top have been removed.

    It’s not just Republicans and Democrats now. It’s liberty vs. tyranny….and the community has organized. Guess which large group is in favor of personal liberty and our Constitution??? It’s not the Congress or the appointed thugs. The community has organized, Mr. Precedent.

    You don’t like us? That’s ok. We don’t like you much either.

If one or two PATRIOTS who had airplanes would work out a plan to collect all of those absentee voter cards from our military and deliver them at record speed to their districts. This would definately undermine the digusting little lap-boy Holder. It can be done. We have raised the ire of the leftist pigs who are hell bent on destroying this country and our allies. Does anyone know someone with an airplane that could make the deliveries????

    I find this article very informing but I have not seen anyone mention it’s one huge mistake. In the second to last paragraph he refers to District of Columbia as a state… “Expect more of the same regarding Hawaii and the District of Columbia, two more states grossly out of compliance with the MOVE Act.” It is NOT!

      Fair enough. Calling DC a state is obviously not accurate. It was a technician’s mistake. When cataloging “jurisdictions” which have failed to comply with a particular law, it is easier to think, and write, in terms of “states” if you are listing the “things” which have not complied. I could use “jurisdictions” next time. It will be accurate but won’t read as smoothly to people who are lucky enough to have never attended law school.

  33. My son is a Sergeant in the Air force, and his vote counts are NOT being counted, after he served a tour in Afghanistan and is still on active duty??
    This is UNBELIEVABLE!!! He is a Patriot by all accounts. This is DISGRACEFUL, the things this Eric Holder has the nerve to control and do, and the causes he is allowed to take up, so his party of LOSERS, including himself can be in power of America, the land of the free, before President Obama turned and is turning it into the Land of the Opressed. Only Pajamas Media is reporting this last chapter?? UNBELIEVABLE, I and my husband say. as proud parents of a military member, who has excelled in every way possible. This is an outrage!! Let’s as voters, remember all the vastly unpopular means the Democrats and President Obama have gone against the U.S. people on everything so far and vote them out this November, and in 2012, as they are truly the PARTY OF NO!!

What else would you expect from Holder, who was personally involved in obtaining the pardons for the Puerto Rican terrorists and engineering the pardon of Marc Rich, who was on the FBI’s 10 Most Wanted List; having been convicted, in absentia, for multiple felonies. Holder committed that particular engineering job while he was working for President Clinton and only after Marc Rich’s wife “contributed” a few million to Clinton’s campaign funds and his “presidential library fund”. So, charges were brought against the New Black Panther Party by the Bush Administration. The New Panthers refused to answer the charges, so they were charged by default. Eric Holder allows the charges to be dismissed. Right? Maybe we could get the NAACP to investigate? Come to think of it, maybe that won’t work. Why? Benjamin Todd Jealous, the president and CEO of the NAACP called Anthony “Van” Jones a “National Treasure.” “He is quite simply one of the few Americans in recent years to have generated powerful new ideas that are creating more jobs here.” While Van Jones may have left the White House under a cloud, the NAACP says that’s not his whole story. The group considers him a pioneering hero for the environment and civil rights — so much so that it awarded him one of its highest honors in Feb. 2010, an NAACP Image Award. The NAACP gives out awards to Communists now. The great Martin Luther King is rolling in his grave.
